Prior Lake, MN 55372-1714 MEETING DATE: AGENDA #: PREPARED BY: AGENDA ITEM: DISCUSSION: ALTERNATIVES: MAY 16, 2005 5G JANE KANSIER~ PLANNING DIRECTOR CONSIDER APPROVAL OF A RESOLUTION INITIATING THE REZONING OF THE NEW CITY HALL SITE FROM THE R-2 DISTRICT TO THE C-3 DISTRICT Histo~.: The Prior Lake City Council recently approved a site for a new City Hall, located on the north side of Dakota Street, west of Erie Avenue. The City is in the process of purchasing each of the properties. Current Circumstances: The new City Hall site is currently zoned R- 2 (Low to Medium Density Residential). The property has been identified as C-TC (Town Center) on the 2030 Comprehensive Land Use Plan, recently approved by the City Council. The Issues: In order to construct the new City Hall on the proposed site, with the set proposed setbacks, the property must be rezoned. Section 1108.501 of the Zoning Ordinance states "the City Council may on its own motion initiate amendments by referring them to the Planning Commission for review." A motion to initiate the vacation will refer this matter to the Planning Commission and allow the staff to schedule a public hearing. In addition, this action will eliminate the need for the property owners to file a petition and pay the application fee. Conclusion: The staff recommends the City Council initiate the rezoning from the R-2 to the C-3 district. Any issues will be identified during the review process. The City Council has three alternatives: 1. Adopt a Resolution initiating the rezoning of the property to the C-3 district. 2. Deny this Resolution. 3. Prior Lake, MN 55372-1714 RESOLUTION 05-XX RESOLUTION INITIATING THE REZONING OF PROPERTY LOCATED AT 4600 THROUGH 4626 DAKOTA STREET FROM R-2 TO C-3 BY: SECOND BY: WHEREAS, WHEREAS, WHEREAS, WHEREAS, The City of Prior Lake is in the process of purchasing the properties located at 4600 through 4626 Dakota Street for the purpose of constructing a new City Hall; and In 2005, the City Council approved the 2030 Comprehensive Plan Land designating this property for C-TC (Town Center) uses; and The City of Prior Lake wishes to make some improvements to this property; and In order to determine whether the rezoning is or is not in the public interest, the City Council has initiated the rezoning process by motion. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF PRIOR LAKE, that: 1. The above recitals are herein fully incorporated herein as set forth above. 2. Pursuant to Section 1108.501 of the City of Prior Lake Zoning Ordinance, the process for the rezoning of the properties located at 4600 through 4626 Dakota Street, is hereby initiated Passed and adopted this 16th day of May, 2005.
