MEETING FOR PUBLIC ACCESSES: SCENIC OVERLOOK - LOT 3
OF SUNSET SHORE AND TERRACE CIRCLE (NORTH); VACATE
- LIME ROAD (NORTH AND SOUTH ENDS) AND EIGHTH
STREET; REMAIN AS IS - SEVENTH STREET, MONROE AVE.
AND KENT STREET INTERSECTION.

The purpose of this agenda item it to continue the public informational
hearing from May 15, 1995 to determine if the City Council desires to
classify the above mentioned accesses according to the
recommendations of the Lake Advisory Committee. A notice was
placed in the June 17th issue of the Prior Lake American regarding this
meeting.
At the regular May 15, 1995 City Council meeting, a public
informational meeting was held to determine the classification of the
above mentioned accesses. During that meeting Council questioned
whether the City had the legal right to classify an access to something
other than what it was originally intended for.
The residents in the Terrace Circle neighborhood submitted a petition
objecting to the proposed classification of "Scenic Overlook" for the
Terrace Circle (North) access. One resident suggested that Eighth Street
also be classified as a Scenic Overlook. We have met the city attorney
to discuss the legal issues and with the Lake Advisory Committee to
review Eighth Street.
City staff met with the city's attorney on May 24, 1995 to discuss the
legal issues regarding the public accesses and whether the City had the
right to classify them as proposed in the Lake Access Study. . The
outcome of this discussion was as follows: If the dedication on the plat
shows a road with no other description, the intended use was either a
road or access to the lake. If the City has been using or maintaining an
access for a particular purpose, it may have accrued such rights, thus
making it easier to classify an access accordingly. If the City owns a lot
it can do as it desires within ordinance guidelines.
At the May 17, 1995 Lake Advisory Committee meeting there was
discussion on the Terrace Circle (North) and Eighth Street accesses.

