O� PRION ti U 4646 Dakota Street SE Prior Lake,MN 55372 AtINivESp'SP CITY COUNCIL AGENDA REPORT MEETING DATE: DECEMBER 22, 2014 AGENDA#: 7A PREPARED BY: LARRY POPPLER, CITY ENGINEER/INSPECTIONS DIRECTOR FRANK BOYLES, CITY MANAGER PRESENTED BY: LARRY POPPLER AGENDA ITEM: PUBLIC HEARING TO CONSIDER APPROVAL OF A RESOLUTION ORDERING THE IMPROVEMENTS AND PREPARATION OF PLANS AND SPECIFICATIONS FOR THE STEMMER RIDGE ROAD IMPROVEMENT PROJECT (CITY PROJECT#TRN14-000004) DISCUSSION: Introduction The purpose of this agenda item is to hold the Public Hearing to consider approval of a resolution ordering the Stemmer Ridge Road Improvement Project and the preparation of plans and specifications. A super majority (4/5) is needed to approve the resolution. History As part of the 2013 County State Aid Highway 12 Project, the City has installed the structural components of the lift station that will serve the future annexation areas. The project also installed trunk forcemain that will connect to existing forcemain already installed with the previous phase of County State Aid Highway 12 construction. This forcemain currently extends north to the end of existing Stemmer Ridge Road. In order to serve the future annexation areas, Stemmer Ridge Road together with the incomplete section of sewer and water pipe must extend from where it currently terminates north to County State Aid Highway 82. Trunk utilities were installed as part of the County State Aid Highway 82 in 2007 in anticipation of future need. The cumulative value of these improvements are $4.2 Million. The Stemmer Ridge Road project would be the final link for utilities to serve the approximately 2400 acre annexation area. Recognizing this fact, the City Council placed the Stemmer Ridge Road project in the 2030 Comprehensive Plan in 2005 and in the Capital Improvement Program for 2015 construction. At its October 7, 2013 meeting the City Council adopted Resolution#13- 146 authorizing the Mayor and City Manager to enter into a contract with WSB &Associates for engineering services for the Stemmer Ridge Road project. Part of the work was to prepare a Feasibility Report. The M.S. Chapter 429 process applies to all projects that will be financed in whole or in part through special assessments or bond proceeds. Phone 952.447.9800 / Fax 952.447.4245/www.cityofpriorlake.com The extension of Stemmer Ridge Road north of the Spring Lake Estates neighborhood is considered in the report and includes improvements to parts of S 05 T114 R22, S 04 T114 R22, S 33 T115 R 22, and S 32 T115 R22. A map of the project area (Figure 1) is included in the Feasibility Report. The proposed improvements include sewer and water extension, street construction, storm sewer, storm water quality, concrete curb and gutter, and appurtenant work. Current Circumstances The Feasibility Report includes total estimated costs, preliminary assessment amounts, and a project financing summary. Also included in the report are design criteria, estimates and information on watermain, sanitary sewer, storm sewer, and streets. Details on each can be found in the Feasibility Report. Two Public Information Meetings were held on July 31, 2014 to provide the property owners an opportunity to discuss the project in an informal setting prior to the first Public Hearing. The first neighborhood meeting was with the property owners proposed to be assessed. The second meeting was held with property owners within the Spring Lake Estates neighborhood. Staff presented the proposed improvements, project costs, estimated assessments and answered general questions regarding the project. On August 11, 2014, the City Council held a Public Hearing to discuss the project. Many residents located in the Spring Lake Estates neighborhood spoke at the meeting discussing concerns over traffic volumes and speeds. The City Council directed that staff review the traffic concerns and provide other options. The specific direction is shown below: 1) Consider traffic impacts on the existing neighborhood 2) Include provisions to address safety concerns 3) Show sewer and water without setting road alignment by showing a trail for access or other measure 4) Consider alternative connections to CSAH 82 5) Discourage traffic by not including a four way intersection and not aligning with Mystic Lake Boulevard at CSAH 82 6) Work with the County and SMSC where possible Four alternatives were developed based on this direction. The four alternatives are as follows: Alignment C —Stemmer Ridge Road does not connect between CSAH 12 and CSAH 82 Alignment D —Stemmer Ridge Road connects CSAH 12 to CSAH 82 at Howard Lake Road Alignment E —Stemmer Ridge Road connects CSAH 12 to CSAH 82 at Mystic Lake Boulevard Alignment F—Stemmer Ridge Road connects CSAH 12 to CSAH 82 at Mystic Lake Boulevard along east of the large wetland The alternative conceptual alignments are attached to this report as well as a comparison matrix showing the pros and cons of each. Each alternative includes traffic calming measures to reduce speeds on Stemmer Ridge Road. These features include medians, roundabouts, reduced design speed of 35 MPH, and removal of driveways along the roadway. The four alignment alternatives were presented to the public at a neighborhood open house meeting on November 17th, 2014. The meeting was well attended. A summary of the comments received at or after the meeting is attached to this agenda packet. The SMSC has purchased a significant portion of property within the assessment area. This purchase could change the way this project is delivered. Considering the SMSC's interests in development of the project area, the project could be completed as a part of their development through a cooperative agreement. An agreement with the SMSC could assure City infrastructure be installed with their project. A separate agenda item (9A) will discuss the SMSC agreement. Conclusion City Staff is prepared to discuss each of the concerns presented at the Public Hearing. If the Council deems the issues that have been brought up need to be addressed in the project plans and specifications, direction could be given to staff. The purpose of this Public Hearing is to determine whether the project should move forward to the next step, which is preparation of plans and specifications which will provide greater information about expected project cost and, therefore, the assessments associated with the improvements. Once the plans and specifications are completed, they will be submitted to the City Council for approval and authorization to advertise for bids. The Council could decide not to continue with the project upon receipt of bids. A separate Assessment Hearing will be conducted following review of the proposed assessments by the City Council's Assessment Review Committee. In summary, the project is feasible from an engineering and economic standpoint. Approval of the Feasibility Report does not grant final approval of the project. City Staff strongly recommends that the City Council choose one of the alignment which connects Stemmer Ridge Road between CSAH 82 and CSAH 12 at Mystic Lake Boulevard(Concept E or F). This alignment is also supported by the SMSC in the event that the road is constructed under the SMSC Agreement. As discussed in the comparison matrix this is an important north/south roadway within this region of the City in terms of emergency access, traffic growth, distribution of traffic, connectivity, and park access. Accordingly, the City has been planning for this roadway connection for 10+ years and has made significant investment in infrastructure ($4.255 Million) in reliance on this connection as shown in our Comprehensive Plan. The extension of Stemmer Ridge Road to Mystic Lake Boulevard is desirable since the county anticipated a four way 90 degree intersection at this location. Howard Lake Road which is gravel is anticipated to be unnecessary and turned back to the city. Terminating Stemmer Ridge Road at the Howard lake intersection results in poor sight lines and a skewed intersection much as we saw at TH13 and Zinran. ISSUES: The alternative alignments presented this evening are conceptual. The specific alignment can't be fully developed until a concept is chosen and further design can commence. The final design may adjust the roadway location based on land development scenarios, wetlands, drainage patterns, or other topography considerations. Since these alignments are conceptual it is more appropriate to discuss general alignment principals such as whether the road connects from CSAH 82 to CSAH 12, connection location at CSAH 82, and traffic calming features to be incorporated in the final design. The residents within the Spring Lake Estates neighborhood are concerned with future traffic volumes, future traffic speeds, future casino traffic, crossing Stemmer Ridge Road to get to Howard Lake Park. They suggest that the roadway not connect to CSAH 82. A concept has been developed that does not provide a connection between CSAH 82 and CSAH 12. The concerns expressed by the Spring Lake Estates neighborhood are partially derived from the estimated 6000 vehicle trips per day on Stemmer Ridge Road shown in the Comprehensive Plan for 2030. Scott County has recently completed traffic modeling which shows a reduction in the