CONSIDER APPROVAL OF A RESOLUTION ADOPTING A POLICY WITH
RESPECT TO THE OPERATION OF CITY OWNED BOAT SLIPS
DISCUSSION:
Historv: One of the Vision Elements of the 2020 Vision and Strategic Plan is
Natural Resources. One of the tactical action steps to be taken within this
element is, "Adopt a program which ensures an acceptable level of lake access,
parking and responsible lake utilization."
The downtown redevelopment vision element contains a tactical action plan to,
"complete a plan for tying the downtown to the lake."
Various actions have been taken to implement these tactical action plans. The
Department of Natural Resources has proposed to increase the number of
parking stalls at both the DeWitte and Sand Point access as part of an overall
improvement plan for both. It is hoped that such action will address some of the
on-street parking in the neighborhoods, while providing some modest additional
access to the lake.
In an effort to encourage lake users to utilize public facilities at Sand Point and
Lakefront, and to encourage boaters downtown, 18 boat slips have been
installed at Watzel's Beach in Lakefront Park. An equivalent number of slips are
planned for Sand Point.
The Council desires to have a set of policies that govern the use of the city
owned slips. The Council conducted a joint workshop' with the Lake Advisory
Committee and Park Advisory Committee. Following that meeting, staff was
directed to prepare a draft set of policies for review by each advisory body before
the matter is submitted for Council consideration.
Current Circumstances: From the joint work session, the staff has prepared a
draft set of policies. These policies have been reviewed by both advisory bodies
and are being submitted for City Council consideration tonight.
Conclusion: The Council should determine whether it wishes to adopt the
attached policies for the city owned boat slips.

MOTION:
Based upon the prevailing sentiment at the joint meeting, the attached policies do
not contemplate overnight use of the slips. Instead, the slips would be available
for use during normal park hours (5 a.m. to 10 p.m. daily, except weekends).
The Council may some day want to allow overnight usage, but to begin with, daily
usage is perceived to be easier to administer.
No fee is to be charged for slip usage. No time limits or scheduling system is to
be employed either. If our experience demonstrates that greater control is
necessary, then appropriate modifications can be made.
Finally, the policies clarify that personal watercraft and canoes should be
beached rather than utilize available slips.
For safety's sake, fishing, waterskiing, tubing, diving and swimming are not to be
done from the slips.
If the Council adopts the attached policies regulating city boat slips, it would be
our intent to recommend ordinance amendments in the future which would make
violation of these park policies a misdemeanor punishable by up to a $1,000 fine
or up to 90 days in jail.
Because the slips will be open only during park hours, most enforcement will be
done by park patrol. Police officers will periodically check the slips as part of their
normal patrol responsibilities.

(2) Direct staff to prepare the appropriate ordinance amendments.
(3) Take no action.

A RESOLUTION ADOPTING PARK POLICIES REGULATING CITY OWNED BOAT SLIPS

WHEREAS, As part of the City Council's efforts to implement the 2020 Vision and Strategic Plan,
boat slips have been installed at Watzel's Beach; and
WHEREAS, The Council desires to establish policies for the use of such boat slips to promote
equitable and harmonious usage; and
WHEREAS, In an effort to adopt such policies the City Council has conducted a joint workshop with
the Park Advisory Committee and the Lake Advisory Committee; and
WHEREAS, Draft policies were subsequently prepared and discussed by the members of each
advisory body and have been submitted to the City Council for consideration.
NOW THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF PRIOR LAKE,
MINNESOTA as follows:
1. The recitals set forth above are incorporated herein.
2. The Boat Slip Policies as set forth in the document dated March 7, 2005, are hereby approved.
3. The staff is hereby directed to communicate these policies to the public.
4. The staff is hereby directed to propose revisions to the city code which will facilitate enforcement of
the policies as a misdemeanor.

CITY OF PRIOR LAKE BOAT SLIP POLICIES

1. This dock is owned by the City of Prior Lake for use by watercraft
operators on Prior Lake.
2. Slips are available on a first come first served basis only.
3. Slips may be occupied only during Lakefront Park hours: 5:00 am to
10:00 pm daily. NO OVERNIGHT MOORING ALLOWED.
4. There is no daily time limit for slip usage during normal park hours.
5. One slip is reserved for Official Watercraft of The Department of Natural
Resources I Scott County Sheriff's Department. Unauthorized use is
prohibited.
6. No mooring of personal watercraft or canoes. Beach such watercraft in
designated areas.
7. No fishing, water skiing, inner tube usage, diving or swimming from docks.
8. All other applicable State, County and City Ordinances apply.
Violation of the above regulations may result in a fine of up to $1,000 I or up
to 90 days in jail. The City of Prior Lake is not responsible for any and all
personal injury, property damage, theft or other liabilities arising as a
consequence of using the dock or failure to abide by the regulations set forth
herein.
