INTRODUCTION'
BACKGROUND'
The purpose of this Agenda item is to authorize eminent domain
proceedings in accordance with Minnesota Statutes Chapter 117 for the
Northwood Road improvement project. Approval of a Resolution is in
order for authorization of the eminent domain proceedings. Also staff is
requesting the Council authorize appraisal and land acquisition work by
approving one of the attached quotes.
The improvements to Northwood Road were included in the City's Capital
Improvement Program along with programmed Municipal State Aid
funding. The roadway has deteriorated severely and a public hearing
was approved for reconstruction of Northwood Road.
On April 4, 1994, the City Council adopted Resolution 94-15 ordering the
preparation of plans for Northwood Road. MSA Consulting Engineers
was authorized to prepare plans for the project. On December 19, 1994,
the City Council authorized the necessary easement description work to
construct the street, walk and utility improvements by MSA Consulting
Engineers.
The easement description work was inadvertently omitted from the plan
preparation. Staff mentioned on the December 19, 1994, staff report that
appraisal and land acquisition proposals as well as authorizing eminent
domain proceedings would be requested at a future meeting.
Staff is requesting that eminent domain proceedings be authorized by the
Council. A Resolution is enclosed for Council action on this procedure.
Attached to the Resolution are the preliminary drawings of the land
acquisitions needed for Northwood Road street, walk and utilities.
Attached to this report are proposals from appraisers and land acquisition
firms for performing work as follows:

DISCUSSION:
MSA Consulting Engineers has worked with Evergreen Land Services
Co. and believes an independent firm can acquire the easements more
cost effectively than their firm. Appraisals are needed to determine a land
acquisition cost for land acquisition and possible condemnation
proceedings. Universal Valuation Services, Inc. was the firm that
performed appraisals on Northwood Road for lakeshore, non lakeshore
and vacant parcels before and after a street improvement. The appraisal
work and land acquisition will be both done on an hourly basis.
The proposals for the appraisals do not have a cost to exceed figure.
Universal Valuation Services, Inc. has subsequently agreed to not
exceed $10,550 for the cost of the appraisals. Testimony for
condemnation would be an additional cost at an hourly rate.
The amount of time required for easement acquisition will vary depending
upon the cooperation of the property owners. Staff requests that the
Council authorize Evergreen Land Services Co. to do the land
negotiations with a cost not to exceed $6,000 without Council approval.
The intent is to stay within the $3,000 to $5,000 estimated range.
Eminent domain proceedings are authorized under Minnesota Statute 117
and is for public entities in obtaining land for public purposes. Northwood
Road is a local City collector which is on the City's State Aid System.
Portions of the right-of-way acquisition costs can be eligible for State Aid
reimbursement. A right-of-way acquisition cost of $74,300.00 was
estimated in the Feasibility Study.
Staff's intent is to pursue obtaining all necessary easements by using the
land acquisition firm in lieu of condemnation. Eminent domain
proceedings will commence concurrently as the negotiation process is
done so that right-of-way will be available for construction. Parcels will be
removed from eminent domain proceedings.if they are acquired.

The recommendation is for the Council to approve a Resolution to
authorize eminent domain proceedings on the Northwood Road project.
Also the recommendation is for Council to approve Universal Valuation
Services, Inc. to perform the appraisal work as the firm has done the
previous appraisals for the Northwood Road project, and the hourly rate is
less than the other firm. Also to approve Evergreen Land Services Co. to
perform the land acquisition work as per the attached proposals as their
proposal had an estimated lower total cost, lower hourly rate and has
worked with MSA Consulting Engineers previously.
The Council should approve the attached Resolution and approve a
motion authorizing Universal Valuation Services, Inc. to prepare the

installation of grading, storm sewer, aggregate base, concrete curb and gutter,
bituminous surfacing, walk, and appurtenant work improvements associated
therewith for public purposes, and
WHEREAS,
private negotiations may not be successful in acquiring the necessary required
interests in said property for the needed public purposes, and
WHEREAS
it may be necessary to commence eminent domain proceedings under Minnesota
Statutes Chapter 117 for the acquisition of certain land interests for the purposes
of completing the above project.
NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY COUNCIL OF PRIOR
LAKE, MINNESOTA, that authorization is hereby granted to such City officials and agents as necessary
to acquire temporary and perpetual easements for street, utility, and drainage purposes with the right to
install, repair, maintain, alter, add or remove, replace, said utilities and to install and maintain said roads,
on, over or across a portion of the lands described in and attached hereto as Exhibit "A".

