DISCUSSION:
Historv: Annually, the staff provides the Planning Commission and the City
Council with a report regarding the number and types of variance requests
that have been considered in the previous year. This report summarizes the
variance activity in 2004, and is intended to provide useful information to the
City Council when considering the need for ordinance amendments or when
considering other variance requests.
The following table is a summary of variance activity for 2004, and a
comparison of activity for the previous 4 years.

Note: If an applicant requested a variance and the Planning Commission approved a
reduction of the original request, then it is represented as one approved request and one
denied request in the tables.
Table 2 compares the specific types of variance requests in 2004 to the
requests for the four preceding years.

The 2004 variance requests are comparable to requests made in the previous
4 years. The majority of the variances were requested to make improvements
to existing single family dwellings in required side, rear and lakeshore sides.
The applications with the largest number of requests were for new
construction on nonconforming lots. The Planning Commission was fairly
consistent in denying variances where there were design alternatives to allow
a reasonable use of the property consistent with the Zoning Ordinance
requirements, and the Council consistently upheld the decisions of the
Planning Commission.
In 2004, the City adopted the following amendments to the Zoning Ordinance
text:
1. Section 1107.2200 was amended to allow fiber cement siding and EIFS
as Class I materials.

2. Sections 1101.400 and 11 02.800were amended to define boat lifts and
landings and to establish setbacks for these uses.
3. Section 1108.800 was amended to allow the simultaneous processing of
Comprehensive Plan Amendments and Rezonings.
4. Section 1108.200 was amended to allow the Planning Commission to
make the final decision on a CU P.
5. Section 1102.1202 was amended to reduce the required setback for a
play area for a day care center in certain instances.
6. Sections 1109.502 and 1109.503 were amended to require the inclusion
of a location for a deck addition to all new single family homes.
7. Section 1101.504 of the ordinance was amended to clarify the application
of this section to residential fences.
8. Section 1107.2202 was amended to allow cast-in-place and precast
concrete panels and Class I materials in the 1-1 district.
9. Section 1106 was amended to allow mixed use development as PUD
districts.
10. Section 1113 was added to the ordinance to allow off-premise directional
signs for facilities of regional significance.
11. Sections 1102.403, 1102.503, 1102.603, 1102.703 and 1107.203 were
amended to allow free-standing parking lots as an accessory use to
nonresidential uses in residential districts, subject to approval of a
conditional use permit.
12. Section 1104.201 was amended to add the lakes within the Orderly
Annexation Area to the Shoreland District requirements in the City.
13. Section 1101.800 was amended to automatically designate newly
annexed land as R-1 on the City Zoning Map.
The amendments adopted in 2004 were intended to address some specific
issues. Most of these amendments will have no affect on the variance
requests received.
The staff continues to work with applicants to reduce the number of variance
requests by reviewing submitted documents and eliminating requests through
plan redesign when possible.
Current Circumstances: The Planning Commission considered this
summary report on February 28, 2004. The Planning Commission concluded
that the variances requested were site specific. At this time there is no need
to amend the Zoning Ordinance to address a recurring issue.
Conclusion: The Planning Commission and the staff recommend approval of
this report.
ALTERNATIVES:
The City Council has two alternatives:

1. Approve the variance summary report as part of the consent agenda.
2. Provide the staff with additional direction.
