SHAKOPEE, MN 55379-1393 (612) 496-8353 MEMORANDUM: IL C 0 P ■ TO: Jim Dunn % Bryce Huemoeller FROM: Jon Westlake, Planning Director DATE: April 26, 1994 SUBJECT: Request for Variance (#1243-v-il) from the requirement that the property abut a publicly maintained road in Section 4 of Spring Lake Township, zoned UE. This is to inform you that the Scott County Board of Adjustments has denied the above mentioned request, effective February 14, 1994, for the following reasons: 1. Jim Dunn (developer) created the 66' strips to develop the land, thus creating his own hardship. 2. To grant a variance from the required 66' public road frontage would be precedent setting as others of these situations are evident in the County. 3. Based on the Spring Lake Township attorney's opinion, a variance should not be granted on properties where the property owners are not the applicant and seem to be opposed.
