AGENDA ITEM: CONSIDER APPROVAL OF A RESOLUTION WAIVING PLATTING
REQUIREMENTS FOR THE SUBDIVISION OF PROPERTY LOCATED AT
GATEWAY STREET AND FRANKLIN TRAIL
DISCUSSION: Introduction
The purpose of this agenda item is to review a request for the subdivision of an
unplatted parcel of land. The proposal includes the conveyance of 0.77 acres
of land to be transferred from property at 15870 Franklin Trail to 5116 Gateway
Street. If both parcels were previously platted, this exchange would be
handled by City staff as an administrative approval since each lot meets the
minimum requirements for the C-2 zone. However, since the property is
unplatted and no change in use is proposed, the City Council is being asked to
waive the platting requirements.
History
Two commercial buildings exist on separate lots zoned General Business (C-2)
in the Gateway business area. One building is known as the Olson Dental
office (15870 Franklin Trail), and the other is known as the Lemke Building
(5116 Gateway Street). The Olson property was recently sold to Vista
Property Management LLC. Since a portion of the Lemke property is long and
narrow along Gateway Street to the corner of Franklin Trail, the new Vista LLC
property owner inquired about adding that piece to their property. Since both
properties are unplatted, staff support a waiver of platting requirements action
by the City Council since no further changes on the site or buildings were being
proposed at this time.
Current Circumstances
The parcels are described as follows:
1. 15870 Franklin Trail; owner—Vista Property Management LLC
Existing size = 1.71 acres; Proposed size as "Parcel A" = 2.48 acres.
2. 5116 Gateway Street; owner— Paul Lemke Properties LLC
Existing size = 2.00 acres; Proposed size as "Parcel B" = 1.23 acres.
The minimum required lot area for parcels in the C-2 District was recently
amended from 1.0 to 0.5 acre; therefore, both new parcels remain as
conforming to the ordinance.
ISSUES: The subdivision of unplatted land (lands described by metes and bounds) is
regulated by Subsections 1006.104 through 1006.106 of the City Subdivision
Ordinance. These sections state the following:

1006.104 Conveyance By Metes And Bounds. No division of one or
more parcels in which the land conveyed is described by metes and bounds
shall be recorded if the division is a subdivision, as defined by the Subdivision
Ordinance. Building permits will be withheld for buildings or tracts that have
been subdivided and conveyed by this method without City approval and the
City may refuse to take over tracts as streets or roads or to improve, repair or
maintain any such tracts.
1006.105 Exceptions. The provisions of Section 1006.104 do not apply
where all the resulting parcels, tracts, lots, or interests will be twenty(20) acres
or larger in size and five hundred feet (500') in width for residential uses and
least five (5) acres or larger in size for commercial and industrial uses.
1006.106 Council Resolution Waiving Requirements. In any case in
which compliance with the foregoing restrictions will create an unnecessary
hardship and failure to comply will not interfere with the purpose of this
Section, the Council may waive such compliance by the adoption of a
resolution to that effect and the conveyance may then be filed.
The applicant is requesting a waiver of platting requirements to subdivide
property in order to allow for a transfer of 0.78 acre from one commercial lot to
another. The realignment of the property lines will not create any
nonconformity with the current Zoning Ordinance. In addition, both properties
are developed and currently serviced with an existing street and public utilities.
Therefore, waiving the platting requirements at this time will not interfere with
the purpose of the Subdivision Ordinance. In this particular case, City staff
believes that the obligation of the platting requirements creates an
unnecessary hardship for the property owners to subdivide the property. As a
condition of approval, the property owners must submit deeds for the newly
created parcels. Another condition requires platting on either parcel if further
improvements are made to the buildings that change the existing square
footage.
FINANCIAL There is no budget impact as a result of this proposal.
IMPACT:
ALTERNATIVES: 1. Motion and a second, as part of the Consent Agenda, to approve a
resolution waiving platting requirements for the subdivision of property
located at Gateway Street and Franklin Trail.
2. Motion and a second to deny the resolution and require the property be
platted.
3. Motion and a second to table action and provide staff with specific
direction.

A RESOLUTION WAIVING PLATTING REQUIREMENTS FOR THE SUBDIVISION OF PROPERTY LOCATED
AT GATEWAY STREET AND FRANKLIN TRAIL
Motion By: Second By:
WHEREAS, Paul Lemke Properties LLC, owner of property at 5116 Gateway Street is proposing to subdivide
and convey property to Vista Property Management LLC, owner of property at 15870 Franklin
Trail; and
WHEREAS, The property owners have asked the City Council to waive the platting requirements in order to
allow for the transfer of 0.77 acre from 5116 Gateway to 15870 Franklin, resulting in Parcel A at
2.48 acres and Parcel B at 1.23 acres in the General Commercial (C-2) Use District; and
WHEREAS, The City Council has found that compliance with the restrictions set forth in Subsections 1006.104
and 1006.105 of the Subdivision Ordinance will create an unnecessary hardship and failure to comply
will not interfere with the purpose of the Subdivision Ordinance; and
WHEREAS, The City Council has approved the conveyance of this property by metes and bounds.
NOW THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF PRIOR LAKE, MINNESOTA as
follows:
1. The recitals set forth above are incorporated herein.
2. The platting requirements are hereby waived.
3. The property owners may convey the property as shown on the survey dated July 23, 2015 for Parcel A and
Parcel B.
4. Conveyance of this property is subject to the condition that the property owner(s) submit deeds to the City
describing the newly created parcels.
5. Any future change in the square footage of the existing primary buildings or the construction of new buildings
on either Parcel A or Parcel B will require the platting of the parcel(s) corresponding to the building change or
construction project.
