HomeMy WebLinkAbout6A - 1995 Improvements Projs.STAFF AGENDA REPORT AGENDA #: PREPARED BY: SUBJECT: DATE: 6A PAUL BOETTCHER, ACTING ASSISTANT CITY ENGINEER CONDUCT PUBLIC HEARING ON 1995 IMPROVEMENT PROJECTS AND CONSIDER A RESOLUTION ORDERING IMPROVEMENTS AND PREPARATION OF PLANS a) Project 95-01 RidgemontAvenue b) Project 95-02 Creekside Circle c) Project 95-03 Titus Addition FEBRUARY 6, 1995 INTRODUCTION: BACKGROUND: The purpose of this Agenda item is to conduct a Public Hearing for Projects 95-01, 95-02, 95-03, and other City projects and to consider the adoption of a Resolution ordering these improvements and the preparation of plans. On December 5, 1994, the Council approved both the Feasibility Study for the projects and Resolution 94-61 calling for a Public Hearing on the improvement projects. Resolution 94-61 scheduled a Public Hearing for the 1995 improvement projects for February 6, 1995. On January 30, 1995, at 6:30 p.m. in the Council Chambers, staff conducted an Informational Meeting to explain the scope of each project and the estimated assessments as well as received feedback from the residents. Information received from this meeting will be presented to Council at the Public Hearing. Included in the packet are sample assessment sheets which provide the assessment rate and a project financing summary sheet which provides the funding sources and tax levy for each project area. AREA 1 - Ridgem0nt Avenue - pro!ect 95-01 Ridgemont Avenue is the only access to quite a large residential area. It is proposed that Ridgemont Avenue be reconstructed from the existing concrete curb and gutter north to Rutledge Street as shown in Exhibit 2. Ridgemont Avenue has been patched in numerous locations and has extensive cracks. The portion of road proposed for improvement does not have concrete curb and gutter. Reconstruction of the existing road to an urban section with concrete curb and gutter and minor storm sewer improvements is proposed. The typical street section is shown in Exhibit 3. The southerly portion of Ridgemont Avenue does not have sanitary sewer or watermain. Street reconstruction provides the opportunity to extend a lateral sanitary sewer line south in order to provide service to the existing homes on the east side of Ridgemont and undeveloped parcels. Since the homes in the area are twenty or more years old, it is likely that the septic systems do not meet current standards and both on-site septic and water systems could be subject to failure. The proposed utility improvements are shown on Exhibit 4. The project consists of 3,200 linear feet of concrete curb and gutter, 1,600 linear feet of bituminous surfacing and 900 feet of sanitary sewer and watermain. The Ridgemont Avenue project is a hold-over from the 1994 Capital Improvement Project and will be assessed to the benefitting property owners and included in the 429 bond issue. AREA 2 - Creekside Circle - Project 95-02 Creekside Circle is shown in Exhibit 5. The pavement on this street has pot holes and has been patched in several locations. There is extensive alligator cracking. Currently, storm water runoff is conveyed by existing ditches to the cul-de-sac where a catch basin collects the runoff and discharges it to the creek. The north end of the road has a bituminous berm that will be replaced with concrete curb and gutter. Other improvements include street reconstruction with new bituminous surfacing and storm sewer improvements. The proposed typical sections consist of both an urban and rural section as shown in Exhibit 6. The rural portion will remain as is in order to maintain adequate cover over the existing watermain. This project consists of approximately 800 linear feet of concrete curb and gutter and 1,100 linear feet of bituminous surfacing. This project is also a hold-over from the 1994 Capital Improvement Project and will be assessed to the benefitting property owners and included in the 429 bond issue. AREA 3 - Titus Addition - Project 95-03 The properties within the Titus 1st Addition have wells and individual septic systems. It is not anticipated that City sewer and water will be extended to the area for 15 years. The streets have extensive cracking and have had several large areas patched. The streets have a bituminous curb and storm sewer. Exhibit 7 shows the streets within Titus 1st Addition proposed for improvements, which includes milling the existing bituminous blending it with existing base, and placing a 1.5" bituminous overlay. Martindale Drive will be reconstructed at Pike Lake Trail in order to improve the vertical curve at the intersection and the subgrade inspected for correction prior to the overlay. The project consists of resurfacing approximately 3,000 linear feet of street and reconstruction of 100 linear feet. The typical sections are shown in Exhibit 8. Benefitting property owners will be assessed, and the City portion of the project costs included in the 429 bond issue. AREA 4 - Restrooms/Storage Construction in Memorial Park This project would enhance the Memorial Park ball field which is a high use facility during the spring, summer and fall times of year. Restrooms and additional storage is needed and would enhance the ball park. The cost of the project will be included in the 429 bond issue to be paid by ad valorem tax levy. This item was moved up in the Capital Improvement Program to 1995 by the City Council. -2- DISCUSSION: AREA 5 - CSAH 18 from the North City Limits tO CSAH 42 This project is for the improvements associated with County Road 18 construction in which approximately 1,900 lineal feet of roadway is in the Prior Lake city limits. City improvements to be considered are concrete curb and gutter, storm sewer, walks, utility crossings, and landscaping. The costs of the