AprilFest ia an annual event for families of the entire community and a main fundraiser for St. Michael's Church. They have already applied for a liquor and gambling license (to be considered). St. Michael's is requesting that the $200.00 Outdoor Concert permit fee be waived as they are a non-profit organization. Attached is proof of their non profit status. Also attached is the $225.00 clean up deposit which is refundable if no mess is left for the City of Prior Lake maintenance department. The dance will be held in an enclosed area (tent) and any debris from the dance will also be contained in the enclosed area. . . Approve the waiver of Outdoor Concert fee in the amount of $2oo.oo. Deny fee waiver request. Staff recommends Council approve the fee waiver 'for St. Michael's AprilFest upon approval by City Manager Frank Boyles of the Outdoor Concert permit. A motion as part of the consent agenda to approve the waiver of the Outdoor Concert permit fee for St. Michael's Church for the period of April 29 and April 30, 1995. On Thursday 03-09-95 I was assigned the Outdoor Concert application submitted by Cynthia Geis on behalf of St. Michael's Church. The application as submitted requests an Outdoor Concert permit be issued for Saturday, April 29th. 1995, starting at 1830 or 1900 Hrs. / 6=30 or 7=00 P.M. and ending at 2300 Hrs. / 11:00 P.M. The music will be supplied by a DJ, Todd Michael Hertaus 01-09-65 of 17395 Sunset Tr. 8.W. Prior Lake, MN 55372 phone: 440-3529 who calls himself, Crazy Todd when performing. The event is an annual fundraiser for the church called ,APRILFEST, for families in the community. On 03-13-95, I called Cynthia Geis. During the phone conversation with Gels, she told me the following: The event, APRILFEST, is scheduled for the 29th and 30th of April, Saturday and Sunday. Crazy Todd will only be playing Saturday night between 6=30 pm and 11=00 pm. - The music will be contained within the tent. There is a beer garden within the tent which is monitored by adults. Anyone requesting to purchase 3.2 beer will pay a nominal fee and will be checked for I.D. at the beer garden. The dance is usually made up of approximately 50 people, parishioners who come with their younger children. There are not usually teenagers at the dance. - The parishioners will know about the event and the event is open to the public as a fundraiser but will not be publicized in any other ways. There will be pop available in the beer tent for younger children. The beer garden is in one corner of the tent and is monitored closely. I asked Gels about the diagram she had submitted. There is a neighbor to the west of the.tent less than 25 feet away and asked her what provisions they have made to eliminate the sound disrupting that family. Gels told me~ Every year that this event been ongoing, they go to the neighbors door, tell them when the music will be played and invite them to attend. She doesn,t believe there has been a problem doing this in the past. Geis told me the city of Prior Lake closes off the street (Pleasant between the church and the school parking lot and no access is allowed onto that road during the event). This allows for people to park in the church parking l°t and come to the area of the school. I have placed a phone call to Todd Hertaus requesting he contact me about the street dance, however, in the application the decibel level has already been addressed at 68 DB's and Hertaus has dealt with the city of Prior Lake on a number of outdoor concerts. He is aware of the ordinance and that he is the one held responsible in the event of violations. Gels told me the dance allows the workers at the festival to relax after a busy day and visit with other people from the parish and and surrounding communities and is not aimed at raising money and is there for the benefit of the people assisting with the event for the most part. Gels explained to me she and her husband, the current chairs of the event, are assisted by last year,s chairs, Dave and Cheryl Siehndel, and other members of the event. The city of Prior Lake approved an outdoor concert permit for the church last year. The event was held April 30th, 1994, from pm to 11:00 pm. According to the diagram the situation is set up similarly. In checking our records, there is no indication of complaints against the church or because of the festival.
