OF THE 180-DAY REVIEW PERIOD FOR AN AMENDMENT TO THE JEF-
FERS POND PRELIMINARY PLANNED UNIT DEVELOPMENT TO ALLOW
A MOTOR FUEL STATION AND CAR WASH
DISCUSSION: Introduction
The purpose of this agenda item is to consider an extension request to the
180-day review period by C-Store Partners for its application to amend the Jef-
fers Pond Planned Unit Development (PUD) in order to allow a Motor Fuel Sta-
tion and Car Wash for Super America.
History
Kimley-Horn & C-Store Partners have applied for approval of an amendment to
the Jeffers Pond PUD to allow a Super America within Outlot C of Jeffers Pond.
In 2005, the City Council approved a Preliminary PUD Plan for approximately
336 acres as Jeffers Pond development including mixed-use commercial devel-
opment in Outlots B and C. On July 27, 2015, the City Council tabled the amend-
ment application and requested that it come back on August 24th for action, in-
cluding a possible review extension if requested by the applicant, C-Store Part-
ners.
Current Circumstances
C-Store Partners has submitted a "Waiver of 120 Days" form dated August 12,
2015 that would extend the maximum City 180-day review period from Septem-
ber 18 to October 31, 2015. This extension will allow the applicant, in conjunc-
tion with the Jeffers Foundation, to complete and submit information requested
by the City Council on July 27, 2015. This information includes an updated
traffic study, a phasing plan, and design criteria for commercial and residential
development, all within Outlots B and C.
ISSUES: Sufficient time is necessary to provide information requested by the City Council,
which warrants an extension of the City's review period.
ALTERNATIVE 1. Motion and a second to approve a resolution approving an extension of
MOTIONS: the City's 180-day review period for an amendment to the Jeffers Pond
Preliminary PUD.
2. Motion and a second to deny a resolution to extend the 180-day review
period.
3. Motion and a second to table action and request further information
from City staff.

A RESOLUTION APPROVING AN EXTENSION OF THE 180-DAY REVIEW PERIOD FOR AN
AMENDMENT TO THE JEFFERS POND PRELIMINARY PLANNED UNIT DEVELOPMENT TO ALLOW
A MOTOR FUEL STATION AND CAR WASH

WHEREAS, Kimley-Horn and C-Store Partners (the "Developer") submitted an application for an
amendment to the Jeffers Pond Preliminary Planned Unit Development ("PUD") Plan to
allow a Motor Fuel Station and Car Wash for Super America in Outlot C of Jeffers
Pond; and
WHEREAS, The Prior Lake Planning Commission conducted a public hearing on June 15, 2015 to
consider the proposed amendment to the PUD and further recommended approval; and
WHEREAS, The Prior Lake City Council considered the application for the proposed amendment to
the PUD on July 27, 2015, and further tabled the request until August 24, 2015; and
WHEREAS, The City Council requested that the Developer submit additional information for review
prior to making a final decision, including an updated traffic study, a phasing plan and
design criteria, all for development proposed in Outlots B and C; and
WHEREAS, The Developer submitted a request on August 12, 2015 to extend the 180-day City review
period from September 18 to October 31, 2015; and
NOW THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF PRIOR LAKE,
MINNESOTA as follows:
1. The recitals set forth above are incorporated herein.
2. The City Council approves the extension of the 180-day review period to October 31, 2015.

BY THE APPLICANT. YOU HAVE REQUESTED/AGREED TO AN EXTENSION BEYOND
September 18,2015 TO October 31,2015. THE REASON FOR THE EXTENSION IS AS
FOLLOWS:
To allow the city council additional time to consider conditions of approval for the current Super
America application and the master developer to update a traffic study and complete design
standards for future development areas.
