History
Proposed street reconstruction improvements to Fish Point Road,
Fairlawn Shores Trail, Frost Point Circle, Bluedorn Circle, 150th
Street, Candy Cove Trail, and Centennial Street (Project #05-01 &
#05-11) are included in the approved 2005 Capital Improvement
Program. Resolution 05-24 ordering preparation of plans and
specifications for the project was approved by the City Council on
February 7, 2005.
A Public Informational Meeting was held to provide affected
property owners an opportunity to discuss the project. A Public
Hearing was conducted on January 18, 2005 and continued on
February 7, 2005. A second open house meeting was held on
March 23, 2005. City staff was in attendance to answer questions
from the public. All of these meetings were well attended. Notes
from the March 23, 2005 meeting are attached.
This project includes 2 parts that will be bid separately. In
addition to the street reconstruction, the existing sanitary sewer
will be rehabilitated used cured in place pipe.
Current Circumstances
This project includes storm sewer, sanitary sewer, water main,
concrete curb and gutter, aggregate base, bituminous surfacing,
and appurtenant work. The engineer's construction cost estimate

is $3,336,768. Indirect costs are estimated at 26%, and include
engineering (17%), administration (5%), and financing (4%) for a
total estimated project cost of $3,918,139. The construction of
this project is proposed t o b e funded through assessments, t ax
levy, and Trunk Reserve funds, Water Quality Funds, Capital Park
Fund, Operating Budget, and Sewer and Water Funds.
Part of the 2005 Reconstruction Project and the Main Street
Project involve sanitary sewer rehabilitation using Cured In Place
Pipe (ClPP) commonly called "slip lining". The ClPP process
involves placement of a plastic pipe liner, which will cure to the
inside of the existing sanitary pipe. The City used the ClPP
process during last year's reconstruction project. The technique
was less disruptive that full replacement of the sanitary sewer and
worked well. City staff has evaluated the sanitary sewer located
in the project area and has determined the extent of pipe lining
and pipe replacement.
The CIPP process will be coordinated using a contractor separate
from the contractor performing the street repairs. The pipe lining
will be performed after the base course of bituminous has been
placed on the project. The liner is fed into the pipe from the
existing manholes. Hot water is then introduced to the pipe which
expands and adheres the liner to the existing pipe wall. The liner
is expected to extend the usable life of the sewer a minimum of
fifteen years.
Issues
Issues raised at the latest informational meetings included:

A number of residents continued to ask why Flint Road
was not included in the project assessment.
Response: Nagell appraisal has reviewed this issue and
has determined that while the residents of Flint Road do
receive some general benefit due to the construction on
Fish Point Road Flint properties did not receive special
benefit. If the City were to perform improvements to Flint
Road the residents would be assessed at 100% as a first
time improvement, and therefore this issue would not
reduce the assessment burden of the neighborhood.
Without performing improvements to Flint Road, the
benefit would not support the project assessment.
The residents of Frost Point Circle have asked that a
second Appraisal be performed on Frost Point Circle.

Response: Staff has explained to the resident whose
house would be appraised that the higher the value of the
house, the easier it is to prove special benefit, since the
project cost remains the same. However, if the residents
are willing to pay to have the appraisal performed, City
staff finds this acceptable.
The residents on 150th in the area of the sidewalk
construction question the need for the project. They also
feel that they should have received better notice of the
proposed project.
Response: The sidewalk segment connects the sidewalk
near Indian Ridge Park to the trail segment at Fish Point
Park. The sidewalk is proposed on the south side of the
street to avoid a mid-block crossing. Additional
information has been sent out to the affected residents
regarding the sidewalk.
The appraisals will be evaluated when the actual bids are
received on this project. Upon receiving actual bids on
this project, the proposed assessment rate will be defined.

Other individual design issues have been discussed and
resolved.
Response: A wide variety of issues have been resolved
through individual conversations and neighborhood
meetings.

In addition to the comments received at the meeting, Staff
received e-mail comments from Lisa Palmer (5461
Farilawn Shores Trail) and a letter from Jeff and Joanie
Evens (5443 Fairlawn Shores Trail). Staff has responded
to Ms. Palmer via e-mail and has received no additional
comments. The Evens' have requested additional
clarification on driveway aprons and street lighting along
with specific concerns about their property. Staff has
prepared a written response and will try to meet with Mr.
and Mrs. Evens to resolve those issues.

FINANCIAL IMPACT:
Circle, 150th Street, Candy Cove Trail, and Centennial Street. The
actual amount of the special assessments will be based upon
actual project costs. When the City advertises for bids, there is
always a provision in the bid documents specifying the City
Council reserves the right to reject all bids. The City Council has
in the past, rejected bids on projects where the bids exceeded the
Engineer's estimate or were otherwise unfavorable for the City.
The total cost of this year's projects are estimated to be
$3,918,139 and will be recovered through special assessments,
Sewer & Water, Water Quality, Capital Park, and Trunk Reserve
funds in addition to tax levy. The table below outlines the project
costs based on the engineer's estimate.

