BOTHOF Dear Mr. Westlake: Please accept the following comments for the record at the public hearing on October 13, 1986 regarding variance requests for the above referenced persons. Mr. Doherty has requested a variance from the 50 foot setback requirement for a septic system, to 30 feet from Spring Lake. In viewing the drawing submitted with this request, it appears there are practical alternatives which would minimize or eliminate the variance requested. A 15 foot setback between the house and trench has been maintained with this proposal. My feeling is that this 15 foot corridor is less important than the setback from Spring Lake. Accordingly, I feel moving the two 35 foot trenches closer to the house is more reasonable. In fact, it would appear one of the trenches could be situated alongside the 46 foot trench, the other at 10 feet from the house and no variance from the lake setback would be required. Moreover, the distance between well and septic tank has been mentioned. Spring Lake is a highly valuable resource which spills into Prior Lake. These two waters comprise the most heavily used lake system in Scott County. It is of paramount interest to all residents of Scott County to protect these waters from any unnecessary input of nutrients. Therefore, if the alternatives I mention above can be put into effect (even though they may cost more) they should be required. Mr. Bothof proposes to place a detached garage along the north side lot line and seeks a variance from the required lake setback to 50 feet. I note from the drawing submitted that the actual distance from the lake is 43 feet, not 50 feet as proposed. I assume that the garage is to be situated at this particular location because the adjoining lot has a garage at the same approximate setback. This is not a sufficient reason to grant a variance. There is a general guideline that a house can be setback to the same distance as houses on adjoining lots, however the guideline is intended to provide reasonably consistent sightlines and use of the water for all residents. A garage neither promotes nor denies use of the water. Therefore, there is no reason to put it closer to the water just because the neighbor's garage is closer. Unless there is a more compelling reason to have the garage at a 50 foot setback (e.g. if there is a septic system in the way) I don't believe it needs to be any closer than the existing house. Incidentally, the Natural Ordinary High Water mark (NOHW) of Crystal Lake, from which the setback is determined, is at elevation 944.7 or .9 feet higher than the shoreline depicted on the survey submitted with the variance request. This means the proposed setback is actually less than the 43 feet shown on the survey, by some unspecified distance. I appreciate the opportunity to make these comments.
