HomeMy WebLinkAbout6B - Board Of Review AGENDA #: PREPARED BY: SUBJECT: DATE: BACKGROUND: DISCUSSION: ISSUES: RECOMMENDATION: AGNREV.WRT STAFF AGENDA REPORT 68 FRANK BOYLES, CITY MANAGER 1995 BOARD OF REVIEW MAY 1,1995 Under Minnesota statutes the City Council acts as the Board of Review each year to consider resident concerns about the valuation which is placed on their property by the County Assessor as of January 2. This evening, the Council will be acting as Board of Review for this purpose. County Assessor, Leroy Arnoldi, has conducted assessments of properties within the City of Prior Lake in accordance with state statute. As a result of his work he has prepared the attached memorandum to local boards of review which summarizes his findings. The Council, acting as the Board of Review, should listen to questions and concerns raised by residents about the value which has been placed upon their property as of January 2, 1995. Mr. Arnoldi will attempt to immediately respond to questions which do not require significant additional research. In some cases it may be necessary for Mr. Arnoldi to research the question and return to the Council when the Board of Review is reopened on May 15. The local Board of Review is the first of numerous opportunities afforded to taxpayers to appeal the value of their property as of January 2, 1995. In order to proceed to the next step, the property owner must perfect their appeal at the previous step. To perfect the appeal, the person must send a letter documenting their concerns or address their concerns in person to their local Board of Review. The only issue in question is whether or not the valuation of the property is accurate when compared with other like properties as of January 2, 1995. The amount of property taxes is a separate matter which is considered as part of the budget hearing and truth in taxation process. The Council should provide Mr. Arnoldi the opportunity to make a presentation with respect to assessment trends this year. The public should then be allowed to present their concerns with respect to this year's valuation. Questions which cannot be answered this evening should be referred to Mr. Arnoldi for further research. A report will be presented to the City Council prior to reopening the hearing on May 15 if necessary. Prior Lake, MN 55372 Re: Property Identification, Harbor 4th Addn, Lot-014, Block-OOI, Resident, Non-Homestead I am the co-owner of the above mentioned property, which is a garage located adjacent to 6560 Harbor View, Prior Lake, Minnesota. There are five comparable garages, side by side, standing under a town home. The garages are owned in addition to garages attached to the individual townhomes. The most recent selling price of garages identical to my garage in question is approximately $6,000.00. To my knowledge, no garage has ever sold for the estimated market value of $8,900.00. I therefore request that the estimated market value on my garage be $6,000.00 rather than the $8,900.00 previously submitted. MAY 1,1995 INTRODUCTION: The purpose of this Agenda item is to approve right- of-way for Plat No. 1 and to provide a plat which shows the parcels acquired for Project 82-3, North Shore and simplify future legal descriptions BACKGROUND: State statute 505.1791 requires that a plat recorded for the purpose of defining right of way be signed by the mayor or chair of the governing body involved. This plat will simplify the description of the right-of- ways created as a result of project 82-3, North Shore. Ten easements were required from private property owners for project 82-3 to construct Beach Street, which was completed in 1986. Right-of-way acquisition also included the condemnation of a shared private road. As many of the property owners owned the property north of this road, a request to move the alignment of Beach Street to the north was honored by the city. This realignment created two remnant parcels, located between the north edge of the private road and Beach Street. The property owners stated that they wanted to acquire the remaining portions of the private road which was not acquired for the public road. See attached map. In 1991, the city and residents representative, Roy Stromme, agreed to replat by means of a highway plat. This method, commonly used by counties but not by cities, greatly simplifies the right of way location by combining all the individual right-of-ways on one plat. The City had Valley Surveying complete the plat but did not file the plat as the property owners had not completed the torrencing of the property. By approving the plat, there is no change in the easements which were acquired, it simply shows all the parcels on one map and makes future legal descriptions more clear. This plat matches the Knob Hill plat. Roy Stromme submitted a bill of $847.50 for updating the abstract for the torrens action. Larry Anderson denied the claim as this was not part of the agreement. The City was to provide the right-of-way plat and the property owners torrens the properties. Resolution 95-28 is included for approval of the plat. The alternatives are as follows: 1. Approve Resolution 95-28 as recommended. 2. Table this item for a specific reason. 3. Deny this Agenda item for a specific reason. Valley Surveying was paid to complete the plat two years ago. There is no budget impact. This resolution has been reviewed and approved by Glenn Kessel, City Attorney and the time for filing is appropriate. I I -......... ------------ RESOLUTION 95-28 RESOLUTION OF THE PRIOR LAKE CITY COUNCIL AUTHORIZING THE RECORDING OF RIGHT-OF-WAY PLAT NO.1 FOR CITY PROJECT NO. 82-3 (BEACH STREET/CHATONKA BEACH TRAIL) MOTION BY SECONDED BY WHEREAS, the City ot Prior Lake acquired certain street right-ot-ways in City Project No. 82-3 (the "Project"), and WHEREAS, the acquisition ot said right-ot-ways involved ten (10) parcels affecting ten (10) separate owners of record at the time of the condemnation proceeding; and WHEREAS, the right-ot-way acquisitions tor the Project affected numerous parcels ot property which were subsequently recorded as separate documents in the Scott County Recorder's Office; and WHEREAS, the City Engineering Department has caused the preparation of a Right-Ot-Way Plat No. 1 which specifically describes and locates the street right-of-ways which were acquired by the City; and WHEREAS, the City Council believes it is in the best interest of all parties and the City that the Right-Of-Way Plat No. 1 be recorded to assist all affected parties in locating specifically the acquired right-of-ways. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF PRIOR LAKE, MINNESOTA, that in accordance with Minn.
