APPROVING THE VACATION OF A PUBLIC EASEMENT AT 16720

DISCUSSION: Introduction
The purpose of this agenda item is to consider vacating a drainage and
utility easement. Vitaliy Tereshkov has requested the vacation of a
drainage and utility easement located within property owned by him and
located at 16720 Welcome Avenue (PID 25-901-008-6).
History
In the 1960s, an easement was granted for the purpose of maintaining a
storm water utility line for the surrounding area around Welcome Avenue.
Since then, storm water has been redirected with recent City street and
utility projects, and the storm water line is no longer in operation or
necessary.
Current Circumstances
The applicant has commenced construction upon the property for an
industrial building. The subject easement lies across the property and upon
inspection by the City Public Works Department, the old storm water utility
line within the easement is no longer in operation. Any future operation of a
public utility line within the easement is not planned. The utility line crosses
the center of the property, thereby significantly impacting the buildable area
of the site. For property title purposes the vacation of the easement is
requested.
As required by State Statute 462.358 Subd.7, the City Council is required to
review the disposal or acquisition of public lands as it relates to compliance
with the Comprehensive Plan.
Upon proper notification, State Statute 462.358 allows the Council to
vacate easements by resolution following a public hearing. The statute
also states "no such vacation shall be made unless it appears to be in the
public interest to do so."

The public easement is no longer necessary for public utility purposes and
therefore, unless new information is disclosed from the public hearing, City
Staff recommends approval of the easement vacation request.
ISSUES: Following the public hearing, the City Council must make two
determinations. Does the vacation of the existing easement comply with the
Comprehensive Plan and is there a public need or anticipated future need
for the dedicated property?
Comprehensive Plan Review
The Comprehensive Plan does not specifically discuss utility easements,
other than as a function of ensuring access to public utilities. The vacation
of this easement is not inconsistent with any specific goal or objective of the
Comprehensive Plan.
Public Need
Upon inspection by the City, a public need is unnecessary for the utility
easement at this time or planned for the future.
FINANCIAL There is no financial impact involved with the vacation of the public
IMPACT: easement.
ALTERNATIVES: 1. Conduct the public hearing and unless significantly new information to
the contrary is revealed, approve the proposed vacation by adopting the
attached resolution.
2. Continue the discussion to a date and time certain to allow the staff to
provide additional information specifically requested by City Council.
3. Based upon expressed findings of fact, deny part or all of the application
based upon inconsistency of the proposal with specific regulations of
Zoning and Subdivision Ordinances and/or specific policies of the
Comprehensive Plan.

RESOLUTION APPROVING THE VACATION OF A PUBLIC DRAINAGE AND UTILITY EASEMENT AT 16720
WELCOME AVENUE SE
MOTION BY: SECOND BY:
WHEREAS, Vitaliy Tareshkov, owner of subject property, has submitted a petition for the vacation of
drainage and utility easement located at 16720 Welcome Avenue SE. The petition has been
duly presented to the City of Prior Lake,signed by the owners of the property situated in the City
of Prior Lake, Scott County, Minnesota to wit:
Legal Description (Drainage and Utility Easement):
20 foot drainage and utility easement across Part of Section 1, Township 114, Range 22, Scott
County Minnesota.

WHEREAS, Notice of the hearing has been duly published and posted in accordance with the applicable
Minnesota Statutes; and
WHEREAS, A Public Hearing was held on said petition on Monday, October 26, 2015, in the Council
Chambers at City Hall, 4646 Dakota Street SE; and
WHEREAS, The City Council then proceeded to hear all persons interested in said petition and persons
interested were afforded the opportunity to present their views and objections to the granting of
said petition; and
WHEREAS, The portion of drainage and utility easement requested for vacation is not necessary to provide
drainage or utility service to the property or adjacent properties, and therefore, no longer serves
a public purpose.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF PRIOR LAKE, that:
1. The above recitals are herein fully incorporated herein as set forth above.
2. The City Council of Prior Lake has determined that the vacation of said easements would be in the public interest.

3. Pursuant to Minnesota Statues 462.358,the following described drainage and utility easement is hereby vacated:
