Prior Lake, MN 55372-1714 RESOLUTION 05-61 A RESOLUTION AUTHORIZING THE MAYOR AND CITY MANAGER TO ENTER INTO A PURCHASE AGREEMENT AND OPTION AGREEMENT WITH SCOTT COUNTY FOR THE ACQUISITION OF APPROXIMATELY 39 ACRES OF PROPERTY WITHIN SPRING LAKE PARK FOR COMMUNITY PLAY FIELD PURPOSES. Motion By: Fleming Second By: LeMair WHEREAS, the County owns Spring Lake Regional Park ("Park") within Scott County which consists of approximately 345 acres; and WHEREAS, the City desires to obtain approximately thirty-nine (39) acres of cropped park land in the northwest corner of the Park from the County in order to address a deficiency in active recreational area for community play fields identified in a 2004 study by Ingraham and Associates; and WHEREAS, as part of the consideration for the County transferring a portion of Spring Lake Park to the City, the County desires to obtain approximately three (3) wetland areas, containing approximately 51 acres adjacent to the Park to be included within the Park boundaries; and WHEREAS, the terms, conditions and consideration for this transaction are set forth in a Purchase Agreement and Option Agreement as identified in that certain City Council Staff Report, Item 10C, dated April 4, 2005; and WHEREAS, the transaction will not create any permanent net loss of acreage to the Park, will allow the park land to be used to its best advantage, and will provide land for the development of community play fields to address an identified need within the City of Prior Lake. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF PRIOR LAKE, MINNESOTA that: 1. The recitals set forth above are incorporated herein. 2. The Mayor and City Manager are hereby authorized to enter into the Purchase Agreement and Option Agreement identified herein for the acquisition of approximately 39 acres of property within Spring Lake Park for the future development of community play fields. 3. Funds for this transaction in an amount not to exceed $866,400.00 shall be drawn from the Capital Park Fund. PASSED AND ADOPTED THIS 4TH DAY OF APRIL, 2005.
