HomeMy WebLinkAbout15-071 Enclave at Cleary 3rd Addn Final Plat 4646 Dakota Street SE Prior Lake, MN 55372 RESOLUTION 15-071 A RESOLUTION APPROVING THE ENCLAVE AT CLEARY LAKE 3 ADDITION RD FINAL PLAT AND DEVELOPMENT CONTRACT Motion By: KEENEY Second By: MCGUIRE WHEREAS, On January 13, 2014, the City Council approved the preliminary plat for The Enclave at Cleary Lake 2 Addition, subject to conditions identified by Resolution 14-013; and nd WHEREAS, Ryland Homes Inc. (the “Developer”) has submitted an application to the City of Prior Lake for approval of a Final Plat for The Enclave at Cleary Lake 3 Addition; and rd WHEREAS, The City Council has found that the final plat of The Enclave at Cleary Lake 3 Addition is in rd substantial compliance with the approved preliminary plat for The Enclave at Cleary Lake 2 nd Addition which includes The Enclave at Cleary Lake 3 Addition platted area. rd NOWTHEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF PRIOR LAKE, MINNESOTA as follows: 1.The recitals set forth above are incorporated herein as if fully set forth. 2.The final plat of “The Enclave at Cleary Lake 3 Addition” is approved subject to the following conditions, rd which shall be met prior to release of and recording of the final plat: a.The Developer shall submit a current title opinion or commitment of title insurance acceptable to the City Attorney. b.The Developer shall pay all fees identified in the Development Contract. c.The Developer shall provide reductions of the entire final plat be submitted, to the following scales: 1” = 200’; and one reduction at no scale which fits onto an 8 1/2” x 11” sheet of paper. d.The Developer shall submit three mylar sets of the final plat with all required signatures. e.The Developer shall provide financial security, acceptable to the City Engineer. f.The Developer shall revise the plans in accordance with the requirements contained in the memorandum from the City Engineering/Public Works Departments dated December 1, 2014. 3.The Developer shall file the final plat and all pertinent documents with Scott County within 60 days from the date of final plat approval. Failure to record the documents by June 12, 2015, will render the final plat null and void. 4.The Mayor and City Manager are hereby authorized to execute the Development Contract on behalf of the City.
