TITLE 3, CHAPTER 12, SECTIONS 1 AND 2 OF THE
OUTDOOR CONCERT ORDINANCE

INTRODUCTION:
The Prior Lake Police Department is currently
reviewing a number of ordinances to see if
they need updating. Many of the ordinances
have been in place for many years and were
designed for use in a smaller city or are
simply outdated. As part of this effort, the
council directed that we look at the Outdoor
Concert Ordinance.
BACKGROUND:
The current city ordinance for outdoor
concerts allows each liquor establishment to
hold two outdoor concerts a year. Stringent
rules are applied to the concerts and, for the
most part, the events cause little problem on
the property. Problems, however, do occur
when large crowds are drawn into Prior Lake by
name bands. Even though the host bar does a
good job of managing the event, visitors come
armed with alcohol and are slow to leave the
surrounding area after the event. Heavy
police patrol is then required to keep the
peace so we don't have assaults and noise
complaints in the early morning hours. The
patrol requires extra officers on the street
at overtime costs.
DISCUSSION:
If the ordinance remains unchanged, the city
can expect escalating overtime costs as a
resul t of outdoor concerts. We have
considered a number of options.

ALTERNATIVES:
It. _would be possible to completely prohibit
outdoor concerts (except for church, city or
school sponsored events). This would
certainly curb city costs and eliminate public
complaints. It would also eliminate outdoor
receptions, graduation parties and the like
where a live band or electronically amplified
music is desired.
A second option is to amend the ordinance to
prohibit or restrict commercially sponsored
outdoor concerts. This would allow for
fundraisers and private parties under certain
circumstances.
Another option is to allow outdoor concerts to
continue lias is" but require that the
sponsoring party pay all city police costs
associated with the event. This would mean
the sponsor would pay a $200 permit fee, $225
refundable clean-up deposit, the cost of
police officers or security at the event plus
any overtime costs incurred by the city as a
result of the event.
The city's primary concerns should be to curb
additional costs associated with outdoor
concerts and the elimination of disturbing the
peace and other public safety types of
complaints. Each of the above options address
both issues to one extent or another.
The attached ordinance amendment would limit
the issuance of outdoor concert permits to
individuals holding private social events
which are private not public and to charitable
religious or non-profit organizations.
Outdoor concerts by IIfor profit" organizations
would be prohibited.
The council has the following options:
1. ) Do nothing.
2.) Restrict commercial concerts by adoption
of the attached ordinance amendment.
3.) Retain the existing ordinance but direct
that fees be amended to assure that the
sponsoring agency pays all city costs.
4.) Defer action pending

ORDINANCE NO. 95-10
AN ORDINANCE RELATING TO CHAPTER 12: OUTDOOR CONCERTS.
The Council of the City of Prior Lake hereby ordains:
SECTION 1
The Prior Lake City Code Section 3-12-2: Licensing, paragraphs A
and B are amended to read as follows:
SECTION 3-12-12: LICENSING:
A. No person, other than a person who has procured a license
from the City or is otherwise exempt pursuant to this
Chapter shall conduct an outdoor concert or music event
in the City.
B. Licenses may be issued only to (a) individuals hosting a
private social event to which members of the public are
not invited or admitted and for which no admission fee in
any form is charged, or (b) charitable, religious or non-
profit organizations which have been in existence at
least three years and which have their principal location
wi thin the ci ty. Licenses will not be issued to any
entity organized and maintained for profit.
SECTION 2
The Prior Lake City Code Section 3-l2-2: Licensing, paragraph B is
retitled paragraph C.
This ordinance is effective upon passage and publication.
