Call to Order and Pledge of Allegiance: Commissioner Larson called the Monday, November 2, 2015 Prior Lake Planning Commission meeting to order at 6:00 p.m. Those present were Commissioners Bryan Fleming, William Kallberg, Wade Larson, Mark Petersen and Dave Tieman; City Planner Jeff Matzke and Development Service Assistant Sandra Woods. 2. Approval of Agenda: MOTION BY PETERSEN, SECONDED BY FLEMING TO APPROVE THE MONDAY, NOVMEBER 2, 2015 PRIOR LAKE PLANNING COMMISSION AGENDA. VOTE: Ayes by Fleming, Kallberg, Larson, Petersen and Tieman. The Motion carried. 3. Election of Officers Petersen nominated Brian Fleming for Chair, seconded by Larson. LARSON ASKED FOR A VOTE ON BRIAN FLEMING AS CHAIRMAN. VOTE: Ayes by Fleming, Kallberg, Larson, Petersen and Tieman. The Motion carried. Fleming nominated Wade Larson for Vice Chair, seconded by Petersen. LARSON ASKED FOR A VOTE ON WADE LARSON AS VICE CHAIR. VOTE: Ayes by Fleming, Kallberg, Larson, Petersen and Tieman. The Motion carried. 4. Approval of Monday, October 5, 2015 Meeting Minutes: MOTION BY PETERSEN, SECONDED BY LARSON TO TABLE THE MONDAY, OCTOBER 5, 2015 PRIOR LAKE PLANNING COMMISSION MEETING MINUTES. VOTE: Ayes by Fleming, Larson, Petersen and Tieman. The Motion carried. Absent by Kallberg. 5. Public Hearings: A. DEV15-001023 – 14539 Pine Road - Variance – Chad and Kimberly Clauson are requesting a variance from the front and side yard setback to add a second floor to their home at 14539 Pine Road located in the (R1SD) Low Density Residential Shoreland Zoning District. PID: 25-040-007-0. Planner Matzke introduced a request to consider approval of a variance from the minimum Front Yard and Side Yard Setbacks for a property in the (R1-SD) Low Density Residential Shoreland District. He 2 explained the history, current circumstances, issues, alternatives and recommendations. He provided a Resolution, location map, street photo of property and existing survey and 2nd story floor plan. Commission Comments/Questions: Kallberg asked for verification that the current owners are not the original owners. Chad and Kimberly Clauson replied correct, they are not the original owners. MOTION BY PETERSEN, SECONDED BY KALLBERG TO OPEN THE PUBLIC HEARING AT 6:14P.M. VOTE: Ayes by Fleming, Kallberg, Larson, Petersen and Tieman. The Motion carried. Public Comment: Kimberly Clauson, (4290 Grainwood Circle NE). She stated she is here tonight with her husband. She said they purchased the property at 14539 Pine Road at the end of July and felt it was an opportunity to have lake shore property that was affordable to them. She explained their current living situation, pointing out the reasons for needing expansion on their new home. Petersen asked if it is lakeshore access at the dead end road. Clauson said it is deeded only to the neighborhood residences; about 7 houses and it is privately policed. Barbara Napiwocki, (5281 Shore Trail NE). She stated her house is directly behind the applicant’s. She described the neighborhood and shared concerns of losing the neighborhood feel due to larger homes. Petersen addressed Napiwocki concerns, stated they are not changing the footprint; however they do understand the large house sydrome. Kallberg stated the prior owners built to close to the propert y lines; and this is not the current owners fault. He said additional living area would be good and explained roof line in comparison with neighboring houses. He said this variance makes sense. Fleming asked Planner Matzke if there is a sense of how many homes on Pine road that have approached the city in the last 3 years on expansion. Planner Matzke replied as far as variance requests go, he has not seen any in recent years; however there have been building additions along Pine and Shore Trail. He said there is a mixture of homes in this area and explained how they were platted in the 1950’s. Fleming echoed Commissioners Petersen and Kallberg comments of sensitivity of obtaining within reason the respect of property rights and City Zoning Ordinances maintaining the character of neighborhoods. MOTION BY PETERSEN, SECONDED BY KALLBERG TO CLOSE THE PUBLIC HEARING AT 6:24P.M. VOTE: Ayes by Fleming, Kallberg, Larson, Petersen and Tieman. The Motion carried. Commission Comments/Questions: 3 Petersen stated whether there is a natural hardship or change of character of the neighborhood; this is a reasonable request to build upwards, and is in support of this variance. Tieman stated the overall size of the impervious material is not increasing and is still within the height request, therefore he will be supporting this request. Larson echo’s sediments of fellow Commissioners; the same footprint being added onto rather than expanding the building out. He is in favor of this variance. Fleming stated he is in support of this variance; there are practical difficulties in complying with the Ordinance. The granting of the variance would be in harmony with the intent of the City Subdivision, Zoning Ordinance and the Comprehensive Plan. MOTION BY PETERSEN, SECONDED BY KALLBERG, APPROVE THE RESOLUTION APPROVING THE REQUESTED MINIMUM FRONT YARD AND SIDE SETBACKS. VOTE: Ayes by Fleming, Kallberg, Larson, Petersen and Tieman. The Motion carried. 6. Old Business: No Old Business. 7. New Business: Review the Application of New Architectural Design Standards in the General Industrial District. Planner Matzke introduced a recommendation to amend subsection 1107.2200, Architectural Design, prior Lake Zoning Ordinance. He explained the history, current circumstances, issues, alternatives and recommendations. He provided Subsection 1107.2200 amendments (amended version), Subsection 1107.2200 amendments (clean version), architectural standards for Hastings, Faribault and Owatonna and Building design example pictures. He closed with reasons of why this is being reviewed and explained this is for feedback only. Commission Comments/Questions: Fleming said one of the pivots of rational was to provide consistency/conformity and also to promote higher quality materials. He said the ordinance is in its infancy and would be reluctant to entertain variations or amendments at this time; for future conversation he asked about the cost differential. He explained promoting business versus precluding businesses into our Community. Planner Matzke mentioned this was not alone about costs; and explained taxable value. He mentioned a couple comparisons of vacant land market value and long term value of materials. Larson asked if a particular parcel was in ownership. Planner Matzke said it is owned by a developer; it is an Outlot and vacant land. Petersen asked what happened to the gable roofs. Planner Matzke explained the ordinance and changes to it; with gable roofs being one of the factors involved. He mentioned the materials and conforming to surrounding properties. 4 Petersen said the industrial areas would fill up quick with the allowance of pole buildings; however doesn’t see this as a good thing. He felt having variations in an industrial park would be desired. He questioned if a conditional use permit was acquired then a pole building can be built in this area. Planner Matzke replied yes, as long as it meets the criteria of the ordinance; he explained the criteria. Petersen said that pole barns would not hold their value and he would not recommend this. Tieman said there is a wide variation in pole buildings and stated if we open up for anything; we will get a variation that is not compatible. He said the correct approach, is to address the commission for interest in a pole building. Kallberg agreed there is a conflict between wanting to build pole buildings in an industrial park, but not require materials that would be at such a cost that it will discriminate potential developers. He asked about distinction between structures. Planner Matzke explained the distinction is between pole barn classifications. He explained the current ordinance on pole buildings construction. Larson said he would be in favor of cement precast buildings in this development. He asked for more input of the different structures, life expectancy of different types of buildings and tax base allotment. 8.
