HomeMy WebLinkAbout7B - Ridgemont Ave/Creekside AGENDA #: PREP ARED BY: SIJBJECT: 7B PAUL BOETTCHER, ACTING ASSISTANT CITY ENGINEER CONSIDER APPROVAL OF RESOLUTION 95-37 APPROVING PLANS AND SPECIFICATIONS AND AUTHORIZING ADVERTISEMENT FOR BIDS FOR THE FOLLOWING COMBINED PRO.JECTS; a) PROJECT 93-01 INDUSTRIAL PARK STORM SEWER b) PROJECT 93-03 TH. 13/MITCHELL POND STORM SEWER c) PROJECT 95-01 RIDGEMONT A VENUE d) PROJECT 95-02 CREEKSIDE CIRCLE DATE: AND APPROVAL OF RESOLUTIONS 95-38, 95-39, 95-40, AND 95-41 DECLARING COSTS TO BE ASSESSED AND SETTING ASSESSMENT HEARING DATES FOR RIDGEMONT AVENUE AND CREEKSIDE CIRCLE MAY 15,1995 INTRODUCTION: The purpose of this Agenda item is to approve plans and specifications, to receive authorization to advertise for bids for Project 93-01, 93-03, 95-01, and 95-02 as noted above, and to set an Assessment Hearing date for Projects 95-01 and 95-02. BACKGROUND: Project 93-01. Industrial Park Storm Sewer, was part of the 1993 Improvement Projects and Resolution 93-16 ordered plans for the improvements. Several options were reviewed and the end result was to construct a storm sewer from the top of the hill with a sediment sump manhole and discharge to the vegetated area near Markley Lake. The property owner has agreed to grant a drainage and utility easement for the storm sewer construction. There is a city disposal area at the top of the hill which the city will clean up in order to construct the pipe. This improvement will prevent further uncontrolled slope erosion. The estimated construction cost is $20,000. In the event that the easement is not acquired this storm sewer area will be deleted from the total project. 16200 Eagle Creek Ave., Prior Lake, Minnesota 55372-1714 / Ph. TH. 13/Mitchell Pond Storm Sewer, was part of the 1993 Improvement Projects and Resolution 93-30 requested MnDOT provide financial assistance for this work. MSA Consulting Engineers has prepared plans and submitted them to MnDOT for cost sharing analysis and approval. This project will correct an eroded area from TH. 13 to Mitchell Pond by the construction of a storm sewer pipe in the ravine and filling over the pipe and restoring the vegetation. The estimated construction cost is $89,000. MnDOT has indicated cost sharing of 31.4%, or $30,353. Project 95-0 1. Rid~emont Avenue, is proposed to be reconstructed from the existing curb and gutter, north 1600 feet to Rutledge Street as shown on Exhibit 2, 3 and 4. Reconstruction to an urban section of a 30 foot width with concrete barrier curb and a sidewalk along the west side is proposed. Sanitary sewer and water will be extended 900 feet to the south limits where no utilities currently exist. This project is a hold-over from the 1994 Capital Improvement Project and will be assessed to the benefiting property owners and included in the 429 Bond issue. Resolution 95-09 ordered preparation of plans for this project. The estimated construction cost is $227,000. The sidewalk will be paid out of the park fund. Project 95-02. Creekside Circle, is proposed to be reconstructed from TH. 13, north 1400 feet to the cul-de-sac as shown on Exhibits 5 and 6. Reconstruction was proposed as a 24 foot wide rural section for the first 1000 feet and then as 24 foot wide urban section the last 400 feet. During the detailed survey and final plan preparation it was determined that curb and gutter would work well along the west side and subsequently the curb and gutter was added to the east side, too, in order to better define the street and to protect the pavement edge. Some additional storm sewer was required near the south end. It is anticipated the reduction in ditch excavation, driveway culverts and restoration area will about offset the cost of the additional curb and gutter. This project is a hold- over from the 1994 Capital Improvement Project and will be assessed to the benefiting property owners and included in the 429 Bond issue. Resolution 95-09 ordered preparation of plans for this project. The estimated construction cost is $120,000. DISCUSSION: These four projects have been grouped together for bidding purposes in order to create a sizable project to obtain competitive bid prices. The combined estimated construction costs total ALTERNATIVES: $447,000. The Mitchell Pond project requires fill material which can be acquired from the Creekside Circle site, also saving money. Under the Cooperative Agreement conditions with MnDOT for Mitchell Pond, the project cannot be advertised until MnDOT has reviewed and approved the plans which is currently underway. MnDOT had indicated award to be required by June 30, 1995, however they have stated funds can be advance encumbered to allow award after June 30, 1995. MnDOT had indicated approval about May 15 which would allow advertisement in the legal paper on May 20 and a bid opening on June 12 and award on June 19, 1995. Construction could then begin about July 5. Waiting for MnDOT approval is potentially worth $30,000 of cost sharing. If MnDOT's approval is after May 15 the ad and bid dates may be pushed back two weeks or more, thus delaying the construction start too. In order to proceed with timely construction in July and August, it is desired to schedule the Assessment Hearing date prior to the receiving of bids. It is recommended that the Ridgemont Avenue assessments be set at 100% of the Public Hearing amounts and that the Creekside Circle assessments be set at 105% of the Public Hearing amounts. If bids are substantially lower than these estimated assessments, the property owners can be re-notified with adjusted rates. Authorizing the Assessment Hearing at this May 15 Council meeting would allow for mailed notices to go out on June 1 for a June 19 meeting. Not moving forward with setting the Assessment Hearing tonight would delay the project by three weeks. The alternatives are as follows: 1. Approve the Resolution approving the plans, authorizing Advertisement for Bids with a bid opening date of June 12, 1995, at 10:00 A.M., and set an Assessment Hearing date of June 19, 1995. All of the above are contingent on MnDOT approval. If MnDOT's approval is delayed, the City Manager and City Engineer would have the authority to advertise and bid one week later, however, the Award and Assessment Hearing could remain on June 19, 1995. 2. Table this item for a specific reason. 3. Deny the project at this time. RECOMMENDATION: The recommendation is to approve a Resolution approving plans and specifications and authorizing advertisement for bids on June 12, 1995, for the combined projects. The recommendation is also to approve Resolutions declaring costs to be assessed and setting an Assessment Hearing date of June 19, 1995. FINANCIAL IMP ACT: Project 93-01 and 93-03 will be paid through Ad Valorem Tax Levy. Projects 95-01 and 95-02 will be paid through Special Assessments, Ad Valorem Tax Levy, and Trunk Reserve. ACTION REQUIRED: Make a motion to approve the Resolutions as recommended. The City Manager shall prepare and cause to be inserted in the official paper and in the Construction Bulletin an advertisement for bids upon the making of such improvement under such approved plans and specifications. The advertisement shall be published not less than 21 days prior to bid opening, shall specify the work to be done, shall state that bids will be opened, and that all bids will be received by the City until 10:00 A.M. on June 12, 1995, at which time they will be publicly opened at City Hall by the City Engineer. 3. The City reserves the right to reject any and all bids for any reason as determined solely by the City. 4. The City Manager shall also have the authority to modify the bid date to June 19, 1995, at 10:00 A.M., if MnDOT approval is delayed and this schedule change remains in accordance with State Statutes. NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY COUNCIL OF PRIOR LAKE, MINNESOTA: 1. The portion of the cost of such improvement is to be paid by the City's Ad Valorem Tax Levy and is hereby declared to be $65 500.00, and the portion of the cost to be assessed against benefited property owners is declared to be $98 200.00. 2. Assessments shall be payable on an equal principal installment method extending over a period of lQ years. The first installment shall be the annual principal plus interest calculated from the public hearing date to the end of this year plus twelve months of the next year and shall bear interest at the rate of a minimum of 8% and not more than 1 % above the net effective interest rate of the bond issuance per annum from the date of the adoption of the assessment resolution. 3. RESOLUTION 93-30 RESOLUTION REQUESTING MINNESOTA DEPARTMENT OF TRANSPORTATION FINANCIAL ASSISTANCE IN THE UPGRADING OF THE STORM SEWER OUTLET FROM T.H. 13 TO MITCHELL POND MOTION BY KEDROWSKI SECONDED BY WHITE WHEREAS, the storm runoff from the T.H. 13 drainage system west of Cand~ Cove Trail runs overland across the rear of propertles adjacent to the highway; and WHEREAS, the volume and velocity of this overland flow causes concerns relative to safety and erosion; and WHEREAS, the City understands T.H. 13 is planned to be upgraded in the future at which time the drainage issues would have to be addressed, and WHEREAS, the City feels that immediate improvements to the drainage system in the area would provide a benefit to the trunk highway system. NOW THEREFORE BE IT RESOLVED BY THE MAYOR AND CITY COUNCIL OF PRIOR LAKE, MINNESOTA, that the Minnesota Department of Transportation financially assist the City of Prior Lake with the upgrading of the T.H. 13 drainage system in the area of Candy Cove Trail. Such improvement is hereby ordered as proposed in the Council Resolution 94-61 adopted December 5, 1994, for such streets and areas in accordance with the report and the assessment of property as described in the report for all or a portion of the cost of the improvement pursuant to Minnesota Statutes Chapter 429 at an estimated total cost of the improvements of $1,297,968.00. 2. The City Engineer and the city's engineering consultant, MSA Consulting Engineers, is hereby designated as the Engineer for this improvement.
