Prior Lake, MN 55372-1714 CITY COUNCil AGENDA REPORT JANUARY 18, 2005 8A lARRY POPPlER, ASSISTANT CITY ENGINEER STEVE ALBRECHT, CITY ENGINEER PUBLIC HEARING TO CONSIDER APPROVAL OF A RESOLUTION ORDERING THE 2005 IMPROVEMENT PROJECT AND PREPARATION OF PLANS AND SPECIFICATIONS. HISTORY On July 19, 2004, Council adopted Resolution 04-117 ordering the preparation of a feasibility report for those projects in the 2005 Capital Improvement Program (CIP) required to follow the Minnesota Statutes Chapter 429 process. The Minnesota Statutes Chapter 429 process is required because the City Council intends to specially assess a portion of the project. The roadways studied in the report include: Fish Point Road, Fairlawn Shores Trail, Frost Point Circle, Bluedorn Circle, Centennial Street, and Candy Cove Trail (TH 13 to CR 44). The recommendation of the feasibility report was to proceed with this project. On December 20, 2004, Council adopted Resolution 04-192 accepting the feasibility report and calling for a Public Hearing on January 18, 2005 for the 2005 improvement project. CURRENT CIRCUMSTANCES The purpose of the Public Hearing is to determine if plans and specifications should be prepared for Council consideration. The Public Hearing will cover the reconstruction of Fish Point Road, Fairlawn Shores Trail, Frost Point Circle, Bluedorn Circle, Centennial Street, and Candy Cove Trail (TH 13 to CR 44), including sanitary sewer, water main, storm sewer, aggregate base, concrete curb and gutter, bituminous surfacing, and appurtenant work. Details of the project and proposed financing was presented at the informational meeting on January 12, 2005 and will be presented to the public at the hearing. www.cityofpriorlake.com Phone 952.447.4230 / Fax 952.447.4245 Financing of the improvements is recommended as follows: Assessments $1,226,914 Tax Levy $1,590,499 Sewer & Water Fund $881,513 Trunk Reserve Fund $18,504 Water Quality Fund $107,815 Capital Park Fund $66,878 Operating BudQet $26,016 Project Total Cost $3,918,139 The proposed assessment rate for Centennial Street is $16,660.00/unit because this a 100% assessment due to the fact that only a gravel street exists today. The proposed assessment rate for the rest of the project is $8,094/unit, which is based upon a 60% public cost I 40% special assessment, because there is an existing worn out bituminous street. The properties deemed to specially benefit from the improvements, in most cases the properties abutting the streets located in the project area, are subject to assessment. Each of the affected property owners have been notified in accordance with the statute regarding tonight's Public Hearing. ISSUES A Public Informational Meeting was held on January 12th, 2005 to provide the property owners an opportunity to discuss the project in an informal setting prior to the Public Hearing. Staff presented the proposed improvements, project costs, estimated assessments and answered questions. Approximately 50 residents attended the informational meeting. The City received and staff answered many questions and received several comments from residents on this project. The following are comments and concerns staff felt the City Council should be made aware of: . Flint Road - A resident asked why the Flint Road residents are not part of the assessable portion of this project. City Staff responded that Flint Road is a private street which the City has not maintained. It is not a driveway. Residents have a Flint Road address and pay to maintain their gravel roadway. . Frost Point Circle - A resident expressed that he didn't feel that the replacement of Frost Point Circle was necessary. Frost Point Circle has concrete curb and gutter and is in better condition than the other roadways scheduled for replacement. The resident felt that we were only reconstructing Frost Point Circle because of the replacement of the cast iron watermain. City Staff responded that when the City completes reconstruction projects, grouping adjoining roadways together makes the most sense so that we are not disrupting these neighborhoods in variety of time periods. Another resident asked if part of the concrete curb can be left so as to reduce the costs. The City has looked at that and feels that salvaging some segments of curb would be unfruitful. The sub- cutting of the street section would require the replacement of all the curbing on Frost Point Circle. 05IMPROV . Candy Cove Sidewalk - A resident asked that the costs for the sidewalk proposed on Candy Cove Trail be eliminated from the assessable portion of the project. City Staff responded that the width of Candy Cove was reduced from 36' to 32', so costs have been reduced on the project for this segment of roadway. The construction and assessment of the sidewalk on Candy Cove is similar to the sidewalk constructed on Rutledge Street last year. On Rutledge Street the width of the roadway was reduced and a sidewalk added on the South side. The sidewalk was assessed on the 2004 Improvement Project. . Street Lights I Power Pole Burial - A resident asked if street lights are proposed and if the utility company would be burying the power in this area. City Staff responded no and that if residents would like