CONSIDER APPROVAL OF A RESOLUTION APpROvINGA
COMBINED PRELIMINARY AND FINAL PLAT TO BE
KNOWN AS THE WILDS NORTH THIRD ADDITION
History: The purpose of this item is to consider an application for a
combined preliminary and final plat for the property located on the
south side of CSAH 42, west of Wilds Path and north of Cougar Path.
The proposed plat consists of 1.57 acres to be subdivided into 4 lots
for single family development. A portion of this site was originally
platted as Outlot C, The Wilds North. The remainder of the site is an
unplatted parcel that was the site of a single family dwelling, That
dwelling was recently removed.
The Planning Commission considered this combined preliminary and
final plat at a public heating on February 28, 2005. The Planning
Commission found the combined preliminary and finaI plat consistent
with the standards of the Zoning and Subdivision Ordinances. The
Planning Commission recommended approval of the preliminary and
final plat to be known as The Wilds North 3rd Addition.
Current Circumstances: Section 1002.400 of the Subdivision
Ordinance permits the combination of the preliminary and final plat
approval under the following circumstances:
· The resulting subdivision contains no more than 5 lots.
· The proposed subdivision is located. in an area where streets and
utilities are in place and capable of serving the subdivision.
· The proposed subdivision does not require the dedication or
construction of future streets, and will not interfere with the
development of adjacent properties.
· The resulting parcels shall conform with all provisions of the
Zoning Ordinance.

This process requires a public heating before the Planning
Commission and approval by the City Council. The difference is that
the Planning Commission and the City Council are simultaneously
reviewing both the preliminary and final pat.
The following is a description of the proposed development.
Total Site Area: The site consists of 1.57 acres.
Access: Access to the site is from Wilds Path and Cougar Path. There
will be no access from CSAH 42.
Ad,iacent Land Use and Zonine: To the north of this property, across
CSAH 42, is vacant land zoned R-1. South and east of this property is
The Wilds North development, zoned R-1. To the west is the portion
of The Wilds North, zoned C-2 (Community Business).
Lots: The preliminary plat consists of 1.57 acres to be subdivided into
4 lots. The proposed lot areas range from 12,000 square feet to 14,400
square feet. All of the lots meet the minimum lot area and lot width
requirements for the R-1 District.
Streets: This plan does not include any new fight-of-way.
Parks: There are no parks identified within this site. Parkland
dedication requirements for the portion of this site originally platted as
Outlot C, The Wilds North, was satisfied by a land dedication. The
dedication requirements for the remaining area will be satisfied by a
cash dedication in lieu of land. The amount of cash dedication is
based on the number of units (2) on this unplatted parcel.
Sanitary, Sewer and Water Main: Sanitary sewer and water main
will be extended from the existing utilities located in Wilds Path and
Cougar Path.
Storm Sewer: This plan is designed to direct stormwater runoff to the
existing storm sewer in Cougar Path and Wilds Path.
Tree Replacement: A Tree Preservation Plan was approved as part of
the original Wilds North plat. There are several significant trees
located on the unplatted parcel. However, when added to the tree
count for the entire Wilds North plat, there is no tree replacement
required.
Landscape Plan: The Subdivision Ordinance requires two
subdivision trees per lot, and four trees per comer lot. The developer
has provided a landscape plan which includes some replacement trees
for the trees to be removed on the unplatted parcel. The plan also

includes additional landscaping along CSAH 42 as a buffer for the
homes on Lots 3 and 4.
The Issues: The proposed plat meets the standards of the Subdivision
Ordinance and Zoning Ordinance, subject to the following conditions:

Revise the plans showing the removal of the median and paving of
the median area or remove Lot 4 from the plat. The median
disrupts the entrance and egress from the driveway on Lot 4. The
proposed driveway does not follow the existing driveway path.
The City did not require the median as part of the WiM's North
plat.
The services for lot 4 shouM be moved to the driveway location.
The applicant must obtain all necessary permits from Scott County,
the Prior Lake Spring Lake Watershed District and any other
governmental agencies prior to grading on the site.
The final plat of "The Wilds North 3rd Addition" is subject to the
following conditions, which shall be met prior to release of and
recording of the final plat:
a. A current title opinion or commitment of title insurance be
submitted acceptable to the City Attorney.
b. Payment of all fees prior to release of the final plat mylars.
c. Reductions of the entire final plat be submitted, to the
following scales: !" = 200'; and one reduction at no scale
which fits onto an 81/2"x 11 "sheet of paper.
d. Three mylar sets of the final plat with all required
signatures be submitted.
e. The developer provide financial security, acceptable to the
City Engineer prior to release of the final plat mylars.
f. The final plat and all pertinent documents must be filed
with Scott County within 90 days from the date of final plat
approval. Failure to record the documents by this date will
render the final plat null and void.
The principal requirements for final plat approval include a signed
Development Contract and the satisfactory completion of all
preliminary plat conditions. The Development Contract specifies the
required improvements for this final plat including streets, watermain,
and sanitary sewer. Sanitary sewer, watermain trunk area charges,
collector street fees, and park dedication fees are outlined in the
Contiact.
Conclusion: The staff and the Planning Commission recommend
approval of the plat to be known as The Wilds North 3ra Addition.

Bud~et Impact: Approval of this final plat will facilitate new
development and contribute to the City's tax base.
The City Council has three alternatives:
1. Adopt a resolution approving the Combined Preliminary and Final
Plat to be known as The Wilds North 3ra Addition, and authorize
the City Manager and the Mayor to execute the Development
Contract.
2. Deny the resolution approving the combined preliminary and final
plat.
3. Defer this item and provide staff with specific direction.
The staff recommends alternative #1. This action requires the
following motion:
A motion and second to adopt a resolution approving the combined
preliminary and final plat to be known as The Wilds North 3ra
Addition subject to the listed conditions and authorizing the Mayor

RESOLUTION OF THE PRIOR LAKE CITY COUNCIL APPROVING THE COMBINED PRELIMINARY
AND FINAL PLAT OF "THE WILDS NORTH 3"D ADDITION" AND SETTING FORTH CONDITIONS TO
BE MET PRIOR TO RELEASE OF THE FINAL PLAT.

WHEREAS:
The Prior Lake Planning Commission conducted a public hearing on February 28,
2005, to consider an application for the combined preliminary and final plat of The
Wilds North 3rd Addition; and
WHEREAS:
Notice of the public hearing on said combined preliminary and final plat has been
duly published and posted in accordance with the applicable Minnesota Statutes and
Prior Lake Ordinances; and
WHEREAS:
All persons interested in this issue were afforded the opportunity to present their
views and objections related to the combined preliminary and final plat of The Wilds ·
North 3rd Addition for the record at the Planning Commission hearing; and
WHEREAS:
The Planning Commission and City Council have reviewed the combined preliminary
and final plat according to the applicable provisions of the Prior Lake Zoning and
Subdivision Ordinances and found said plat to be consistent with the provisions of
said ordinances; and
WHEREAS:
The Planning Commission recommended approval of said combined preliminary and
final plat; and
WHEREAS
The Prior Lake City Council considered an application for a combined preliminary and
final plat approval of The Wilds North 3rd Addition on March 21, 2005.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PRIOR LAKE,
MINNESOTA:
1. The recitals set forth above are incorporated herein as if fully setforth.
2. The City Council finds the combined preliminary and final plat of The Wilds North 3rd Addition to be
consistent with the Zoning and Subdivision Ordinance requirements.
3. The City Council has approved the combined preliminary and final plat of "The Wilds North 3rd
Addition".
4. The combined preliminary and final plat of "The Wilds North 3rd Addition" is approved subject to the
conditions set forth in this resolution.
5. The combined preliminary and final plat of "The Wilds North 3rd Addition" is subject to the following
conditions, which shall be met prior to release of and recording of the final plat:
