HomeMy WebLinkAbout6A - Public Accesses AGENDA: PREPARED BY: SUBJECT: DATE: INTRODUCTION: BACKGROUND: ST AFF AGENDA REPORT 6A LANI LEICHTY, WATER RESOURCES COORDINATOR CONDUCT A PUBLIC INFORMATIONAL MEETING ON PUBLIC ACCESSES: SCENIC OVERLOOK - LOT 3 OF SUNSET SHORE AND TERRACE CIRCLE (NORTH); V ACA TE - LIME ROAD (NORTH AND SOUTH ENDS) AND EIGHTH STREET; REMAIN AS IS - SEVENTH STREET, MONROE AVE. AND KENT STREET INTERSECTION. MAY 15, 1995 The purpose of this public informational hearing is to determine if the City Council desires to classify the above mentioned accesses according to the recommendations of the Lake Advisory Committee. Neighbors within 1,000 feet of each access have been notified and notices placed in the May 6th and 13th issues of the Prior Lake American. The Council has received a petition from residents in the Terrace Circle area. When the Lake Access Study was accepted by the Council at its regular meeting on October 17, 1994, the study made the following recommendations for these accesses: REMAIN AS IS: 1) Seventh Street - North 2) Monroe Ave. & Kent Street intersection VACATE: 3) Lime Road - South 4) Eighth Street - North: vacate a strip of right-of-way on both sides and construct a water quality pond at the storm sewer outlet. 5) Lime Road - North SCENIC OVERLOOK: 6) Lot 3 of Sunset Shore: along with vacating the remaining public waterfront in the Sunset Shore plat. 7) Terrace Circle - North The definitions used in the study are as follows: Remain As Is: City will retain the present use of the parcel and its ownership or easement interests. Vacate: The City would release it's right to use or control property for a designated purpose. Vacate the property after research has been done to ensure no property will be landlocked, and a petition to vacate has been received. 16200 Eagle Creek Ave., Prior Lake, Minnesota 55372-1714 / Ph. No swimming, boat/canoe launching or fishing will be allowed. The boundaries will be dermed with a split rail fence. SEVENTH STREET (NORTH) - This street is platted road right-of-way north of Center Road ending at the lake. There are two existing homes facing Center Road between this right-of-way, they are numbers 2906 and 2940. This street right-of-way will need to be retained to provide for future access to Lots 7 - 11 of Block 24. These lots would not have legal access if Seventh Street were vacated. There is curb opening off of Center Road locating this area in question. Recommendation: Remain as is. MONROE A VENUE AND KENT STREET INTERSECTION - The corner of the intersection is where these two streets meet at the edge of Prior Lake. A gravel path leads down off the road to the shoreline where there is a dock and a boat lift located off of the bank. This right-of-way is needed to maintain the road bed. A survey should be done to determine if the dock and boat lift are located on public property. If they are, they should be removed. Recommendation: Remain as is. LIME ROAD (SOUTH) -This platted road right-of-way has the channel between Spring Lake and Upper Prior Lake running through it. The land south of Spring Lake Road drops off approximately 4 feet to a yard area that has been planted with trees by the adjacent property owners. Recommendation: Vacate the roadway easement and retain drainage easement. EIGHTH STREET (NORTH) - This platted roadway north of Center Road has a storm sewer line running through it outletting at the shoreline of Prior Lake. The property is fully wooded with a mowed trail meandering through the property which is maintained by the adjacent property owner. There are two vacant lots to the east of this area. Recommendation: Vacant a strip of right-of-way on both sides of this roadway easement and consider constructing a water quality pond at the storm sewer outfall. By vacating a strip of land on the east side would make the lot immediately east of Eighth Street a more buildable lot on which a home could be constructed. LIME ROAD (NORTH) - This roadway easement provides an additional access to the Spring Lake Cemetery. The cemetery is located on the east side of platted Lime Road. The area is maintained by the adjacent property owners. Recommendation: Vacate the roadway from 20' north of the curb to the lake. LOT 3 OF SUNSET SHORE - This is a City owned lot which has sanitary sewer, watermain and a storm sewer line running through the property. The storm sewer outlets approximately 10 feet from the waters edge. No parking is available in the near vicinity. A 1 to 2 course retaining wall exists along the lake front which was installed by the Parks department. Several wooden posts and boulders are located on the street side of the