Northwood Road
Dear Mr. Anderson,
This morning I met with Steven Ische of MSA Consulting Engineers
to discuss the various parcels affected by several easements in
connection with the Northwood Road project. Since only
preliminary plans were available for review, and the individual
parcels and owners had not been completely identified along
Northwood Road, the bid I will provide you must be considered a
preliminary range until complete details are available.
The preliminary maps we reviewed consisted of 4 sheets showing
the proposed easements and road alignment. We will reference
these sheets by number to help clarify the parcels we have
identified in our bid.
During our review of the project, it is my opinion that the
parcels affected should be divided into 3 separate reports. Two
of the reports will be prepared specifically for two property
owners. The remaining report will cover approximately 23
parcels. For the purpose of this bid, we will refer to the
reports as 1- Scott County; 2- Outlot A; 3' Platted Lots. We
will discuss our bid for each of these reports below.
REPORT NO. I (Sheet 1)
This first report appraises only the land owned by the Scott
County Park Reserve. The proposed roadway project does not
appear to follow any existing roadways, but rather follows a 50'
wide sanitary sewer easement.
The land being taken includes a permanent roadway taking, seven
total temporary easements and two permanent drainage easements.
Considering the size of the parcel affected and its use, we
believe this parcel should be appraised separately.
Proposed Fee Range- $1,200 to $1,800.

REPORT NO. 2 (Sheets 2-4)
This report appraises a large parcel of land located on the
Northwest side of Northwood Road. Part of the proposed roadway
·
will require acquisition of part of the property not within the
dedicated existing roadway easement. This taking will also
result in severance damages to a small parcel between the new and
existing roadway (Sheet 2-Bottom of Page).
Other easements located along Northwood Road affecting this
parcel include 4+ temporary easements, 3+ drainage easements, 1
Street and sidewalk easement and a 16' street easement. This
parcel may require a complete subdivision analysis. Therefore,
due to the size and potential complexity of this parcel, we
believe this parcel should be appraised separately as well.
Proposed Fee Range' $1,800 to $2,500
REPORT NO. 3 (Sheets 1-4)
The remaining parcels are all individual platted lots. Except
for four parcels on Sheet 2, these parcels should all fall under
a similar valuation technique, and can be grouped into one
report. Most parcels have only a temporary easement involved.
However, 6 parcels include a permanent roadway easement. Four of
these parcels appear to be severed and will require further
analysis and possible additional damages to existing
improvements.
Therefore, we propose a bid based upon the number of easements
which should be valued. The first easement for each parcel would
be $250, and additional easements on the same parcel would add
$100/easement.
The severance damages or additional damages will have to be
examined carefully and may require a completely different
analysis. Since this is a preliminary bid, severance damages
will be the "unknown" which must be examined more carefully when
the final parcels have been identified in this project.
For severance damages and any other "unknown" factors which must
be valued, we will submit an hourly rate of $60/hour to cover
this contingency.
Having looked over the preliminary plans for the project, we have
identified 23 parcels and the easements which will affect each.
We assume that each of these parcels is under individual
ownership. If two lots are combined under one owner, then one of
the lots would be eliminated from our bid.
On the following page, we have identified the lot numbers, the
sheet on which they are located, and the easements which appear
to affect each. A proposed fee is then associated with each as
we discussed above.

Appraisal Fee Estimate
At your request, we have examined the right-of-way and street reconstruction plans
concerning the Northwood Road Project as provided by MSA Consulting Engineers. On the
basis of this information, we are submitting the following proposal for an appraisal of the
project area.
The appraisal would rely upon an analysis of comparable sales of residential lots and/or
acreage. The appraiser would arrive at a conclusion of market value for each parcel both
before and after the taking. '
Our fee for the project will be $9,000.00 to $10,000.00. Included in this fee estimate would

Acquisition ia a negotiated process involving at least two parties. The reasonableness and
level of cooperation we receive from the seller or their representatives can greatly a_ffe~ the
amount of time it takes to negotiate a settlement. We have been very successful in estabhsh-
lng working relationships based on respect for all parties. It is an approach that permits the
acquisition proc~ to proceed in an orderly manner. We recognize that we are using public
funds. We wan~ our efforts to be fair, but do not throw dollars at a problem as a way to
settle disputes.

Mr. Frank Kriz (MSA) requested a brief description of Evergreen Land Services Co. and a
proposal ~om our firm to provide acquisition services for the above referenced project.
Evergreen Land Services Company (El,S) was founded in 1972. It is the oldest firm in
Minnesota specializing exclusively in land acquisition work for public and private -
cn,~t,e.s. The
firm is recognized Ibr its wide variety of projects implemented under the Federal Uniform
Relocation and Acquisition Act, and for its knowledge of Minnesota State Aid (MSA)
procedures and Minnesota Statutes I 17.52.
ELS maintains a staff of 10 full-time employees who are qualified professionals with diverse
experience in land acquisition which insures the quality and cost effective implementation of
each project. We also have an additional 20 agents available on a "as needed basis".
This project will involve funding that requires compliance with previously mentioned Minnesota
Statutes and MSA procedures. The following are projects and agency contacts for acquisition
services performed by Evergreen under these statutes and procedures.