project are the City's participating costs within the County project, and will be included in the 429 bond issue to be paid by ad valorem tax levy. This project was originally deleted from the 1995 Capital Improvement Program and added back at the feasibility phase when it became apparent the county was going to continue to pursue action regarding this extension. AREA 6 - CSAH 44 from T.H. 13 to East City Limit Line This project is for the improvements associated with County Road 44 construction in which approximately 5,400 lineal feet of roadway is in the Prior Lake city limits. City improvements to be considered are concrete curb and gutter, storm sewer, sidewalk, trail, lighting, landscaping, and traffic control signal. The costs of the project are the City's participating costs within the County's project, and will be included in the 429 bond issue to be paid by ad valorem tax levy. The project is proposed for 1995 in the Capital Improvement Program. AREA 7 - Trail Improvements along County Road 83 from County Road 82 to CSAH 42 This project is for the trail improvements associated with County Road 83 construction in which 8,000 lineal feet of roadway is in the Prior Lake city limits. The vast majority of this $4 million road improvement project is to be paid by the Mdewakanton Dakota Community. Approximately $400,000 is to be paid by the developer of The Wilds. The $40,000 anticipated for trail construction is on the west side of County Road 83 north of the Dakota property and south of County Road 42. This segment of trail is not part of The Wilds responsibility and the Dakota have declined to pay for it. While the project is not contemplated in either the 1994 or 1995 Capital Improvement Program it is an important segment to complete given the anticipated traffic at the County Road 42/83 intersection in future years. The trail costs will be paid by an equal amount from the Capital Park Fund and Street Collector Fund. AREA 8 - Construction of Restrooms/Shelter in Grainwood Park This project would enhance the Grainwood Crossing Park near the CSAH 21 bridge crossing of Upper and Lower Prior Lake. Restrooms and shelter would enhance the use of the park and were anticipated as the "city match" to grant funds received for this project. The cost of the project will be included in the 429 bond issue to be paid by ad valorem tax levy. The project is anticipated for 1995 in the Capital Improvement Program. Staff will make a presentation of Project 95-01 Ridgemont Avenue, Project 95-02 Creekside Circle, and 95-03 Titus 1st Addition showing the existing conditions, proposed assessments, and project schedule. The City of Prior Lake initiated a street reconstruction program in 1985. To date, four projects have been completed. A fifth project, Northwood -3- Road, will be completed in 1995. These three projects were included in the 1995 Capital Improvement Program. If approved by the City Council, these projects will be constructed in 1995. Included in the Council Agenda packet are: Exhibits 2 through 8 from MSA Consulting Engineers on the proposed project improvements for Ridgemont Avenue, Creekside Circle and Titus Addition. Ridgemont Avenue - Project 95-01 Reconstruction of the south portion of Ridgemont Avenue without the extension of sanitary sewer and watermain would be contrary to City policy. Currently in this non-serviced MUSA area two dwelling units exist with wells and septic systems. If utilities are not extended, the potential exists for two new dwelling units to be added to exis~,n_g lots of record. If utilities are extended as proposed, the potential exi~s~for a total of six to seven new dwelling units to be built based on lot splits per City standards. It should be noted that the City is already sharing in half of the utility extension costs due to the park property on the west side of Ridgemont Avenue. The two existing dwellings may have septic systems which handle their flow today. However, they both appear to be 20 years or older and may have non-conforming septic systems. Non-conformance requires upgrading to current standards which may not be an economical alternative if City utilities are available. Septic systems may work today but fail when the property changes ownership and the flow increases. The Council should receive and consider comments from affected property owners of the proposed improvements. Based on the input received at the hearing and all other relevant factors, the Council can determine if the project merits approval at this time. At the Public Informational Meeting for Ridgemont Avenue, there was a concern raised about narrowing the street from about 36 feet to 30 feet which is the City standard. The existing street was striped with a bike lane on the west side. The City intends to construct a 5 foot wide sidewalk along the west side to provide a safe pedestrian way which would connect with the sidewalk already in place coming up the hill from the south. The additional cost to provide a sidewalk is $18,650 which could be paid out of the City Collector Street fund. Also a letter from O'Neill, Traxler, Zard, Neisen & Morris, Ltd representing Mr. & Mrs. Larry Haferman of 15831 Ridgemont Avenue SE was received by the City and is included in the Agenda packet. The letter objects to the installation of sanitary sewer and watermain. At the Public Informational Meeting for Titus Addition, residents were concerned with three Shakopee residents along the east side of the addition being allowed access from Prior Lake streets without contributing to the cost of providing this benefit. Should they not be assessed or -4- annexed to the City of Prior Lake? Prior to the meeting, staff will be contacting the City of Shakopee to determine if they will participate in the improvement costs. Also, the residents questioned why Pike Lake Trail does not have dust control placed on it? The cost to provide dust control from the north end of the lake to the north City limits of Prior Lake is $1,350 per application, depending upon the year, one application may be adequate. The City in the past has requested residents to pay for dust control. The City could, at the request of the residents, include in the assessment costs for dust control for the next year or years. The Feasibility Study presented to Council on December 5, 1994, had estimated total project costs and assessment costs as described below: Ridgemont Avenue had an estimated total project cost of $294,700.00 for street, sewer and water. The north section of Ridgemont Avenue is serviced by sanitary sewer and watermain and the south portion does not. As a result, each area will have a different assessment rate. The City's past practice for assessment for street, sewer, and water projects is 100% assessment of the project cost, and for street overlay/reconstruction projects is 60% of the project cost. The remaining 40% of the street project cost is recovered by the City's ad valorem tax levy. The project will be assessed by the front footage method and the estimated assessment rate is $77.55 per assessable front foot for street, sewer, and water areas, and $46.53 per assessable front foot for street only areas. In addition, a trunk charge for trunk sanitary sewer and watermain will be assessed based on property acreage, at $3,500/acre. The areas with municipal sewer and water service will be assessed at 60% for street paving and the areas without will be assessed at 100% for street paving. Creekside Circle had an estimated total project cost of $155,900.00. The Project Assessment per ordinance for street overlay/reconstruction projects is 60% of the project cost which is $93,540.00. The remaining 40% of the project cost is recovered by the City's ad valorem tax levy. The project will be assessed by the front footage method. The frontages used will be the same as for the original paving Project 78-11, and the estimated assessment rate is $35.85 per assessable front foot. Titus Addition had an estimated total project cost of $124,900.00. The Project Assessment per ordinance for street overlay/reconstruction projects is 60% of the project cost which is $74,940.00. The remaining 40% of the project cost is recovered by the City's ad valorem tax levy. The project will be assessed by the unit method as per ordinance and the estimated assessment rate is $2,341.87 per unit. Financing of this project cost is as follows: 1 .) Capital Park Fund ....................................... $ 20,000.00 Project Cost Total ..................................... $ 1,297,968.00 The tax levy of $834,910.00 would result in an annual increase of taxes of $27.21 on an average Prior Lake home with a $120,000.00 market value. The tax increase would be over a ten year period unadjusted for future -5- ALTERNATIVES: RECOMMENDATION: FINANCIAL IMPACT: ACTION REQUIRED: valuation growth. This would equate to an estimated property tax increase based upon the 1994 property tax statements of 4.0% as was indicated at the time the Council approved the Feasibility Report in November. With a 429 Special Assessment Improvement Bond, at least 20% of the bond issue must be assessed per State Statute. In the Feasibility Study the percent assessed is $310,376.00 divided by $1,145,286.00 or 27%. Bond Counsels usually recommend 25% to ensure that the 20% assessed amount is met. It may be prudent to consider writing down a share of tax levy costs by other funds if it is anticipated that assessment appeals may occur at the time of the Public Hearing prior to bonding. One of the concerns with the review and approval of the three assessment projects is the need to assess at least 20% of the 429 bond total which is comprised of the assessment and tax levy amounts. If the proposed projects are not approved in their entirety, the percentage being assessed will vary below the recommended 25% to ensure 20% assessment is met if appeals occur. The following chart shows the percent assessed based upon various combinations of project approvals. The construction services cost is not to exceed $47,750 or 8% of the estimated construction cost. The alternatives are as follows: , Adopt the Resolution ordering the improvements and preparation of plans for projects in areas 1 through 8. Approve a motion authorizing MSA Consulting Engineers to prepare the plans and specifications for the improvement projects. . Modify the Resolution and abandon projects as desired by the Council and direct MSA to prepare plans and specifications for those projects we will complete. 3. Table this item for a specific reason. The recommendation is to adopt the Resolution approving the projects. Action on the Resolution depends on public input and should be withheld until after the Public Hearing and comments have been received by the property owners. The cost of the projects will be recovered through special assessments, capital park funds, trunk reserve, and collector street funds. The action required will be to make a motion to approve or deny the Resolution. I am the owner of the property at 15785 Ridgemount Avenue, Prior Lake, Mn. I have owned this 1.0 acre parcel for over 25 years. In the last 3 years I have had 3 different opportunities to sell the land, but after talking with city staff each time I was assured that the city would be installing sewer and water to my property the following year and that I should wait another year for the improvements. I feel this improvement is needed and it is also my understanding that the city is committed to servicing the entire city with public sewer and water.