There wa~ a motion and unanimous decision by the committee to remain
with the original recommendation as proposed in the Lake Access Study
which was: Terrace Circle (North) - Scenic Overlook, Eighth Street -
Retain utility easement, vacate a strip of land and look into constructing
a water quality pond at the storm sewer outlet.
The following are descriptions of the accesses as mentioned in the Lake
Access Study to be dealt with:
SEVENTH STREET (NORTH) - This street is platted road right-of-
way north of Center Road ending at the lake. There are two existing
homes facing Center Road between this right-of-way, they are numbers
2906 and 2940. This street right-of-way will need to be retained to
provide for future access to Lots 7 - 11 of Block 24. These lots would
not have legal access if Seventh Street were vacated. There is curb
opening off of Center Road locating this area in question.
Recommendation: Remain as is.
MONROE A VENUE AND KENT STREET INTERSECTION - The
corner of the intersection is where these two streets meet at the edge of
Prior Lake. A gravel path leads down off the road to the shoreline
where there is a dock and a boat lift located off of the bank. This right-
of-way is needed to maintain the road bed. A survey should be done to
determine if the dock and boat lift are located on public property. If
they are, they should be removed.
Recommendation: Remain as is.
LIME ROAD (SOUTH) -This platted road right-of-way has the
channel between Spring Lake and Upper Prior Lake running through it.
The land south of Spring Lake Road drops off approximately 4 feet to a
yard area that has been planted with trees by the adjacent property
owners.
Recommendation: Vacate the roadway easement and retain drainage
easement.
EIGHm STREET (NORTH) - This platted roadway north of Center
Road has a storm sewer line running through it outletting at the shoreline
of Prior Lake. The property is fully wooded with a mowed trail
meandering through the property which is maintained by the adjacent
property owner. There are two vacant lots to the east of this area.
Recommendation: Vacant a strip of right-of-way on both sides of this
roadway easement and consider constructing a water quality pond at the
storm sewer outfall. By vacating a strip of land on the east side would
make the lot immediately east of Eighth Street a more buildable lot on
which a home could be constructed.
LIME ROAD (NORTH) - This roadway easement provides an
additional access to the Spring Lake Cemetery. The cemetery is located
on the east side of platted Lime Road. The area is maintained by the
adjacent property owners.
Recommendation: Vacate the roadway from 20' north of the curb to the
lake.
LOT 3 OF SUNSET SHORE - This is a City owned lot which has
sanitary sewer, watermain and a storm sewer line running through the
property. The storm sewer outlets approximately 10 feet from the
waters edge. No parking is available in the near vicinity. A 1 to 2
course retaining wall exists along the lake front which was installed by
the Parks department. Several wooden posts and boulders are located on
the street side of the property to keep out snowmobilers. The property
owner to the south has requested the City to install more posts for the
same purpose. The house on the south side is located very close to or on
the lot line.
Recommendation: Scenic Overlook, which would include a wooden
split rail fence on the north and south sides to define the property
boundaries and installing a park bench for viewing of the lake. A survey
should be done to determine the location of the house on the south side.
Consideration should be given to selling a portion of Lot 3, depending
on the survey, to that property owner. The owner to the south has called
and is opposed to the idea of the City installing a fence on this property.
SUNSET SHORE WATERFRONT PROPERTY-In the original plat
of Sunset Shore the waterfront property was dedicated to public for
public use (see map). Approximately half of this waterfront has been
vacated by the City. As part of the recommendation for Lot 3 of Sunset
Shore, the LAC also advises the City to vacate the remaining waterfront
that is dedicated for public use. It will be the responsibility of the land
owners to initiate the vacation process for their property.
Recommendation: Approve property for vacation.
TERRACE CIRCLE (NORTH) - This access extends north off the end
of the Terrace Circle cul-de-sac. There is a fire hydrant at the end of the
cul-de-sac and a storm sewer line running down the center of the
easement outletting at the lake. Side street parking is available on
Terrace Circle. The two adjacent property owners mow the property and
claim to have improved it by removing chunks of asphalt and concrete.
Recommendation: Scenic Overlook, which would include a wooden
split fence defining the property boundaries, along with a park bench for
viewing the lake. Also, "No Parking With Trailers" signs should be
installed in the neighborhood to prevent overflow parking from the

Dewitte Avenue Public Access of boat trailers. A neighborhood petition
has been submitted to the City with 29 properties opposing and 2
properties for the recommendation.
ISSUES: The Lake Access Study recommendations were intended to provide the
City with a "strategic plan" through which reasonable access would be
provided to the lake. The study philosophy was that the City needs to
provide reasonable access for non-Iakeshore dwellers while respecting
the rights of lake shore owners. The LAC believes that these
recommendations are part of the overall strategy to accomplish this
objective.
ALTERNATIVES: The alternatives are as follows:
1. Accept the staff recommendations.
2. Accept the recommendations for one or more accesses and
recommend changes for the others.
3. Continue the hearing for a specific reason.
RECOMMENDATION: Staff recommends the following for each access:
-Lot 3 of Sunset Shore: Scenic Overlook, includes a park bench and
split rail fence.
-Lime Road (South): This right-of-way has previously been vacated, no
action required.
-Eighth Street: Retain utility easement, vacate 10ft. on the east side and
look at constructing a water quality at the storm sewer outlet.
-Seventh Street: Remain as is.
-Monroe Avenue and Kent Street: Remain as is.
-Terrace Circle (North): Scenic Overlook, includes a park bench, split
rail fence and installation of "No Parking" signs in the neighborhood.
ACTION REQUIRED: Motion and second to adopt the staff recommendations to classify the
following: Remain As Is - Seventh Street, and the Monroe A venue and
Kent Street intersection; Vacate - A portion of Eighth Street (north),
and Lime Road (north); Scenic Overlook - Lot 3 of Sunset Shore and
Terrace Circle (north) /,'
