CITY COUNCIL WORK SESSION REPORT

AGENDA ITEM: WORK SESSION TO DISCUSS FEE TO TRUST
The City Council has scheduled the September 28, 2015 work session to
discuss Fee to Trust. The entire session is devoted to this topic.
The agenda for the work session as previously shared with the City
Councilmembers includes the following:
I. Copies (attached) of both Fee to Trust Applications for ICO
(Menden area) and Meadows. The City Attorney will briefly
summarize these applications.
II. Process — How, when and what may the City challenge? As with
most things there is a protocol and process the City must follow to
preserve its opportunities to act.
III. Past history of Fee to Trust applications—the City Attorney will
share some of the applications for Fee to Trust affecting Prior Lake
from the 1990's to present.
IV. Successful and unsuccessful arguments —the City Attorney's office
has looked at published Fee to Trust applications to identify the
arguments which have been both successful and unsuccessful. He
will share them with the City Council as well as respond to
questions.
V. Issues that might be relevant to these two applications —the City
Attorney and Councilmembers can discuss the issues which are
relevant to these applications as a starting point for comments.
The Council may want to meet again once the 30 day notice is
received from the BIA for each.
VI. The YMCA letter is attached. The Council may wish to consider
the YMCA (format not necessarily content) as a template for its
responses to these and future applications.
VII. Typically only the cities or counties are notified about making
comments regarding Fee to Trust applications. Would the City
Council want to encourage others to respond (Metropolitan
Council, School District, Watershed or Townships)? Attached is
the Metropolitan Council letter indicating that the City has an
obligation to implement its Comprehensive Plan. Councilmembers
have asked that this subject be part of the work session as the
placement of property into trust can complicate City plans.

VIII. Arguments made by the City may require research or expertise not
found on staff or City Attorney's office. The City Council should
discuss what it wishes to do in this regard. If no additional
resources are desired, the City Council should discuss how much
time should be spent by Staff and attorney on this matter including
City Council inquiries, work sessions or other interactions.
IX. At the conclusion of the meeting the Council should provide
direction to the Staff regarding what it desires to do next on this
topic or if it wants a proposed process and timeframe prepared for
subsequent consideration.
X. The City Attorney has prepared a Power Point presentation which
he will present to the City Council Monday evening. A paper copy
will be available at that time as well.
