MAYOR AND CITY MANAGER TO EXECUTE A LAND SURVEYOR'S
CERTIFICATE OF CORRECTION TO PLAT
DISCUSSION: History
The land office of the SMSC is in the process of examining the titles to
property it owns. One such property is the Meadows of Mystic. The
survey for the property in question contains numerous areas including
distance, and bearings of various descriptive lines. The SMSC seeks to
correct the plat.
Current Circumstances
The city has received a land surveyor's certificate of correction. Because
the property in question is located within the corporate boundaries of the
city we have been asked to approve and execute the correction.
Conclusion
The Council should determine if it desires to support this RLS survey
correction.
ISSUES: Correction of previous surveying errors is desirable. This action may be
taken in anticipation of a Fee to Trust Application.
FINANCIAL None.
IMPACT:
ALTERNATIVES: 1. Approve the land surveyor's Certificate of Correction and authorize the
Mayor and City Manager to execute the same as part of the consent
agenda.
2. Remove this item from the consent agenda for further discussion.

A RESOLUTION APPROVING A LAND SURVEYOR'S CERTIFICATE OF CORRECTION TO PLAT
Motion By: Second By:
WHEREAS, the Shakopeee Mdewakanton Sioux Community is the owner of lands collectively referred to
as Meadows at Mystic Golf Course, and
WHEREAS, the SMSC is examining the plat in an effort to correct any errors which may exist, and
WHEREAS, errors have been identified in Document T231323 which is Registered Land Survey No. 218,
dated August 5, 2014 which require correction, and
WHEREAS, a Certificate of Correction to Registered land Survey No. 318 has been prepared by Bolton &
Menk, Inc. on behalf of the SMSC, and
WHERAS, such certificate requires approval by the City Council of prior Lake and execution by the Mayor
and City Manager since the property is located within the city's corporate limits.
NOW THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF PRIOR LAKE,
MINNESOTA as follows:
1. The recitals set forth above are incorporated herein.
2. The above identified certificate of correction is hereby approved by the City Council of the City of Prior
Lake.
3. The Mayor and City Manager are hereby authorized to execute the certificate on behalf of the city.

LAND SURVEYOR'S CERTIFICATE OF CORRECTION TO PLAT
Name of Plat: REGISTERED LAND SURVEY NO. 218
Pursuant to the provisions of Minnesota Statutes, Section 505.175, Nathaniel T. Stadler, the
undersigned, a Registered Land Surveyor in and for the State of Minnesota, declares as follows:
1. That the plat of REGISTERED LAND SURVEY NO. 218 dated August 5, 2014 and filed on
October 31, 2014 in the office of County Registrar of Titles, Scott County, Minnesota, as
Document No. T231323 was prepared by Richard J.Williams, a Registered Land Surveyor who
is not now available for the following reasons:
Richard J. Williams has retired from surveying and is no longer in the area.
2. That said plat contains errors, omissions, or defects in the following particulars, to-wit:
A. The distance on the easterly line of Tract B reads"662.63" is incorrect.
B. The bearing and distance on the southerly line of Tract B reads"N 44°32'50"W 134.27"
is incorrect.
C. The bearing and distance on the southerly line of Tract B reads"N 50°19'03"W 127.78"
is incorrect.
D. The bearing and distance on the southerly line of Tract B reads"N 61°20'40"W 242.14"
is incorrect.
E. The bearing and distance on the southerly line of Tract B reads"N 66°33'38"W 133.36"
is incorrect.
F. The distance on the westerly line of Tract B reads"321.29" is incorrect.
3. That said plat is hereby corrected in the following particulars, towit:
A. The distance indicated above in 2 (A) should read "665.81".
B. The bearing and distance indicated above in 2 (B) should read "N 44°23'51"W 137.23".
C. The bearing and distance indicated above in 2 (C) should read "N 50°10'04"W 127.78".
D. The bearing and distance indicated above in 2 (D) should read "N 61°11'41"W 242.14".
E. The bearing and distance indicated above in 2 (E) should read "N 66°24'39"W 132.14".
F. The distance indicated above in 2 (F) should re "321.49".
