AUTHORIZING RESTRICTION OF LAWN AND GARDEN
SPRINKLING AND OTHER OUTDOOR USES
JULY 3, 1995
INTRODUCTION:
The purpose of this Agenda item is to consider adoption of
Resolution 95-60 authorizing the City Council to restrict the hours
for lawn and garden sprinkling. As a separate matter, the Council
should discuss changes which might be desirable to the existing
City code.
BACKGROUND:
The following is the Section of the current City Code that
discusses restricted hours for sprinkling:
RESTRICTED HOURS FOR SPRINKLING: Whenever the City
Council shall determine that a shortage of water supply
threatens the City, it may, by resolution, limit the times and
hours during which water may be used from the City water
supply system for lawn and garden sprinkling, irrigation, car
washing, air conditioning and other uses specified therein, a
copy of said resolution shall thereupon be mailed or
otherwise delivered to each water customer. Two (2) days
after the mailing or delivery of such resolution, any water
customer or other person who shall cause or permit water to
be used in violation of said resolution shall, in addition to
being subject to prosecution for a misdemeanor, be charged
five dollars ($5.00) for each day of such violation, which
charge shall be added to his next water bill. Continued
violation is hereby prohibited and shall be cause for
discontinuance of water service.
DISCUSSION:
The recent dry weather has produced a high demand for
municipal water. The City has been able to meet the demand.
On Wednesday, June 21, 1995, the City pumped 3.3 million
gallons of water. This is a City record. All three wells were
operating to meet this demand for water.
The high usage of water agitated the iron deposits in the pipes
and caused some colored water problems.

The City uses off-peak power rates with NSP to power the pumps
at the City's three wells. During the recent dry and hot weather,
NSP asked the City to turn off one of the pumps during a day of
high electric usage.
ISSUES:
I. TYPE OF WATER RESTRICTIONS
On June 8, 1988, the City Council adopted a resolution
restricting lawn and garden sprinkling to even/odd days. The
resolution exempted new sod laid within sixty days previous to
the resolution or any sod laid thereafter. The City Manager
was authorized to initiate additional restrictions if necessary.
The purpose of water restrictions is to "restructure" water
usage to reduce the peak daily usage. Even/odd restrictions
are the most common tool used. A second option is time of
day restrictions. Water usage is restricted to hours other than
11 :00 A.M. to 6:00 P.M. which tends to be the peak water
usage period. This allows daily usage but restructures it to
reduce the peak.
The latter restrictions are most desirable for a number of
reasons:
1. Enforcement - More city personnel are on duty during
these hours and can remind users about the restrictions.
2. Conservation - Water used for irrigation during the peak
heat of the day is lost to evaporation and may even harm
the grass.
3. Allows Daily Use - Even/odd restrictions allow alternate
day use while this restriction allows daily use.
4. Economy - This restriction helps direct city energy usage
away from peak cooling hours. This reduces city costs to
the consumer and leaves energy available during peak
hours for other purposes.
The implementation of the sprinkling ban would be effective from
the hours of 11 :00 A.M. to 6:00 P.M. seven days a week within
the City of Prior Lake. The sprinkling ban would apply only to
usage drawn from the Municipal Water Supply system. The
sprinkling ban would apply to lawn and garden irrigation, car
washing and other non essential outdoor water usage.
For the above reasons, the staff recommends the daily 11 :00 A.M.
to 6:00 P.M. restrictions. A survey is attached which shows the
practices other cities have adopted.

II. ORDINANCE REVISIONS
The current ordinance revisions date back to when the City had
significantly fewer water customers. A number of ordinance
revisions may be in order:
1. Annual Resolution - Because of the unpredictability of
weather, the problem can be gone before the resolution is
adopted. One of two actions are possible. A resolution
could be prepared for adoption which is perpetual rather
than specific to one season. A second option is to
authorize the City Manager to enact sprinkler restrictions
without further Council action. A third option is to write the
ordinance so the restrictions are automatically invoked
every year.
2. Publication - In an effort to notify the water users the city
must mail the Council approved resolution to each of our
4,400 users. This is expensive and may not be the best
way to advise the public. Whatever the ordinance
revisions directed, a more aggressive, less expensive
notification process is in order.
3. Penalty - The penalty should be revised to a misdemeanor
consistent with other aspects of the code with the
requirement that each day is a new violation.
The alternatives are as follows:
1. Approve the Resolution 95-60 and provide direction on
future ordinance revisions.
2. Table this item for a specific reason.
3. Deny Resolution 95-60 at this time.
Alternative NO.1. Resolution 95-60 will impose water restrictions
in accordance with present ordinance requirements. The staff
then needs direction regarding what changes, if any, should be
made to update the ordinance to current city needs.

RESOLUTION RESTRICTING OUTDOOR WATER USAGE
MOTION BY.
SECONDED BY:
WHEREAS:
the City Council has determined that a shortage of water supply is
threatening the City's water supply system due to the high demand of
water used for sprinkling lawns and gardens and other outdoor uses as
a result of the hot and dry weather of recent days; and
WHEREAS:
Prior Lake City Code Title 9, Chapter 4, Section 15 provides a means by
which water usage regulations may be implemented.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF PRIOR LAKE,
MINNESOTA, that:
1. Lawn or garden sprinkling and other non essential outdoor use of the
Municipal Water System shall be banned daily between the hours of
11 :00 A.M. to 6:00 P.M. within the City of Prior Lake. Such restriction
shall take effect immediately and continue until September 30, 1995.
2. The City Manager is hereby authorized to impose additional
restrictions, if necessary.
3. Any new sod laid within the past 60 days and any laid in the future
from the date of this Resolution shall not be affected by this ban

PRIOR LAKE, MINNESOTA
HELD: July 3, 1995
Pursuant to due call and notice thereof, a regular meeting
of the City Council of the City of Prior Lake, Scott County,
Minnesota, was duly called and held at the City Hall in said City
on Monday, the 3rd day of July, 1995, at o'clock .M.