street lights they should make that evident at tonight's public hearing or through a petition. The costs for the street lights would be assessed at 100%. If there is enough interest in the burial of the overhead power lines either the residents or the City must ask Minnesota Valley Electric Cooperative for an estimate for the burial of the power lines. Once the estimate is done, the residents must decide if the costs are acceptable as the residents must pay 100% of the cost for the burial. . Fairlawn Shores Parking Area - A parking area exists on the south side of Fairlawn Shores Trail. This resident has a driveway access off of 150th Street with a rear yard fronting Fairlawn Shores Trail. This parking area was constructed within the Fairlawn Shores Trail right of way and would be considered the private use of public property. The Council should provide direction to staff on whether the engineering design would include the reconstruction of this parking area or it's removal. This resident is not being assessed on this project. 100% Assessment rate - The costs for Centennial Street are greater than estimated in previous years. Looking back in the 1999 records the initial assessment rate was estimated at $11,500 I unit. Once bids were received the numbers dropped just below $10,000 I unit. The main differences between the 1999 estimate and the 2005 estimate are the addition of street sub-cutting, placement of two feet of granular borrow and an increase in unit prices. In 2003 Hope Street was improved from a gravel surface to bituminous with concrete curb and gutter. The proposed assessments for Hope Street were $13,012 I unit. Appraisals will be performed on Centennial Street as have been done in previous years. The City staff is prepared to discuss each of the concerns presented at the Public Meeting. If, in the council's judgment, the issues should be addressed in the plans and specifications, direction could be given to staff. The purpose of this Public Hearing is to determine whether the project should move forward to the next step, which is preparation of plans and specifications which will provide greater information about expected project cost and, therefore, the assessments associated with these improvements. Once the plans and specifications are completed, they are submitted to the City Council for approval. At the same time approval is sought to advertise for bids, the Council could decide not to continue with the project upon receipt of bids. If the Council elects to proceed, a separate Assessment Hearing will be conducted following review of the proposed assessments by the City Council's Special Assessment Committee. 05IMPROV ALTERNATIVES: RECOMMENDED MOTION: REVIEWED BY: REVIEWED BY: 05IMPROV CONCLUSION The project is feasible from an engineering and economic standpoint. If the preparation of plans and specifications is approved, the work will be completed by City staff. There are three alternatives for the City Council to consider: 1. Conduct the Public Hearing and approve a resolution that orders the 2005 Improvements and authorizes City staff to prepare plans and specifications. 2. Deny this item for a specific reason and provide staff with direction. 3. Table this item until some date in the future. A motion and second to adopt a resolution ordering the 2005 Improvements and authorizing City staff to prepare plans and specifications. 16200 Eagle Creek Avenue S.E. Prior Lake, MN 55372-1714 RESOLUTION 05.xx ORDERING 2005 IMPROVEMENTS AND PREPARATION OF PLANS AND SPECIFICATIONS FOR FISH POINT ROAD, FAIRLAWN SHORES TRAIL, FROST POINT CIRCLE, BLUEDORN CIRCLE, CENTENNIAL STREET, AND CANDY COVE TRAIL MOTION BY: SECOND BY: WHEREAS, the Prior Lake City Council on its own initiative has determined that it desires to complete the 2005 Public Improvement Project; and WHEREAS, on December 20, 2004, the City Council adopted Resolution 04-192 accepting the Feasibility Report and calling for a Public Hearing to be held on the 2005 Improvement Project which includes the reconstruction of Fish Point Road, Fairlawn Shores Trail, Frost Point Circle, Bluedorn Circle, Centennial Street, and Candy Cove Trail sanitary sewer, water main, storm sewer, aggregate base, concrete curb and gutter, bituminous surfacing, and appurtenant work; and WHEREAS, ten days mailed notice and two weeks published notice of the hearing was given, and the hearing was held on the 18th day of January, 2005, at which time all persons desiring to be heard were given an opportunity to be heard thereon; and WHEREAS, since the project is initiated by the City Council it must be approved by 4/5ths vote in accordance with Minnesota Statutes 429.031 Subdivision 1 (n. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF PRIOR LAKE, MINNESOTA: 1. The recitals set forth above are incorporated herein. 2. The City Engineer is hereby authorized to prepare plans and specifications for the improvements delineated in City Council Resolution 04-192 adopted December 20, 2004 and by the required statutory 4/5ths vote does hereby order the project. 3. The City Engineer is hereby designated as the Engineer for these improvements. The Engineer shall prepare plans and specifications for the making of such improvements.
