INTRODUCTION:
Staff is requesting the City Council to adopt the new
Minnesota State Building Code along with several optional
chapters. The Minnesota State Building Code has been
revised and updated to incorporate the newest available
codes. For example, we are now using the 1988 Uniform
Building Code as referenced with the present State Building
Code. The new State Building Code adopts by reference the
1994 Uniform Building Code.
BACKGROUND'
Many people would classify this proposed amendment as
simple housekeeping because existing codes now in effect
are just being updated. Additional codes or new codes are
not being considered as a part of this request.. However, the
Council should be aware that a new fee schedule would be
used in determining the Building Permit and Plan Review
Fees only. The revised fee schedule is a part of the 1994
Uniform Building Code and will be used without modification
by the vast majority of municipalities. The cities of Apple
Valley and Shakopee are already using the revised fee
schedule. Most municipalities will start using the revised fee
schedule after the adoption process is completed. Below is a
permit fee estimate for a single family dwelling with a
valuation of $100,000.00 for comparison purposes.

DISCUSSION:
Fee increases using the above example total $408.80 or
7.5%. The majority of fees (sewer and water connection
fees) which constitute the majority of the total cost would
remain unchanged. Fee schedule increases would apply
only to the Building Permit and Plan Review Fees.
ALTERNATIVES:
The alternatives are as follows:
1. Amend Section 4-1 of the Prior Lake City Code as
attached, adopting the new Minnesota State Building
Code.
2. Continue the discussion.
3. Deny the amendments.
RECOMMENDATION: Staff recommends Alternative Number 1.

ORDINANCE NO. 95-
AN ORDINANCE AMENDING TITLE 4 OF THE PRIOR LAKE CITY CODE.
The City Council of tile City of Prior Lake does hereby ordain:
I.
Sections 4-1-1, 4-1-2 and 4-1-3 of Title 4, Chapter 1, of the Prior Lake City Code are
hereby amended in their entirety to read as follows:
4-1-1: BUILDING CODE: Thc Minnesota State Building Code (Code), established
pursuant to Minnesota Statutes sections 16B.59 through 16B.75, and as may
hereafter be amended from time to time, three (3) copies of which arc on file in the office of
the Prior Lake Building Inspection Department, is hereby adopted as the Building Code for
the City of Prior Lake, Such Code and such future amendments are hereby incorporated in
this Chapter as completely as if set out in full.

Section 109.1 of thc 1994 Uniform Building Code (UBC) is hereby adopted, as
amended below:

Use and Occupancy. No building or structure shall be used or occupied, and
no change in the existing occupancy classification of a building or structure or
portion thereof shall be made until the Building Official has issued a certificate
of occupancy therefor as provided herein.
EXCEPTION: Group U Occupancies
Issuance of a certificate of occupancy shall not be construed as an approval of
a violation of the provisions of the UBC or of other ordinances of the City of
Prior Lake. Certificates presuming to give authority to violate or cancel (he
provisions of the UBC or other ordinances of the City of Prior Lake shall not
be valid.

4-1-2:
(A)
All new construction jn thc I-2 Light Industrial Zoning District shall be exempt from
the provisions of subsection 4-1-1(C)1.
Any person applying for a building permit which may require removal or disturbance
from the natural surface or' the earth or sod, soil, sand, gravel, stone or other matter,
shall submit an erosion control plan as outlined in the 1989 edition of "Protecting
Water Quality in Urban Areas," published by the Minnesota Pollution Control
Agency, or an equivalent set of standards. No pe,,-'rnit shall be issued until the erosion
comrol plan is approved by the City Engineer.
APPLICATION, ADMINIST~TION AND ENFORCEMENT:
The application, administration and eoforcement of the Code shall be in accordance
with Minnesota rule' pan 1300.2100 and as modified by chapter 1305. The Code
shall be enforced within the extraterritorial limits permitted by Minnesota Statute
16B.62, subdivision 1.
(B)
The Prior Lake Building Inspection Department shall be the Building Code
Department of the City. A Minnesota certified "Building Official" will administer thc
Code.
4-1-3:
PERMITS AND FEES:
(A)
The isguance of permits and the collection of fees shall be as authorized in Minnesota
Statute 16B.62, subdivision 1, and as provided for in chapter 1 of the Code and
Minnesota roles parts 1305.0106 and 130:5.0107.

Permit fees shall bc assessed for work governed by this Code in accordance with
Table No(s). lA of this Ordinance. In addition, a surcharge fee shall be collected on
all permits issued for work governed by this Code in accordance with Minnesota
Statute 16B.70.
II.
Section 4-1-5 of Title 4, Chapter 1, of the Prior Lake City Code is hereby deleted in
its entirety and the current sections 4-1-6 and 4-1-7 shall be renumbered as 4-1-5 and 4-1-6,
respectively.
This ordinance shall become effective from and after its passage and publication.
