DISCUSSION: Introduction The purpose of this agenda item is to hold the Assessment Hearing related to the Highland, Marsh, Skyline, Grainwood and Eau Claire Improvement Project. The purpose of the hearing is to give property owners an opportunity to express concerns about the actual special assessment. At the assessment hearing the council shall hear and consider all objections to the proposed assessment, whether presented orally or in writing. The Council may also consider a resolution adopting the assessments. History Each year the City reconstructs street segments that are scheduled for reconstruction as part of its Capital Improvement Program (CIP) and have exceeded their useful design life. The City uses the Capital Improvement Program and its Pavement Management Program to plan for infrastructure improvements and the financing for capital improvements. One of the components of funding the project is the use of special assessments. The Minnesota Statute 429 defines a process that must be adhered to when using special assessments or bond proceeds. Various project approvals have taken place in accordance to the 429 process. At the March 9, 2015 Council meeting, the Council awarded bids for the improvement project. Project TRN15-000004 includes sanitary sewer, water main, storm sewer and street reconstruction. The City executed a contract with Chard Tiling to construct the project and the project is underway and nearing substantial completion. At its regular meeting of September 14, 2015 the Council approved Resolution 15-151, which declared the cost to be assessed, ordered the preparation of the assessment roll and established the date of the Assessment Hearing as October 26, 2015. Phone 952.447.9800 / Fax 952.447.4245/www.cityofpriorlake.com The Assessment Review Work Group met on September 3, 2015 to review the 2015 project as well as the assessment method, and the proposed assessments. The recommendations in this report are those of the assessment review work group. Current Circumstances All benefitting property owners have been mailed a Statement of Special Assessments, which included information pertinent to their property such as the total proposed assessment amount and the assessment rate. The Notice of the Special Assessment Hearing was published in the newspaper on October 10, 2015, and October 17, 2015. Under State Statute, the City may only assess a property up the amount the property is specially benefitted by the public improvement. Special benefit is defined as the difference between fair market value before and after the project. The property owners who believe that the proposed assessment exceeds the special benefit have a right to appeal their assessments in District Court. In order to perfect their right to appeal the assessment a property owner must submit their written and signed objections to the proposed assessment to the City Manager prior to the Assessment Hearing or present it to the City Council at the Assessment Hearing. Within 30 days of the Assessment Hearing, the property owner must also file the appeal in District Court. No appeals were received at the time this report was prepared. Conclusion The Council should open the public hearing at the time set forth in the notice, receive public input and then close the public hearing. If certain issues need additional study, those issues could be referred to the Assessment Review Work Group for evaluation and recommendation; otherwise, it would be appropriate to approve the attached resolution. Statute requires that special assessments be certified to the County by November 30th. Since property owners must be allowed 30 days to pay off their assessments interest free, the assessment roll must be adopted prior to November 1, 2015. ISSUES: The Assessment Policy states that interest rates charged should be 2% over the bonding rate. The current bonding rate is at 2.44% which would put the interest rate charge for the project at 4.44%. The City tries to employ strategies to keep the overall costs and assessments low. These strategies include reduced street widths on this project and minimizing the construction limits. The project also utilized onsite materials when possible to provide a cost savings. The assessment calculation has been computed in a manner consistent with the latest calculation methods and the Assessment Policy. Assessment amounts include 40% of the eligible street and stormwater 2 system costs including project support for these items. The cost is divided by the total number of units. This project was divided into three areas for the purposes of assessments. The West Side includes Highland, Marsh and Skyline, the East side includes Grainwood and Eau Claire. A portion of Eau Claire was rehabilitated which was not assessed in accordance to the Assessment Policy and past practice. A map showing the three areas is attached. FINANCIAL The Credit River Road Improvement Project is proposed to be financed by IMPACT: Special Assessments, tax levy, Street Oversize Fund, Sewer Fund, Water Fund, and Trunk Sewer Fund. The project costs are shown in the attached table with a total assessment amount of$928,605.93. The Council approved the issuance of general obligation street improvement bonds and initial transfers from the Water Fund and Sewer Fund in the spring of 2015 for this project. The interest rate for this project is proposed at 4.4%. A final project reconciliation will be prepared when the project is completed. The anticipated completion date is Fall 2016 after the final lift of asphalt is completed. ALTERNATIVES: 1. Unless new information to the contrary is offered at the public hearing, approve a resolution adopting the assessment roll as submitted for 2015 Improvement Project#TRN15-000004. 