RESOLUTION PROVIDING FOR PUBLIC SALE
OF $950,000
GENERAL OBLIGATION IMPROVEMENT BONDS OF 1995
BE IT RESOLVED by the City Council of the City of Prior
Lake, Minnesota, as follows:
1. Finding: Amount and Purpose. It is hereby found,
determined and declared that this City should issue $950,000
General Obligation Improvement Bonds of 1995 (the "Bonds") for
the purpose of providing money to finance the construction of
various improvements in the City.
2. Appointment of Financial Advisor. The City Council does
hereby appoint Juran & Moody, Inc., in St. Paul, Minnesota, to
act as its financial advisor to the City for the sale of the
Bonds.
3. Meeting: Bid Ooening. This Council shall meet at the
time and place specified in the form of Notice of Bond Sale
attached hereto as Exhibit A for the purpose of considering bids
for, and awarding the sale of, the Bonds. The City Manager, or
designee, shall open bids at the time and place specified in such
Notice of Bond Sale.

4. Notice of Bond Sale. The City Manager is hereby
authorized and directed to cause notice of the time, place and
purpose of said meeting to be published in the official newspaper
of the City and in Northwestern Financial Review not less than
ten (10) days in advance of the date of sale, as provided by law,
which notice shall be in substantially the form set forth in
Exhibit A attached hereto and made a part hereof.
5. Official Terms of Bond Sale. The terms and conditions
of the Bonds and the sale thereof are fully set forth in the
"Official Terms of Bond Sale" attached hereto as Exhibit Band
hereby made a part hereof.
6. Official Statement. The City Manager, Finance Director
and other officers or employees of the City are hereby authorized
to participate in the preparation of an official statement for
the Bonds with Juran & Moody, Inc.
The motion for the adoption of the foregoing resolution was
duly seconded by member and, after full
discussion thereof and upon a vote being taken thereon, the
following voted in favor thereof:

Consideration of the bids and award of the sale of the bonds will

REDEMPTION:
At the option of the Issuer, bonds
maturing on or after December 1, 2000
shall be subject to prior payment, on
December 1, 1999 and any interest
payment date thereafter, at a price of
par and accrued interest. Redemption
may be in whole or in part of the bonds
subject to prepayment. If redemption is
in part, the bonds remaining unpaid
which have the latest maturity date
shall be prepaid first and if only part
of the bonds having a common maturity
date are called for prepayment the
specific bonds to be prepaid shall be
chosen by lot by the Registrar.
BOND REGISTRAR:
Principal will be payable at the main
corporate office of First Trust National
Association, in St. Paul, Minnesota (the
"Registrar"). Interest will be payable
by check or draft of the Registrar
mailed to the registered holder of the
bond at his address as it appears on the
books of the Registrar. The Issuer will
pay reasonable and customary charges for
the services of the Registrar.
CUSIP NUMBERS:
If the bonds qualify for assignment of
CUSIP numbers such numbers will be
printed on the bonds, but neither the
failure to print such numbers on any
bond nor any error with respect thereto
shall constitute cause for a failure or
refusal by the Purchaser thereof to
accept delivery of and pay for the bonds
in accordance with terms of the purchase

DELIVERY:
Forty days after award subject to
approving legal opinion of Briggs and
Morgan, Professional Association, of St.

Legal opinion will be printed on the

bid, to be forfeited as liquidated
damages if bidder fails to comply with

If a Financial Surety Bond is used, it
must be from an insurance company
licensed to issue such a bond in the
State of Minnesota, and preapproved by
the Issuer. Such bond must be submitted
to Juran & Moody, Inc. prior to the
opening of the bids. The Financial
Surety Bond must identify each bidder
whose Deposit is guaranteed by such

Financial Surety Bond. If the bonds are
awarded to a bidder using a Financial
Surety Bond, then that purchaser is
required to submit its Deposit to Juran
& Moody, Inc. in the form of a certified
or cashier's check or wire transfer as
instructed by Juran & Moody, Inc. not
later than 3:30 P.M., Central Time, on
the next business day following the
award. If such Deposit is not received
by that time, the Financial Surety Bond
may be drawn by the Issuer to satisfy
the Deposit requirement. The Issuer
will deposit the check of the purchaser,
the amount of which will be deducted at
settlement and no interest will accrue
to the purchaser. In the event the
purchaser fails to comply with the
accepted bid, said amount will be
retained by the Issuer. No bid can be
withdrawn after the time set for
receiving bids unless the meeting of the
Issuer scheduled for award of the bonds
is adjourned, recessed, or continued to
another date without award of the bonds
having been made.
INFORMATION FROM
PURCHASER:
All rates must be in integral multiples
of 1/20th or 1/8th of 1%. No limitation
is placed upon the number of rates which
may be used. All bonds of the same
maturity must bear a single uniform rate
from date of issue to maturity and no
rate of any maturity may be lower than
the highest rate applicable to bonds of
any preceding maturities.
The successful purchaser will be
required to provide, in a timely manner,
certain information relating to the
initial offering price of the bonds
necessary to compute the yield on the
bonds pursuant to the provisions of the
Internal Revenue Code of 1986, as
amended.