Based on the Feasibility Report, the estimated assessment rate
for Centennial Street as a first time improvement is $16,660 per
unit.
The estimated assessment rate for the rest of this project based
on the Feasibility Report is $8,094 per unit.
Plan modifications may reduce the project cost for certain
elements of design. The actual bids will establish the final
assessment amount.

May 4th, 2005, at which time the bids will be publicly opened at City Hall at 16200 Eagle
Creek Avenue SE by the City Engineer. No bids will be considered unless sealed and
filed with the City Manager and accompanied by a cash deposit, cashier's check, bid
bond, or certified check payable to the City of Prior Lake in the amount of five (5) percent

Special Assessment/Value Benefit Letter Report
for property owners located along Flint Road SE in Prior Lake, MN
Dear Mr. Poppler:
As discussed, this letter report is intended to analyze and determine value benefit, if any; of the
2005 Street Reconstruction Project, as it pertains to Flint Road in Prior Lake, MN.
The subject of this letter addresses possible value benefit to residents located along Flint Road in
Prior Lake. The 2005 street improvement project will not physically reconstruct any portion of
Flint Road, as outlined in the project construction guidelines. However, roadways leading to the
access of Flint Road will be reconstructed and upgraded. The access road leading to Flint Road
is most notably Fish Point Road SE (proposed roadway upgrading), which is a collector street
colmecting Highway # 13 to the neighborhood.
Therefore, because Flint Road SE will not undergo any reconstruction, a specific value benefit to
the homeowners will not be realized. However, a general benefit to area property owners within
the reconstruction project area will exist. A general benefit is distinguishable from a special
benefit in that while a general benefit is common to all land in the immediate vicinity, a special
benefit is one that is particular to a specific property.
It is the opinion of the appraiser, those potential buyers of residential properties within the Flint
Road neighborhood will consider a neighborhoods reputation, roadway access, overall appeal
and pride of ownership. Marketability and market values will increase due to the added appeal
from upgrading of the area roadways to general upkeep of the neighborhood.

150th Street Sidewalk
Prior Lake City Staff conducted an Informational Meeting on March 23rd, 2005 for the
City's Improvement Project. Part of the improvement includes new sidewalk
construction on the south side of 150th Street from Fairlawn Shores Trail to the Fish
Point park entrance. The informational meeting was very well attended. This
memorandum is intended to address some of the questions that were asked at the
informational meeting and as clarification to those who could not attend the meeting
or who were unable to talk with City Staff. This is a list of issues and concerned
raised by residents present at the meeting.
1. Some residents asked why the sidewalk is being constructed. This proposed
sidewalk has been part of the Parks Department's overall plan. This sidewalk
segment connects Indian Ridge Park with Fish Point Park. Since the City will be
reconstructing streets in this neighborhood, for economic reasons, this
sidewalk segment and street overlay are planned to be included with the City
Reconstruction Project. The proposed sidewalk will provide a connection to the
recently constructed sidewalk across Fairlawn Shores Trail at 150th Street.
2. For safety reasons, the sidewalk is identified on the south side of 150th Street.
Mid block pedestrian crossings are not ideal and since the connection to Fish
Point Park entrance is located on the south side of 150t~ Street, the proposed
sidewalk is identified on the south side..
3. The right of way on the south side of 150t~ Street is located 17 feet south of the
curb line. The sidewalk is proposed to be 5 feet wide with 5 feet of boulevard
between the curb and the sidewalk.

4. A number of residents asked who will shovel the new sidewalk. City Staff has
met to discuss this issue. The new sidewalk serves as a connection between
the parks, the City maintenance staff will add this sidewalk to their route.
5. The existing grade of five driveways along the south side of 150th Street show
that work beyond the right of way is necessary to provide a smooth driveway
transition. Right of Entry Agreements are necessary for work beyond the right
of way. The five driveways with challenging grade will receive a full driveway
replacement with this project.
6. The cost for the sidewalk and overlay improvements is not assessed. Money
from the Capital Park fund will be utilized to pay for the sidewalk improvements.
Dollars from the Operating Budget will be utilized to pay for the overlay
improvements.

The City Council will be making decisions on this project at two upcoming
meetings. Approval of plans and specifications will be taken to the City Council
at the April 4th City Council meeting. Approval of the bids will be taken to the
City Council at the May 16th meeting for consideration. If at the May 16th
meeting the bids received are acceptable to the City Council, the City would
enter into an agreement with a Contractor and work would begin.
Once construction begins the residents on 150th Street will receive project
newsletters outlining the construction schedule, contact information, and other
valuable information.