estimated traffic which can be expected on Stemmer Ridge Road by full build out. Based on the new County projections it is anticipated that 3000 vehicle trips per day would be on the new section of Stemmer Ridge Road and 2000 vehicle trips per day on the existing section to the south. The differences between the models are attributed to a lower prediction of jobs in this region, the curvilinear nature of the roadway corridor, and lower residential growth in this region. The attached memo from Scott County discusses the new modeling results. While the results show less predicted traffic, Stemmer Ridge Road is still an important roadway in this region of the City. Scott County supports the completion of Stemmer Ridge Road to support the remainder of the transportation plan and the county roadways in the area. Depending on which option is chosen, traffic calming features on the existing Stemmer Ridge Road can be implemented incrementally or as part of this project. These improvements can include: pavement striping, installation of bumpouts, speed display signage, and possibly a roundabout at Belmont Avenue. Like Crest Avenue, certain traffic safety elements can be incorporated into pavement resurfacing projects as this 9 year old roadway ages or independently if the need arises. Considering the location of lakes and wetlands and other development in the region, the Stemmer Ridge Road connection between CSAH 82 and CSAH 12 is the last opportunity to provide another north/south roadway in this region of the City. If this roadway does not connect between CSAH 82 and CSAH 12, other roadways will be utilized to facilitate movement of traffic in this region. These roadways include CSAH 17, Northwood Road, Fremont Avenue, and CSAH 12. Of concern from a safety perspective is the substitution of a portion of the traffic to Fremont/Northwood Road. It is our opinion that Fremont and Northwood Road already have a healthy traffic demand that will continue to rise even if Stemmer Ridge Road is connected. The ultimate impact will be the excessive traffic and speeds which were witnessed just this summer when CSAH 21 was closed. It is not appropriate to shift the transportation burden from the Spring Lake Estates Neighborhood to the Fremont /Northwood neighborhood. Of the projected 3000 trips per day expected on Stemmer Ridge Road as modeled by Scott County, approximately 1200 are generated by the properties along Stemmer Ridge Road and side streets.The remaining 1800 trips per day would be other local trips between CSAH 82 and CSAH 12. Examples of this traffic include property owners within the annexation area or along CSAH 12 driving to the regional park, Dakotah Sport and Fitness, trips to downtown Prior Lake, trips to CSAH 42 and TH 13, commuting to CSAH 21 or Interstate 35, or even other Mystic Lake Enterprises. The City's consultant WSB &Associates Traffic Engineering Department has reviewed the traffic patterns. Based on a review of the existing and future traffic patterns for this area and assuming that Stemmer Ridge Road does not have a connection between CSAH 82 and CSAH 12, the following traffic diversion could be anticipated: • 30% of the through traffic or an additional 540 trips per day on Northwood Road/Fremont Avenue • Of the traffic on Northwood Road/Fremont Avenue 20% would be to or from the east and 10% to or from the west • 70% of the cut through or an additional 1260 trips per day on CSAH 17 In addition to the residents along Northwood and Fremont, staff has heard from two other sources. The first is residents in tha Autumn Acres subdivision to the south of County Road 12, Their concerns are having a north south roadway in addition to County Road 17 to gain access and egress from their properties in all kinds of circumstances. We have also heard from property owners and developers of property in the annexation area. They are concerned that the city assure that the transportation system in this area is complete just as the city has done in all other portions of the community. So there are certainly multiple stakeholders regarding this project now and in the future. We understand that these interests will either attend the hearing or submit their comments in writing. The Stemmer Ridge Road connection is important from a public safety perspective as well. Both the police chief and fire chief have commented regarding the importance of this road as it relates to emergency response to Spring Lake Estates, other properties in the area and future development including the two major parks. Allina Ambulance which serves this area has prepared the attached study. They emphasize that there are