AGENDA ITEM: CONSIDER APPROVAL OF 2015 CIGARETTE LICENSE RENEWALS
DISCUSSION: Introduction
The purpose of this agenda item is to consider approval of the 2015 cigarette
license renewals.
History
Cigarette licenses are valid from January 1 to December 31 of each year and
are subject to annual renewal.
Current Circumstances
For 2015 a total of eight license renewals are being requested. Captain Jack's
has decided not to renew their cigarette license in 2015. They will discontinue
selling cigarettes by December 31, 2014.
Under the Prior Lake City Code, tobacco violations are tracked for 36
months.For each violation within that time period the ordinance calls for in-
creasingly significant penalty. Holiday Station Store #198 on Duluth Avenue
failed a compliance check in November 2012 for selling cigarettes to a minor.
This was their first violation. Prior Lake Shell failed a compliance check in
November 2013. In 2014 Prior Lake Shell and Village Liquor were both cited
for selling cigarettes to minors. For Prior Lake Shell it was their second viola-
tion and for Village Liquor their first.
If the clerk at Prior Lake Shell or Village Liquor is found guilty, the court will
impose a penalty on the clerk, and city code provides for a $150 to $500 fine
for the first violation. In the event of a second violation the fine would be at
least $700 and suspension of the license for a minimum of seven days but
not more than twenty days.
No other violations have occurred for any of the renewal applicants in the
past five years. The police department conducts annual compliance checks
for all cigarette licensees. Attached to this agenda report is a list of the busi-
nesses requesting renewal of their cigarette licenses.
Conclusion
The Prior Lake Police Department has completed an investigation of the ap-
plicants to ensure that all requirements and issues concerning public safety
and compliance have been met. All applicants have provided the required
documentation for this license.
FINANCIAL All eight applicants have paid $250.00 each for their annual license fee bring-
IMPACT: ing the total revenue for these licenses to $2,000.00.
ALTERNATIVES: 1. Approve the 2015 cigarette license renewals as part of the consent
agenda.
2. Deny the license requests.
