Call to Order and Pledge of Allegiance: Commissioner Larson called the Monday, May 4, 2015 Prior Lake Planning Commission meeting to order at 6:00 p.m. Those present were Commissioners Adam Blahnik, Bryan Fleming and Wade Larson, and Planner Jeff Matzke. 2. Approval of Agenda: MOTION BY LARSON, SECONDED BY BLAHNIK TO APPROVE THE MONDAY, MAY 18, 2015 PRIOR LAKE PLANNING COMMISSION AGENDA. VOTE: Ayes by Blahnik, Fleming and Larson. The Motion carried. 3. Approval of Monday, April 20, 2015 & Monday, May 4, 2015 Meeting Minutes: MOTION BY LARSON, SECONDED BY FLEMING TO APPROVE THE MONDAY, APRIL 20, 2015 AND THE MONDAY, MAY 4, 2015 PRIOR LAKE PLANNING COMMISSION MEETING MINUTES. VOTE: Ayes by Blahnik, Fleming and Larson. The Motion carried. 4. Public Hearings: A. DEV15-001009 – Bendzick Automotive Variance & CUP – Bendzick Automotive is requesting a Conditional Use Permit to allow a Motor Vehicle Repair Service and a Variance from the minimum setback for a parking lot in the (C-2) General Business Zoning District; PID: 25-282- 005-0. Planner Matzke introduced a consideration of approval regarding a Conditional Use Permit to allow a motor vehicle service and repair land use in the C-2 (General Business) Commercial Zoning District. The site is located along Panama Avenue (Hwy 23) north of Village Lake Drive and south of Truck State Hwy 13. He explained the history, current circumstances, issues, alternatives and recommended motions. He provided a draft CUP resolution, draft variance resolution, location map and project plans dated April 17, 2015. Commission Comments/Questions: Fleming asked if the land was purchased or not. Planner Matzke replied the land has a purchase agreement in process with a closing date set, and further stated the applicant is aware of the deadlines. Fleming asked about the timing on the execution of the purchase agreement. 2 Planner Matzke suggested asking the applicant, as they are present tonight. Blahnik asked if this building requires 32 parking stalls and if there was an option to share parking with McDonalds. Planner Matzke replied the requirement is 32 parking stalls based on 4 parking stalls per service bay. He also mentioned that there used to be, until recently, shared parking easement with McDonalds. It was never envisioned to remain due to topography challenges. Blahnik asked if the five foot variance is identical to the setback variance to what McDonalds had previously received. Planner Matzke replied yes; 0there is ten feet between the two parking lots. MOTION BY BLAHNIK, SECONDED BY FLEMING TO OPEN THE PUBLIC HEARING AT 6:20 P.M. VOTE: Ayes by Blahnik, Fleming and Larson. The Motion carried. Applicant Adam Bendzick – ProService Automotive, Prior Lake, Minnesota. Larson questioned if they already have an existing business in Prior Lake and if they were running out of room in their current building. He asked how long ago they started their business and what kind of repairs will be performed, as well as the number of bays in the shop. He thanked him for staying in the community. Applicant Bendzick replied they have rented a building since they started their business 13 years ago in 2002, but he would like their own building. He mentioned repairs would be general mechanical and there would be two bays dedicated for oil changes and five for general mechanical. He stated Prior Lake is a great city for their business. Fleming asked about the current number of employees. Applicant Bendzick responded currently there are five employees, but he anticipates to double employees within the first couple of years, thereby creating more jobs in the city. Public Comment Tom Evenson – Gonyea Land Company located at 211 South River Ridge Circle, Burnsville, Minnesota. He is representing both the applicant and seller; they need to receive approval of the conditional use permit before the closing date set for June 1st. MOTION BY LARSON, SECONDED BY BLAHNIK TO CLOSE THE PUBLIC HEARING AT 6:21 P.M. VOTE: Ayes by Blahnik, Fleming and Larson. The Motion carried. Commission Comments/Questions: 3 Blahnik is in support of both the conditional use permit and the variance as requested by the applicant. He mentioned the five feet is backing up to a parking lot for McDonalds, and McDonalds had an identical variance for their parking lot, resulting in a reasonable ten feet between parking lots. The conditional use permit is consistent with the goals of the comprehensive plan and zoning ordinance. It will not have any undue adverse impact on adjoining properties as it will enhance the current vacant lot. With regards to the variance, there are practical difficulties given the shape of the lot being triangular as well as practical difficulties in the need to coordinate the parking. Fleming will be supporting the conditional use permit and variance with all the reasons of findings of fact that Commissioner Blahnik mentioned, as well as the list of conditions. Larson is supporting this business with the conditional use permit and variance, including its expansion in Prior Lake. MOTION BY FLEMING, SECONDED BY BLAHNIK TO APPROVE A RESOLUTION APPROVING THE CONDITIONAL USE PERMIT. VOTE: Ayes by Blahnik, Fleming and Larson. The Motion carried. MOTION BY FLEMING, SECONDED BY BLAHNIK TO APPROVE A RESOLUTION APPROVING THE VARIANCE SUBJECT TO THE LIST OF CONDITIONS. VOTE: Ayes by Blahnik, Fleming and Larson. The Motion carried. 5. Announcements / City Council Updates: Recent City Council Discussions/Decisions  TIF for Dominium project and the Ron Clark Pike Lake project  Announced next meeting as possibly canceled. 8. Adjournment: MOTION BY LARSON, SECONDED BY BLAHNIK TO ADJORN THE MAY 18, 2015 PLANNING COMMISSION MEETING. VOTE: Ayes by Blahnik, Larson and Fleming. The Motion carried.
