I am disappointed that there are ordinances that will prevent me from obtaining the needed variances to build a garage today. I am hopeful the situation changes when county road 12 is rerouted away from Spring Lake in the next couple of years. I may reapply at that time, if I still live at 2485 Spring Lake Rd. SW. Please cancel my two variance requests (setback from road and setback from lake) and refund to me all money paid to Scott County for this request. The amount of the refund should be$1,640.00. I need a variance of 53 feet from the shoreline setback (22 - 75). I also need a variance of 88 feet from the public road (County Road 12) setback (12 - 100). The proposed location of the garage is not near any other property owners. The proposed location is at least 15 feet from the nearest property line. The proposed square footage of the garage is 660 (22 X 30). The need for the variances comes with the setback from the road and the lake. If the garage is located 100 feet from the road, it will be in the lake. If the garage is located 75 feet from the lake, it will be in the road. If the proposed location for the garage is approved, it will be at least 22 feet between the closest point of the garage and the lake. I am proposing a 12-foot setback from the road for the driveway. I believe it is a hardship to be garageless in Minnesota. The location of my lot is squeezed between the road and the lake, but currently we are able to drive in off the road and park 3 cars comfortably in the proposed location of the garage during the summer. We are asking for permission to build a garage to protect our vehicles during the winter and improve the property appearance and value. Additional supporting facts: On June 7, 2003 someone broke a rear window on one of our unprotected vehicles. We filed a police report with the Prior Lake police. The report number is 2003-4204. • Granting of the variance will not be in conflict with the Comprehensive Plan. Extraordinary circumstances apply to this property, which do not generally apply to other properties in the same zoning district or vicinity. The West boarder of the property is only 50 feet from the edge of the roadway to the high water mark of Spring Lake. Where the house is located on the East boarder of the property there is 80 feet from the edge of the roadway to the high water mark of the lake. These distances do not include 13 feet of the property being used by the road. The literal interpretation of the provisions of the Ordinance would deprive us of building a garage. It is common for a house with a 100-foot wide lot to have a garage. Other properties in this same district have garages. There are no special conditions or circumstances as a result of my actions. Granting these variances as requested to build a garage will not confer on me any special privileges that is denied by this Ordinance to owners of other lands, structures or buildings in the same district. I believe all homeowners already have or could build garages. The variance requested is the minimum variance, which would alleviate the hardship. The variance requested would not be materially detrimental or will not essentially alter the character of the property in the same zoning district. In fact, the plan is to clean up the area of lumber and other stuff currently being stored outside to improve the looks and value of the property. Economic considerations alone do not constitute a hardship to us. If we continue to use the property for outside parking that currently exists under the provisions of this Ordinance, we will have to endure a severe hardship during the coming winter in Minnesota. The County snowplow will cover our automobiles with snow, slush, and gravel when they come through. We will have a difficult time starting our automobiles in the morning to go to work because of being stored outside and unprotected. There will require additional time every morning to clean all the windows on each automobile for a safe commute to work. There will also be a safety issue driving up an incline over snow and ice to enter County Road 12. A garage built up to the same level of County Road 12 would alleviate all of these problems. I have already met with Spring Lake Township representatives to discuss the variance application. They recommended reducing the garage size from 24 feet to 22 feet wide. The additional 2 feet of space would be to locate the garage 2 feet further from the lake. I have submitted this application with that request incorporated.