two important elements to emergency response. One is response time the other is competent care once they arrive on the scene. Their report compares four routes from Fire Station 2 to the last address on Stemmer Ridge Road. Their conclusion is, "public safety would benefit with decreased response times to this area with the Stemmer Ridge Road extension." The time savings is in the neighborhood of three minutes depending up the type of road constructed and the ultimate route. Mr. Bill Snoke from Allina Ambulance will be present to address this topic or answer city council questions. FINANCIAL The preliminary cost estimate for the four alternatives range from IMPACT: $4,733,000 to $4,985,000. The funding table below shows how the largest cost alternative could be financed by either a City"429" project or the agreement with the SMSC. Since the SMSC already own the property, this estimated right of way cost could be deducted from the project total for the SMSC project. The added traffic calming costs increase the street oversizing contribution from $277,460 to $652,000 for a City project. Due to the design speed changes to 35 mph, additional length was added to the street and corresponding utilities. New data on pipe material costs have increased the overall sewer and water pricing as well. The Stemmer Ridge Road project is proposed to be financed by Assessments, Trunk Funds, and Street Oversize Fund. The costs include construction estimates for each construction element, project support costs and right of way costs. A project contingency is also included in these preliminary numbers. To order the project, one of the concept alternatives should be selected by the City Council. While the City and SMSC are evaluating an agreement for the installation of Stemmer Ridge Road and corresponding utilities, ordering the project allows for the 429 process to continue should the agreement negotiations stall. The city would incur minimum additional cost as no further action would be necessary if the project proceeds under the agreement with the SMSC. If for whatever reason the agreement progress falters, the city could proceed most quickly to take the next steps in the public improvement process. ALTERNATIVES: 1. RECOMMENDED A motion and a second for Alternative # 1 MOTION: a� PRIL' ti U 4646 Dakota Street SE `�rlNx�so�� Prior Lake,MN 55372 RESOLUTION 14-xxx ORDERING IMPROVEMENTS AND PREPARATION OF PLANS AND SPECIFICATIONS FOR STEMMER RIDGE ROAD IMPROVEMENT PROJECT (PROJECT#TRN14-000004); FINANCING THE STEMMER RIDGE ROAD IMPROVEMENT PROJECT TO BE UNDERTAKEN BY THE CITY AND ESTABLISHING COMPLIANCE WITH REIMBURSEMENT BOND REGULATIONS UNDER THE INTERNAL REVENUE CODE Motion By: Second By: WHEREAS, the Prior Lake City Council on its own initiative has determined that it desires to complete the Public Improvement Project to Credit River Road; and WHEREAS, on June 9, 2014; the City Council adopted Resolution 14-094 accepting the Feasibility Report and calling for a Public Hearing to be held on the Stemmer Ridge Road Improvement Project which includes sanitary sewer, watermain, storm sewer, aggregate base, concrete curb and gutter, bituminous surfacing, and appurtenant work; and WHEREAS, ten days mailed notice and two weeks published notice of the hearing was given, and the hearing was held on the 11th day of August, 2014, at which time all persons desiring to be heard were given an opportunity to be heard thereon; and WHEREAS, the City Council held a second public hearing on December 22, 2014 following written notice and publication; and WHERES, since the project was initiated by the City Council it must be approved by 4/5ths vote in accordance with Minnesota Statutes 429.031 Subdivision 1(f); and NOW THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF PRIOR LAKE, MINNESOTA as follows: 1. The recitals set forth above are incorporated herein. 2. Such improvement is necessary, cost-effective, and feasible as detailed in the feasibility report. 3. The City Engineer is hereby authorized to prepare plans and specifications for the improvements delineated in City Council Resolution 14-094 adopted on June 9, 2014 for Concept and by the required statutory 4/5ths vote does hereby order the project. 4. The City Engineer is hereby designated as the Engineer for these improvements and is authorized to record engineering expenses in the Construction Fund (#501-43500.00-55020-TRN14-000004), 5. The City has determined to make a declaration of official intent ("Declaration") to reimburse certain estimated costs for this project from proceeds of bonds in accordance with the Internal Revenue Service Reimbursement Regulations (Treasury Reg. 1.150-2). 