Historv: On December 13,2004, the Planning Commission unanimously recommended approval of an amendment to allow for a separate parking designation and space requirement related to animal kennel uses. Back1!round: Amcon Construction filed an application to amend Section 1107.304 of the Zoning Ordinance to provide a separate designation for the number of parking spaces required for animal kennel uses. Although the applicant has applied for this amendment for a specific site, the amendment will apply to all kennel uses. Section 1107.304 of the Zoning Ordinance currently reads as follows: Commercial Uses Animal Hospitals & Kennels 1 parking space for each 200 square feet of floor area but not less than 5 spaces. The proposed amendment would create a separate use designation and requirement for the number of parking spaces related to animal kennels, which would read as follows: Animal Kennels 5 parking spaces, plus 1 space per 10 kennels. If training classes take place on site, 1 space per participant, plus 1 space per employee, not to exceed the total available spaces. 1:\04 files\04 ordin amend\04 zoning\kennel parki~ffiy6f\Wi8~Fa.ke.com Page 1 Phone 952.447.4230 / Fax 952.447.4245 Originally, the application request was to amend Section 1107.304 to 1 parking space per kennel vehicle, 1 parking space per employee, 2 parking spaces per groomer, 1 parking space per 10 kennels. However, at the Planning Commission meeting the revised language was recommended. The applicant agreed. ANALYSIS: The purpose of this amendment is to allow for a separate parking classification for animal kennel uses, independent of animal hospital uses. In the past, kennel facilities have commonly been an accessory use to a veterinarian facility. However, in recent years animal boarding / kennel facilities have become more numerous and independent of animal hospital uses. For that reason, many communities are reviewing parking requirements related to this use, and adjusting them accordingly. In 2002 The American Planning Association conducted a parking study that included standards related to animal boarding facilities. The study revealed a range of parking standards, including the following: . 1 space per 600 square feet. . 1 space per employee, plus 1 space per 1,000 square feet. . 5 spaces, plus 1 space per employee. . 2 spaces per 1,000 square feet of gross floor area. . 3 spaces, plus 1 space for each 2 employees, plus 1 space for each 3 pet owners at a maximum capacity if animal training classes are taught onsite. The American Boarding Kennel Association (ABKA) has published the following formula as the industry standard for calculating parking spaces needed for a kennel facility: . 1 space per kennel vehicle. . 1 space per manager . 2 spaces per groomer . 1 space per employee . 1 space per 10 kennels The nature of an animal boarding facility could be seen as similar to other "drop off' type uses (daycare, nursery school). Section 1107.302 of the Zoning Ordinance lists the following parking requirements: USE REQUIREMENT Group Day 5 parking spaces plus 1 for each 5 program care/Nursery Schools participants based on the facility's licensed capacity. Adult Day Care 2 parking spaces for every 5 program Centers participants licensed by the State of Minnesota. 1:\04 files\04 ordin amend\04 zoning\kennel parking regs\cc report.doc Page 2 The parking needs would greatly differ from those of a veterinarian facility. In addition, the care attendant to client ratio is typically higher for animal kennel facilities than for other "drop off' type uses, and would likely have a more limited need for total parking spaces. Zoning Ordinance Amendment Findings Section 1107.304 of the Zoning Ordinance states that recommendations of the Planning Commission and final determinations of the City Council shall be supported by findings addressing the relationship of the proposed amendment to the following policies: 1. There is a public need for the amendment. There is a public need for the amendment. It will refine the parking standards to stay current with the changing industry and provide for a specialized use. 2. The amendment will accomplish one or more of the purposes of this Ordinance, the Comprehensive Plan, or other adopted plans or policies of the City. Objectives and policies of the Comprehensive Plan include: . Determine and strive for a balance of commerce, industry and population; . Encourage a diversified economic base and a broad range of employment opportuni ties; . Promote sound land use; and . Maintain high standards in the promotion and development of commerce and industry. The 2020 Vision and Strategic Plan lists one of the vision elements as: . Streamline zoning approval and building permit processes and regulations without sacrificing quality and effectiveness. The proposed amendment strives to accomplish the objectives and policies of the Comprehensive Plan and the 2020 Vision and Strategic Plan by providing parking requirements that reflect the need of the commercial uses, while providing adequate parking opportunities for the user of the business. 3. The adoption of the amendment is consistent with State and/or Federal requirements. This amendment is consistent with federal and state laws. 1:\04 files\04 ordin amend\04 zoning\kennel parking regs\cc report. doc Page 3 CONCLUSION: The proposed amendment is consistent with the goals and objectives of the Comprehensive Plan and the enabling legislation set forth in Minnesota Statutes. Based upon the analysis set forth in this report, staff recommends approval. FISCAL IMP ACT: Approval of the Ordinance Amendment will facilitate development and increase the City tax base. AL TERNA TIVES: The City Council has three alternatives: 1. Adopt an ordinance amendment request to amend Section 1107.304 of the Zoning Code to establish a separate designation and parking space requirement for kennel uses. 2. Deny the ordinance amendment request to allow a separate designation and parking space requirement for kennel uses. In this case, the Council should direct the staff to prepare a resolution with findings of fact based in the record for the denial of the request. 3. Defer consideration of this item and provide staff with specific direction. RECOMMENDED MOTION: The staff recommends Alternative # 1. This action requires the following motion: A motion and second adopting an ordinance to amend Section 1107.304 of the Zoning Ordinance to allow for a separate designation and parking space requirement for animal kennel uses. Planning Coordinator Danette Moore presented the Planning Report dated December 13, 2004, on file in the office of the City Planning Department. Although the applicant has applied for this amendment for a specific site, the amendment will apply to all kennel uses. Lemke questioned how the parking would be required and the actual enforcement. Moore explained the process. Comments from the Public: The applicants were present but declined to comment. The public hearing was closed at 7:18 p.m. Comments from the Commissioners: Stamson: . Had the same concern as Lemke. Preference would be 5 parking spaces plus one for every 10 kennels - similar for day care and nursery parking. If animal training is on site there should be one space for every attendee and every employee. It is easier to enforce. . Agree with the change but more along the lines of the example. Planning Commission Meeting December 13,2004 Lemke: . Agree with the change that animal hospitals and kennels need the same amount of parking. . Support the change with Stamson's language. Perez: . Agree with the change. Ringstad: . Agreed - the ordinance is required. Likes Stamson's recommendation for parking. Billington: . Agreed - its time to update the ordinance language. The change in that business is like any other business, constant revolving and have to change with it. . Support with the amended number of parking spots. MOTION BY ST AMSON, SECOND BY LEMKE, RECOMMENDING APPROVAL OF THE PROPOSED AMENDMENT AMENDING SECTION 1107.304 OF THE PRIOR LAKE CITY CODE WITH THE REPLACEMENT LANGUAGE OF FIVE PARKING SPACE PLUS ONE FOR EVERY 10 KENNELS. IF ANIMAL TRAINING CLASSES ARE TAUGHT ON SITE, REGISTERED CLASS ATTENDEES PLUS EMPLOYEES SHALL NOT EXCEED THE AVAILABLE PARKING STALLS. Vote taken indicated ayes by all. MOTION CARRIED.