property to keep out snowmobilers. The property owner to the south has requested the City to install more posts for the same purpose. The house on the south side is located very close to or on the lot line. Recommendation: Scenic Overlook, which would include a wooden split rail fence on the north and south sides to defme the property boundaries and installing a park bench for viewing of the lake. A survey should be done to determine the location of the house on the south side. Consideration should be given to selling a portion of Lot 3, depending on the survey, to that property owner. The owner to the south has called and is opposed to the idea of the City installing a fence on this property. In the original plat of Sunset Shore the waterfront property was dedicated to public for public use (see map). Approximately half of this waterfront has been vacated by the City. As part of the recommendation for Lot 3 of Sunset Shore, the LAC also advises the City to vacate the remaining waterfront that is dedicated for public use. It will be the responsibility of the land owners to initiate the vacation process for their property. TERRACE CIRCLE (NORTH) - This access extends north off the end of the Terrace Circle cul-de-sac. There is a fire hydrant at the end of the cul-de-sac and a storm sewer line running down the center of the easement outletting at the lake. Side street parking is available on Terrace Circle. The two adjacent property owners mow the property and claim to have improved it by removing chunks of asphalt and concrete. Recommendation: Scenic Overlook, which would include a wooden split fence defining the property boundaries, along with a park bench for viewing the lake. A neighborhood petition has been submitted to the City with 29 properties opposing and 2 properties for the recommendation. ISSUES: The Lake Access Study recommendations were intended to provide the City with a "strategic plan" through which reasonable access would be provided to the lake. The study philosophy was that the City needs to provide reasonable access for non-Iakeshore dwellers while respecting the rights of lakeshore owners. The LAC believes that these recommendations are part of the overall strategy to accomplish this objective. ALTERNATIVES: The alternatives are as follows: 1. Accept the recommendations by the LAC. 2. Accept the recommendations for one or more accesses and recommend changes for the others. 3. Continue the hearing for specific reason. RECOMMENDATION: Staff recommends that each access be discussed individually and that Council adopt alternative number 1. ACTION REQUIRED: Motion and second to adopt the recommendations by the Lake Advisory Committee to classify the following: Remain As Is - Seventh Street, and the Monroe Avenue and Kent Street intersection; Vacate - Lime Road (south), a REVIEWED BY: PIF#3 portion of Eighth Street (north), and Lime Road (north); 3 ~oo:~~(?e ~d r:cle (no~). Scenic Overlook - Lot MINUTES OF THE LAKE ADVISORY COMMITTEE April 19, 1995 I. CALL TO ORDER: The Lake Advisory Committee meeting was called to order on Wednesday, April 19, 1995 at 7:00 p.m. Members present were: Chair Jody Stroh, Marianne Breitbach, Doug Larson, and John Wingard. Others present were Water Resources Coordinator Lani Leichty. Members absent were: Bill Packer and Tom Watkins. II. CONSIDER APPROVAL OF MINUTES OF PREVIOUS MEETING: The first item on the Agenda was to approve the Minutes of the meeting of March 22, 1995. MOTION BY STROH, SECONDED BY BREITBACH TO APPROVE THE MARCH 22, 1995 MINUTES. MOTION CARRIED UNANIMOUSLY. III. DISCUSSION OF THE JOINT CITY COUNCIL/WATERSHED MEETING: The committee discussed the outcome of the joint City Council/Watershed meeting held April 18th. It was decided, so that those who were not present at that meeting, to schedule a tour of the outlet channel on May 3rd, 1995 to see first hand the erosion occurring downstream of the outlet. IV. DISCUSSION OF THE 1995 EURASIAN MILFOIL MANAGEMENT PLAN: Discussion centered on the first step of action to be taken regarding 1995' s treatment of milfoil. Leichty agreed to invite the Chair of the Prior Lake Lake Association to the next LAC meeting to talk about their experience in treating milfoil in Prior Lake. Treatment areas will be determined at the May meeting along with areas to try test plots of plantings and different rates of chemical applications. V. 1996 FIVE YEAR CAPITAL IMPROVEMENT PROGRAM: Leichty presented a draft of the Five Year Capital Improvement Program for 1996 that showed the proposed projects for the next five years to be funded by the Storm Water Utility fund. VI. ADJOURNMENT: THE MEETING ADJOURNED AT 8:10 P.M.
