Here are the answers: 1. The City will provide you with an allowance as shown below for Ihe blacktop. On the Village Lake Drive side, no more than one to two feet behind the Sidewalk are city property. The remaining property is yours and was dislurbed by the new parking lot work. To compensate for the blacktop and the small amounl of black dirt and sod I have asked the finance department to issue a check to Bealmake for $5000. 2. The triangular parcel was included in the calculation for the parking lot variance. So any development of thaI 101 would require variances and a joint use parking agreement. We can work with you if you have some concepts you would like 10 explore. 3. Fantastic Sam's- We have received the building permit My research shows thaI consistent with our long time practice, neither the liquor slore nor Ihe grocery slore were charged for any metro or city SAC, WAC or related development fees. This is because the Metropolitan Council concluded that now new sewer fiow is created by these remodels since they take the place of identical uses of more or less idenlical sizes Ihat were originally part of the building. Fantastic Sam's on the other hand does create two additional SAC units based upon the Metropolitan Council delermination dated November 9, 2004. As you know the city holds 11 SAC credits as a result of the closure of the Laundromat. We will apply two of these unils 10 Fanlaslic Sam's building permit which means Ihe only charges they will have on Iheir perm II are the permit fee and the plan check fee. In other words none of the fees we discussed on November 9 will be charged on the Fantastic Sam's permit. For future reference, as long as these credits remain, it is staffs practice to apply them as oullined above. If all credits become used up then all development related fees will apply including but nollimited to Metro and city SAC and WAC, Park Dedication, Water Tower, etc. If, once the building is completely renovaled any SAC credits remain they may nol be converted to cash as set forth in Metropolilan Council Policy. Bernie and Marty, I thoughllhe SAC unils might be included under our business subSidy policy which would include and application and lime delay to get the item on the city council agenda. Bul my reading of the definition of business subsidy does not in my opinion include SAC Credits. I am pleased we are able 10 get this resolved quickly. I have instructed my Building inspection Departmenl to proceed as outlined above with the Fantastic Sam's building permil so il can be promptly processed and another new business can become part of South Lake Village. Based upon what I have heard people love Village Markel and are flocking there now that il is open. I am confident that Ihe liquor store, salon and sandwich shop will experience the same fervor. All solder and flux used for the potable water distribution systems shall eontain less than 0.2 percent lead. Use of 50-50 solder or flux containing more than 0,2 percent lead is prohibited in pOlable water distribution systems, Any solder other than 95-5 tin-antimony or 96-4 tin-silver musl be specifically approved by the administrative authority prior to use (see Minnesota Slatutes, Section 326.371), Joints to be soldered must be properly fluxed with noncorrosive paste-type flux eomplying with ASTM Standard B813-00. 10, PVC plastic pipe used for the drain, waste, and vent syslem shall comply with ASTM Standard D 2665, D 2949 or F 891 (see Minnesota Rules, part 4715.0570 through part 4715.06(0). Solvent weld joints in PVC and CPVC pipe musl include use of a primer which is of contrasting color to the pipe and cement (see Minnesota Rules, part 4715.0810, subpart 2), II. Plastic pipe must be installed in accordance with Minnesota Rules, part 4715,0580(F) and part 4715.0600, Above-grade horizontal runs of plastic waste and vent pipe cannot exceed 35 feet in total length. Above- grade vertical stacks constructed of plastic pipe may exceed 35 feet in total height ouly if an approved expansion joint is used. 12, The water piping system shall be disinfected in accordance with Minnesota Rules, part 4715.2250. 13, The plumbing system shall be tested in accordance with Minnesota Rules, part 4715.2820. 14. The plans and specifications were prepared by a licensed master plumber, The plumber who has prepared the plans is the only one that can use the plans for construction, If another plumber is contracted to install the plumbing, they must submit their own plans and specifications for the project.