2. MOTION: 3 i Pro( 60, 4646 Dakota Street SE 4rilvxEsolP Prior Lake, MN 55372 RESOLUTION 15-xxx A RESOLUTION ADOPTING ASSESSMENTS FOR THE 2015 IMPROVEMENT PROJECT, CITY PROJECT#TRN15-000004 STREET IMPROVEMENTS Motion By: Second By: WHEREAS, Pursuant to proper notice duly given as required by law, the Council has met and heard and passed upon all objections to the proposed assessments for the 2015 Street Improvement Project, City Project#TRN15-000004 NOW THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF PRIOR LAKE, MINNESOTA as follows: 1. The recitals set forth above are incorporated herein. 2. The proposed assessment for the 2015 Street Improvement Project, City Project#TRN15-000004, a copy of which is attached hereto and made part hereof, is hereby accepted and shall constitute the special assessment against the lands named therein, and each tract of land therein included is hereby found to be benefitted by the proposed improvement in the amount of the assessment levied against it. 3. The assessment shall be payable on an equal principal method extending over a period of ten (10) years for street and storm improvements, the first of the installments to be payable on or before the first Monday in January 2016, and shall bear interest at the rate of four and forty-four hundredths (4.44) percent per annum from the date of the adoption of this assessment resolution. To the first installment of each assessment shall be added interest on the entire assessment from September 14, 2015 until December 31 of the year in which the first installment is payable, and to each subsequent installment shall be added interest for one year on all unpaid installments. 4. The owner of any property so assessed may, at any time prior to certification of the assessment to the County Auditor, pay the whole of the assessment on such property, with interest accrued to the date of the payment, except that no interest will be charged if the entire assessment is paid within thirty (30) days, and he/she may, at any time thereafter, pay to the city treasurer the entire amount of the assessment remaining unpaid, with interest accrued to December 31 of the year in which such payment is made. Such payment must be made before November 15 or interest will be charged through December 31 of the next succeeding year. 5. The Finance Director shall forthwith transmit a certified duplicate of this assessment to the County Auditor to be extended on the property tax lists of Scott County. Please find enclosed a Public Hearing Notice and the Proposed Assessment for your property related to Street Improvement Project#TRN15-000004. The terms of payment are detailed in the notice and a sample payment schedule is included should you choose to allow the assessment to be certified to the tax roll. The Council may consider adoption of the assessments at the October 26th, 2015 meeting. A Final Notice will be sent once the assessments are adopted. Upon adoption you will have three Payment options. 1. Payment in Full- If the assessment is paid in full within 30 days after adoption, interest will not be applied to the payment. Any amount remaining after 30 days will have interest applied to it accrued from the date of Council adoption. 2. Payment Prior to Certification —You may pay all or a portion of the assessment prior to certification to the County on Nov. 15. Any remaining amount will be certified to the County. 3. County Certification —You may roll the assessment to the County to be payable in installments with your property taxes. Please see the attached sample payment schedule showing the projected annual payments. Adoption by the council of the proposed assessment against abutting property may occur at the hearing. The amount to be specially assessed against your particular lot, piece, or parcel of land is shown in the attachment to this notice. No appeal to district court may be taken as to the amount of an assessment unless a written objection signed by the affected property owner is filed with the municipal clerk prior to the assessment hearing or presented to the presiding officer at the hearing.The council may upon such notice consider any objection to the amount of a proposed individual assessment at an adjourned meeting upon such further notice to the affected property owners as it deems advisable. Under Minn. Stat. §§435.193 to 435.195 and City Code, Section 111, the council may, in its discretion, defer the payment of this special assessment for any homestead property owned by a person 65 years of age or older, one retired by virtue of a permanent and total disability,or a member of the National Guard or other reserves ordered to active military service for whom it would be a hardship to make the payments.When deferment of the special assessment has been granted and is terminated for any reason provided in that law and Ordinance(Resolution),all amounts accumulated plus applicable interest become due. Any assessed property owner meeting the requirements of this law and City Code Section 111, may, within 30 days of the confirmation of the assessment, apply to the city clerk for the prescribed form for such deferral of payment of this special assessment on his/her property. An owner may appeal an assessment to district court pursuant to Minn. Stat. §429.081 by serving notice of the appeal upon the mayor or clerk of the city within 30 days after the adoption of the assessment and filing such notice with the district court within ten days after service upon the Mayor or City Manager.