8. The City may declare other separate statements of reimbursement intent in connection with specific public improvements projects as they are initiated under Minnesota Statutes Chapters 429 and 444, or for other capital projects, with the understanding that such additional declarations of reimbursement intent will supplement this resolution. All reimbursed expenditures will be capital expenditures, costs of issuance of the bonds, or other expenditures eligible for reimbursement under Section 1.150-2(d)(3) of the Reimbursement Regulations. 9. This Declaration has been made no later than 60 days after payment of any original expenditure to be subject to a reimbursement allocation with respect to the proceeds of bonds, except for the following expenditures: a. costs of issuance of bonds; b. costs in an amount not in excess of $100,000 or five percent of the proceeds of an issue; or c. The anticipated original expenditures for the Projects and the principal amount of the bonds are consistent with the City's budgetary and financial circumstances. No sources other than proceeds of bonds to be issued by the City are, or are reasonably expected to be reserved, allocated on a long term basis, or otherwise set aside pursuant to the City's budget or financial policies to pay such Project expenditures. 11. The first four bullets below reiterate the County's comments from its August 8, letter on the importance of the connection. The remaining bullets have been added. • The Stemmer Ridge development was platted in 2004 as collector road connection between CH 12 and CH 82. CH 12 improvements were coordinated and completed with the development and its collector road. • Spring Lake Regional Park planning/investments and the elimination of CH 81 were done with the understanding between the City and County that Stemmer Ridge Road would be completed to CH 82 in the future. • The CH 17 Corridor Study completed in cooperation with the City of Prior Lake included Stemmer Ridge Road as a CH 17 supporting roadway. CH 17 is a future principal arterial roadway serving mobility and longer travel trips. As the corridor develops, failure to implement a supporting roadway network for local trips can lead to similar congestion/crash issues experienced on CH 42 where there is a lack of a supporting roadway network to i serve local trips. i • The recommended regional guidelines for collector roads to be spaced apart are %mile to %of a mile. Currently the only connection between CH 12 and CH 82 between CH 17 and CH 21 is Freemont Ave/Northwood, it is unknown at this time if these roadways would see additional traffic without the connection of Stemmer Ridge Road. • The TED sessions have stressed the importance of adequate connections between the land use and transportation system. If the City desires viable development along the CH 17 corridor and an attractive location for businesses and residential housing to grow in the future, the planning principals of TED need to be implemented as opportunity presents itself to ensure the long term economic health of the corridor and community. • The connection provides way for neighborhood south of the regional park to access the park by vehicle without having to use the Principal Arterial (CH 17). An Equal Opportunity/Safety Aware Etnployer The County has also reviewed the concepts the City had developed for discussion. The County supports any of the concepts that connect Stemmer Ridge Road to Mystic Lake Blvd. The County does not support an option that connects to Howard Lake Dr. Connecting Stemmer Ridge Road and Mystic Lake Blvd. at one common access point to CH 82 increases the likelihood of a future signal on CH 82 that would serve both of these roads. By separating the accesses, it is less likely a signal will be warranted on CH 82 for just one of these roadways and would likely result in something less than a full access. The County is currently in the process of updating its Traffic Model. As part of the update the County has agreed to have our consultant review the City's Stemmer Ridge Road connection traffic forecast. While results of the model update will not be ready until the end of November, it is County staff's opinion that the previous model had over predicted future volumes on this local collector road. The 2004 employment numbers that were allocated to the TAZ do not appear to match the City's future land use guiding of single and multi-family homes. The 2040 Employment assumption in TAZ 90 still appears to be a high number based on the land use plan. The revisions to the 2004 model inputs result in a lower projected volume in 2040.
