BE IT RESOLVED BY the Board of Adjustment oflhe City oePrior Lake, Minnesota;

1. Gary J. Thomas (owner) has applied for variances from the Zooing Ordinance in
order to permit the construction of a porch addition to an existing single family
residence on property located in the R-I (Low Density Residential) District and the
SD (Shoreland Overlay) District at the following location, to wit;
5580 Fairlawn Shores Trail, legally described as follows: Lola :n and 13,
Fairlawn Shores, Scott County, Minnesota. Together with that part of Lot 21,
in the plat ofFairlawn Shores. Scott County, Minnesota. described as foIlows:
Beginning at the northeast corner of Lot 21; and running west along the north
line thereof a distance of 12.00 feet; thence southeasterly to a point on the east
line of said Lot 21, distance 89.00 feet south of the northeast comer, thence
north to the point of beginning.

County. Minnescna described as follows: Beginning at the southwest comer

2. The Board of Adjustment has reviewed the application for variances as .._......:.....1 in
C... #01-lY.!9PC and held a hearing thereon on May 29, 2001.
3. The Board of Adjustment has considered the effect of the proposed variance upon the
health, safety, and welfare of the community, the existing and anticipated traffic
conditiona, light aod air, daoger of fire, risk to the public safety. the effect on property

values in the surrounding area and the effect of the propoaed variance on the
Comprehensive Plan.
4. Because of conditions on the subject property and on the.,.."..,....'::'""'J; property, the
proposed variance will not result in the impairment of an adequate supply of light and

incmIIC the clangor of file, and danger to the public safety, unreasonably diminish or
impair health, safety, comfort, molllls or in my other respect be contrary to the

S. The applicant has no control over the existing house's location, such that the hardship
created has not been created by the applicant. Reasonable use of the r-"r-~... does
not exist with the present ...__...__, as is, without the ~ ""I~-"W_~ variances.
6. Th.... is justifiable hardship caused by the required bluff and ordinuy high water
mark setbacks of today that w.... not conditions when the original principal structure
was constructed.
7. The granting of the variances, as originally requested. is necessary for the
preservation and enjoyment of a substantial rnrmJ' right of the applicant The
variance will not serve merely as a ....._1 _.:~...... to the applicant, and is necessary to
alleviate demonstrable hardship.
8. The contents of Planning Case OI.029PC is hereby entered into md made a part of
the public record. and the record. of decision for this case.
CONCLUSION
Based upon the Findings set forth above, the Board of Adjustment hereby 'Tr" ,_ the
following variances, with conditions, for a porch addition to an existing single family
dwelling as shown on the certificate of survey (Attachment 1).
1. A 2.5 foot varimce to pemllt a porch structure setback of 54 feet from the ordinuy
high water mark (904'), rather than the required 56.5 feet as determined by_
averaging.
2. A 43 foot variance to permit a poroh structure encroachment into the bluff impact
zone rather than the required 2S foot setback to the top of bluff.
The following conditions shall be adhered to prior to the issuance of a Certificate Of
Occupancy for the r...r....._J addition:
I. Remove concrete slab located below the 904 foot contour as depicted on the
certificate of survey.
2. Install and maintain required erosion control during the entire phase of the
construction project until '-b.........:._u ground cover is established.

3. Install a gutter system along the entire roof line of the structure to control nmoff
to an approved. location.
4. Submit two engineers reports: one that approves the project in the bluff zone
location priOT to issuance of a building permit; and the 8CC01ld. report that verifies
all required conditions have been met ahall be submitted at the conclusion of the
project

Doon Occurrence of Certain Events. If the holder of a Variance fails
to make actual use of vacant land, or land and structures which were
existing when the Variance was issued and no new structure, alteration
or substantial repair to existing buildings was required; or if a new
structure was required by the Variance and no building permit has been
obtained, the Variance shall be deemed revoked and canceled upon the
occurrence of any of the following events:
(1) A change in the Use District for such lands is made by amendment to
the Zoning Ordinance by the City Council.

Dear Mr. Thomas:
At your request, we have reviewed the plans prepared by Casanova Construction, which are
attached and visited the site on June 18, 2001 to address the City of Prior Lake's requirements
as outlined on page three of their Planning Report issued May 29, 2001.
The existing deck is setback from the top of the bluff approximately ten feet. The area between
the house and the top of the bluff is a relatively flat area, which drains to the north down the
slope and into the lake. All of the area under the existing deck is essentially impervious (much
of the area is landscape rock over plastic weed barrier). The proposed change from the existing
open deck (where rainwater falls through to the impervious surface below) to the proposed
roofed porch should not affect the total runoff volume or rates into the lake.
Based on our review of the plan provided, the only excavation required for the construction of
the addition is the boring of three 12-inch diameter, 42-inch deep concrete footings. These
footings will match the existing grade and all areas to the north of the footings will remain
undisturbed.
Therefore, based on our review of the site and of the plans provided, it is our opinion that the
proposed work will not negatively impact or interfere with the existing drainage pattems.
Further, we do not believe that the excavation of the footings will have a negative impact on the
site for either site stability or erosion control.
Please contact us with any questions you have concerning our findings or, after the project is
completed, you would like us to review the site to certify its compliance with the proposed plans.
