THE PLATTING OF WOODRIDGE ESTATES 3RD ADDITION
WITHOUT CONSTRUCTION OF MUSHTOWN ROAD.

The purpose of this item is to consider a request by John
Mesenbrink. of Brink Land Company LLC, to allow the platting
of Woodridge Estates 3rd Addition without construction of
Mushtown Road. The developer requests the City incorporate
Mushtown Road in the 1996 CIP and construct Mushtown
Road next year. The developer will pay a minimum of
$50,000.00 dollars or 1/2 of the cost of the road improvement,
whichever is greater.
In 1991, approximately 80 acres of land, located south of 170th
Street and west of The Pond Athletic Complex, was annexed
from Spring Lake Townsite to the City of Prior Lake. The
annexation agreement dated April 15, 1991, Item 4 states
"New Century agrees to pay up to one-half or $50,000.00
dollars, whichever is greater, of the entire cost of improvement
of the area of Mushtown Road located adjacent to the Property
to be annexed to the City. n
The site received preliminary plat approval for a single family
subdivision known as Woodridge Estates, on September 3,
1991. City Council minutes dated September 3, 1991, the
developers agreements for Wood ridge Estates First and
Second Additions as well as a letter from Timothy J. Keane,
attorney representative for New Century Construction, all
indicate that the developer agrees to pay for 500/0 of the costs
of the Mushtown Road Improvements. The preliminary plat of
Woodridge Estates specified that Mushtown Road was to be
improved with the third phase of the project, that being
Woodridge Estates 3rd Addition.

DISCUSSION:
The original developer, New Century Construction, sold the last
phase of the Woodridge Estates development to Brink Land
Company LLC. Mr. Mesenbrink is in the process of submitting
final plat documents for Woodridge Estates 3rd Addition.
However, Mr. Mesenbrink does not desire to construct
Mushtown Road and therefore requests that the City of Prior
Lake undertake the project. Brink Land Company LLC, has
agreed to pay for its share of the Mushtown Road improvement
as required per the annexation agreement and preliminary plat
approval.
ISSUES:
The preliminary plat of Woodridge Estates expressly states that
Mushtown Road be improved with the third phase of the
development. The rationale for the condition was to insure that
the developer, (New Century Construction) paid for their share
of the costs associated with improvement of the township road,
which was required due to the annexation. The current
developer, Brink Land Company LLC, desires to plat the 3rd
phase this year however, Mushtown Road is not in the 1995
CIP. The request of the developer is to allow him to construct
the 3rd addition this year and provide the City with a letter of
credit to pay for their share of the Mushtown Road
improvement costs. Brink Land Company LLC requests that
the City improve Mushtown Road in 1996 and therefore
requests that the improvement be included in the 1996 CIP. In
the interim I the developer would barricade access from
Woodridge Estates 3rd Addition to Mushtown Road until the
road construction is completed in 1996.
In the event that the Council approves the request, the
preliminary plat conditions would have to be amended to allow
development of the third phase without concurrent construction
of Mushtown Road. The Council would also have to
incorporate the Mushtown Road improvement project into the
1996 CIP. Approval of the request would allow the developer
to complete the Woodridge Estates subdivision and finish the
project. This alternative would be beneficial to the City and
residents of the neighborhood. Completion of the project will
require that the developer pay all fees associated with the final
plat. In addition, once the neighborhood is developed, the
neighborhood parks will be improved and the south portion of
the site will be final graded and improved which will be much
more appealing than the current site.
In the event that the Council denies the request, the developer
would not be able to plat the property until such a time as the
City improves Mushtown Road.

ALTERNATIVES:
1. Approve the request to allow Brink Land Company LLC to
final plat Wood ridge Estates 3rd Addition and pay its share
of the cost to improve Mushtown Road. Direct staff to
include this project in the 1996 Capital Improvement
Program.
2. Continue or table discussion for specific reasons.
3. Deny the request.
RECOMMENDATION: Alternative #1 subject to the following conditions:

for Mushtown Road. (Estimated cost per MSA letter dated
July 7, 1995 - $5,700.00 dollars).
2. The developer provide a letter of credit to cover its share of
the cost of the Mushtown Road improvement. ($50,000.00
or 1/2 of the cost of the improvement, whichever is greater)
as required by the City Engineer.
The developer petition to amend the preliminary plat of
Wood ridge Estates and pay all associated fees.

This is a letter regarding Mushtown Road and Brink Land Company's
Woodridge Estates Third Addition.
Brink Land will be responsible to pay a minimum of $50,000.00 dollars
or 1/2 of the cost of the improvement, whichever is greater if the City
takes over the Mushtown Road project. We are requesting that we are
allowed to construct the final plat of Woodridge Estates Third Addition
this year without construction of Mushtown Road and barricade the two
ends which connect to Mushtown Road until the City completes the
road.
Brink Land Company also requests that the City of Prior Lake improve
Mushtown Road and that the project be incorporated into the 1996
CIP. Brink Land Company would provide a Letter of Credit for it's
share of the cost for improvement of Mushtown Road, ($50,000.00 or
1/2 of the cost, whichever is greater). The letter of Credit would be
given to the City at the time the Developer's Agreement for Woodridge
EstatesThird Addition was executed.

2. New Century shall, within 30 days after the execution of
this Agreement, pay to the City the amount of $2,000 to reimburse
the City the costs and attorney's fees incurred by the City in
reviewing New Century's annexation petition, negotiating an
agreement with the Township, and drafting the necessary
documents; in addition, New Century shall reimburse the City an
amount up to $1,500, being the sum actually invoiced and paid by
the City in reimbursement of the Township's costs and attorneys'
fees incurred in this matter.

3. In the event the annexation occurs, New Century shall,
on or before December 31, 1991, reimburse the City the full
amount of the negotiated in "lieu of real estate taxes" payment
for the Property paid by the City to the Township in the agreed
amount of $8,000 pursuant to that certain Amendment to Orderly
Annexation Agreement between the City and Township.
4. New Century agrees to pay up to one-half or $50,000,
whichever is greater,. of the entire cost of improvement of the
area of Mushtown Road located adjacent to the Property to be
annexed to the City.

Items 5 thru 7 were bypassed in order to go directly to item #8:
Consider Approval of Bid Award for Project 91-14 Lakefront Park
Trails and Resolution 91-37. Assistant city Engineer Loney
presented a map of the proposed trail system and reported the
results of the bid opening for paving trails in Lakefront Park.
The low total bid base and alternate of $69,690.25 was submitted
by Prior Lake Blacktop. Resident Dorothy Watzl, 15608 Red Oaks
Road, expressed concern regarding the proposed handicapped access
trail to the Lakefront Park beach area. Ms. Watzl also requested
that city Manager Unmacht meet with Dave Watzl to discuss the
issue in more detail, and whether there had been a written
agreement between the City of Prior Lake and Watzl's on the road
to the beach area. Irene Abrahamson, 4696 Rutledge Street,
addressed the Council concerning traffic on Red Oaks, snowmobile
use in the park and signs to direct people to parking areas.
Extensive discussion occurred on all of the issues brought up by
Ms. Abrahamson and Ms. Watzl.

Council directed staff to research solutions to the snowmobile
issue and present a plan prior to this winter. Loney stated that
the trail construction would start within two weeks after the
contracts are signed.

The next portion of Agenda Item #8 was: consider Request of John
and Meda Kop. Meda Kop addressed the council with a request that
the City consider naming a portion of the trails located within
Lakefront Park "Kop Trail". A short discussion occurred on the
location of the trails to determine which area the Kops had in
mind when making the request. council directed staff to look
into naming the trails in Lakefront Park.
The next order of business was: Consider Action to Establish FiAe
Fire Hall Referendum. City Manager Unmacht gave a brief update H~
on the status of the issue as outlined in his memorandum of
September 3, 1991. Fire Chief, Al Borchardt, briefly discussed
the findings of the Land Acquisition, Building and Equipment
Committees. Discussion occurred on whether to put the equipment
purchases on the referendum or to purchase the equipment with
Equipment Certificates. Council directed staff to draw up a list
of pros and cons and present them on September 16.

The next order of business was: Consider Preliminary Plat of Wood 'i<..J.
Wood Ridge Estates. Attorney Tim Keane presented a map of the t~~at~.
proposed plat and discussed details of his Letter of Intent dated
August 28, 1991, which identified additional design and open
space issues agreed to by staff and the developer within the Wood
Ridge Estates preliminary plat.

Keane also discussed details with regard to the following: The
proposed trail system, minimized grading levels, tree ~lantings,
erosion control, sewer and water connections, berm~ngs, and
amount of land designated to park dedication. City Planner
Graser discussed the Metropolitan Council's request. with regard
to the City's urban service area expansion application.
Discussion occurred on the recommended tree cover requirements,
purpose of Wood View Court and Ridge View Court drainage and
utility easements and the turn-around and whether it sets a
precedent for utilizing someone else's property to facilitate
their plat. Council expressed a desire that there be a clear cut
differentiation between the trail and private property.
Additional discussion occurred regarding the placement of the
proposed five foot trail next to Lot 1, Block 3 and when the
final construction should occur. Staff suggested that the trail
could be eight feet instead of five feet. Council concurred.
Staff assured Council that the City's policy with regard to
retention of natural features and trails around a body of water
would be considered during construction.

Capital Improvement Program. Council concurred that staff should 7991/92
place this item on the agenda for September 16.

The next order of business was: Staff Report on status of the ~v~
EnividjSuper Valu Projects. City Manager Unmacht reported on the 5up~ V~
status of the agreement on the Development Contract between the ~~oie~
EDA and Enivid. Unmacht also stated that Su~er Valu has 5~~
submitted a preliminary plat and staff will be meet~ng on it this
week.
Topics discussed under other Business is as follows:
City Manager Unmacht presented a letter from the VFW VFW
regarding their request for an Outdoor Concert permit for the
Firemen's Chicken Fry on Sunday, September 8. Discussion
occurred regarding outdoor concerts and the possibility of
Council reconsidering the ordinance as it now is written.
Additional comments occurred on recent outdoor concerts and
problems associated with them. Mayor Andren questioned as to
whether the bar owners had met for the purpose of coming up
with a solution on policing and monitoring the outdoor
concerts they sponsor as they had indicated they would be
doin9. Council concurred that due to the 30 day notice
requ~rement, they could not set a precedent in this case by
granting the permit. A short discussion occurred on raising
the fee and implementing stricter enforcement of the

PROVIDED: AN EASEMENT FOR UTILITIES WILL BE REQUIRED FROM THE

This letter is intended to confi=m understandings reached in meetings
with City staff and ~he developers in the above-referenced projec~
regarding the resolution of issues relating to prelimina=y plat
approval of the Wood=idge Estates 1st Addition. .This let~e= also
confirms modifications to the preliminary plat and this understanding
as recommneded by the Prior Lake Planning Commission at its meeting of
August 22, 1991.
'OLANNTNG ISSUES
1. G~adinq Plan and Veqetation. It is agreed and understood that the
developer will mass grade the roads and drainage improvements.
Because it is beneficial to the prese~ation of existing
vegetation, the wooded home sites will be graded by the individual
home building contractors consis~ent with the overall grading plan
and city.
2. Pond T~ail. The pond trail will be included as an element in the
development plan with the area dedicated for park as indicated on
the preliminary plat. The pond trail will be a five foot walkway
with design and construction of the trail to be conducted by the

SPECIAL CONDITIONS
The developer agrees to the responsibility for 50% of the
costs of the Mushtown Road improvements to be constructed
with the last phase of the development. The last phase will
be a minimum of 40 lots. The developer's share is for a 36
foot urban road section with a 7 ton design. The City may
design a wide road with a 9 ton desi~n. The developer will
construct the section of roadway w~th the last phase of
Woodridge Estates.
The developer will maintain the temporary sedimentation
basins in the second ~hase until 90% of the lots draining to
a sedimentation bas~n in the second phase have turf
established.
3 .
The developer is responsible for the installation
lighting. The street lighting system shall be
the City Engineer prior to. installation.
