INTRODUCTION:
The purpose of this Agenda item is to accept or reject bids received
and enter into a contract for construction of Project 93-04.
Resolution 95-62 has been prepared for Council action on the
award of bid. Also this Agenda item is for Council to consider
authorizing MSA Consulting Engineers to perform the
construction engineering services on this project.

BACKGROUND:
Project 93-04 is the construction of five (5) Civil Defense Sirens to
increase the City's system of outdoor warning sirens.
On June 19, 1995, the City Council approved the Advertisement
for Bids for this project.
A bid opening on July 14, 1995, at 10:00 A.M. was held at City
Hall, and the results will be shown in Resolution 95-62.
DISCUSSION:
Resolution 95-62 shows that F ederal Warning Systems, from
Rochester, Minnesota is the low responsible bidder. The low base
bid is $73.634.31. The Engineer's Estimate is $80,000.00 for this
proj ect.
The City continues to negotiate with the Dakota Community for
assistance in funding for two sirens that will service their
community. The contract documents are prepared to allow a 90
day extension for the City to continue negotiations with the Dakota
Community. See the attached copies of the bid schedule and
quotation submitted by Federal Warning Systems.

The alternatives are as follows:
1. Approve Resolution 95-62 awarding the contract for Project
93-04 to the lowest responsible bidder, Federal Warning
Systems and to approve a motion authorizing MSA
Consulting Engineers to perform construction inspection
services for this project at a cost not to exceed $1,000.00.
The resolution will include two parts:
a) Approve the base bid of $73,634.31 for five sirens
anticipating adequate funding from the Dakota
Community.
b) Approve the base bid of $44,053.35 for sirens 1, 3
and 5 and delete the alternate bid of $29,580.96 for
sirens 2 and 4 anticipating inadequate funding from
the Dakota Community.
The intent of this resolution is to allow the city to award the
contract at this time and to continue to negotiate with the
Dakota Community.
2. Do not approve Resolution 95-62 for specific reasons.
3. Table this item for specific reasons.
The recommendation is to award the bid to F ederal Warning
Systems for the base bid amount and to authorize MSA Consulting
Engineers to perform construction inspection services.
The cost of Project 93-04 will be recovered through Equipment
Certificates and possible funding from the Shakopee Mdewakanton
Dakota Community.

WHEREAS, pursuant to an advertisement for bids for the construction of Civil Defense Sirens
Improvements, City Project No. 93-04, bids were received, opened, and tabulated
according to the law, and the following bids were received complying with the
advertisement:

The alternate bid amount would be subtracted from the base bid amount if

lowest responsible bidder.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF PRIOR LAKE,
MINNESOTA, that
1. The Mayor and City Manager are hereby authorized to enter into a contract
with Federal Warning Systems of Rochester, Minnesota in the name of the
City of Prior Lake for the construction improvements for Project No. 93-04,
Civil Defense Siren Improvements; according to the plans and specifications
therefore approved by the City Council and on file in the office of the City
Manager.

2. The City Manager is hereby authorized and directed to return forthwith to
all bidders the deposits made with their bids, except that the deposits of the
successful bidder and the next two lowest bidders shall be retained until a
contract has been signed.
