History State statute allows non-profit organizations to apply for temporary liquor licenses as a means to raise funds for their organizations. Temporary licenses may be is- sued for up to four consecutive days. The City may not issue more than three (3) four-day temporary license, four (4) three day licenses, six (6) two day licenses, or twelve (12) one day license, in any combination not to exceed 23 days per year to any one organization or for any one location. No more than one temporary license may be issued to any one organization or for any one location within any 30-day period, unless the licenses are issued in connection with an official community event. Current Circumstances The Prior Lake VFW, Village Liquor and several other businesses in Prior Lake are planning a fund raising event to benefit the CAP Agency. This is an annual event held in the South Lake Village Mall. This fund raising event will be held on Thurs- day, November 5, 2015, and will include a wine tasting. The Prior Lake VFW cur- rently holds a Club Liquor License which allows them to sell intoxicating liquor on the premises of their club at 16306 Main Avenue SE. The Prior Lake VFW is re- quired by state statute to apply for a temporary on-sale intoxicating license for this event because it is not being held on the premises for which they are licensed. Conclusion The Prior Lake Police Department has completed an investigation of this applicant to ensure that all requirements and issues concerning public safety and compli- ance have been met. The Prior Lake VFW has provided proof of liquor liability in- surance for this event. FINANCIAL IM- The Prior Lake VFW has paid a license fee of$75.00 for this event. PACT: ALTERNATIVES: 1. Approve the resolution authorizing approval of a temporary on-sale intoxicating liquor license for the Prior Lake VFW as part of the consent agenda. 2. Deny the license request. MOTION: 2 04 �V 4646 Dakota Street SE 4iivrvsso` l" Prior Lake,MN 55372 RESOLUTION 15-xxx A RESOLUTION APPROVING A TEMPORARY INTOXICATING LIQUOR LICENSE FOR THE PRIOR LAKE VFW Motion By: Second By: WHEREAS, The Prior Lake VFW is participating in a wine tasting event to benefit the CAP Agency on Thursday, November 5, 2015; and WHEREAS, State statute allows non-profit organizations to apply for temporary on-sale intoxicating liquor licenses as a means to raise funds for their organizations; and WHEREAS, The Prior Lake VFW is planning to sell wine at this wine tasting fund raising event; and WHEREAS, The Prior Lake Police Department is required to complete a background check on all liquor license applicants. NOW THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF PRIOR LAKE, MINNESOTA as follows: 1. The recitals set forth above are incorporated herein. 2. This license shall be valid on November 5, 2015. 3. All liquor servers shall receive training prior to the event. 4. The Prior Lake VFW shall provide proof of liquor liability insurance as prescribed by M.S. Section 340A.409 to cover this event. PASSED AND ADOPTED THIS 26th DAY OF OCTOBER 2015.
