History Cigarette licenses are valid from January 1 to December 31 of each year and are subject to annual renewal. Current Circumstances In 2011 Shakopee Dakota Convenience Store was cited for selling cigarettes to minors. Holiday Station Store #198 on Duluth Avenue failed a compliance check in November 2012 for selling cigarettes to a minor. Prior Lake Shell failed a compliance check in November 2013. In 2014 Prior Lake Shell and Village Liquor were both cited for selling cigarettes to minors. There were no tobacco ordinance violations in 2015. As the city council is aware the city code does set forth a process through which tobacco violations are addressed both for the clerk selling the products and for the place of business. If the city council desires the staff can review these provisions at the council meeting. None of the businesses have experi- enced four violations within a 36 month period which would result in automatic revocation of the tobacco license for a two year period. No other violations have occurred for any of the renewal applicants in the past five years. The police department conducts annual compliance checks for all cigarette licensees. Attached to this agenda report is a list of the businesses requesting renewal of their cigarette licenses. Conclusion The Prior Lake Police Department has completed an investigation of the appli- cants to ensure that all requirements and issues concerning public safety and compliance have been met. All applicants have provided the required docu- mentation for this license. FINANCIAL IMPACT: All nine applicants have paid $250.00 each for their annual license fee bring- ing the total revenue for these licenses to $2,250.00. ALTERNATIVES: 1. Approve the 2016 cigarette license renewals as part of the consent agenda. 2. Remove this agenda item from the consent agenda and deny or re- quest information regarding one or more of the license requests. 2 RECOMMENDED MOTION: Alternative #1.
