INTRODUCTION:
The upgrading of Mushtown Road from the south end of the
existing blacktop surface to the south for approximately 2500 feet
is a requirement of the annexation agreement for the W oodridge
Estates Development. The annexation agreement between Spring
Lake Township and the City of Prior Lake requires the upgrading
of Mushtown Road with the fmal phase of the W oodridge Estates
Development.
BACKGROUND:
The agreement between the developer of W oodridge Estates and
the City is as follows:
"The developer agrees to the responsibility for 500/0 of the
costs of the Mushtown Road improvements to be
constructed with the last phase of the development. The
last phase will be a minimum of 40 lots. The developer's
share is for a 36 foot urban road section with a 7 ton design.
The City may design a wide road with a 9 ton design. The
developer will construct the section of roadway with the
last phase ofWoodridge Estates."
The above agreement identifies that the developer is responsible
for 50% of the cost of Mushtown Road improvements. City staff
feels that the developer should be responsible for their share of the
frontage along Mushtown Road. Preliminary calculations show
that the developer has approximately 25% of the frontage adjacent
to Mushtown Road. The feasibility report will more accurately

identify the lengths and determine the assessable front footages for
this project.
The City asked MSA Consulting Engineers to submit a proposal
with a cost estimate to prepare a feasibility report for Mushtown
Road Street and Utility Improvement Project. Attached is a copy
of the letter from Mr. Thomas A. Roushar of MSA Consulting
Engineers dated July 7, 1995. The estimated total cost to prepare
the feasibility report is $5,700.00. They anticipate that it will take
approximately four weeks to prepare a rough draft of the report for
the City and adjacent property owners to review. After the reviews
are complete, then the final draft will be prepared and presented to
the City Council.
The City has sent a copy of the proposal and cost estimate from
MSA to the W oodridge Estates developers. They have agreed to
reimburse the City for the cost of the feasibility report if they do
not proceed with the final phase of the W oodridge Estates
development. If the Mushtown Road project proceeds and the City
Council awards a contract and assesses for the street and utility
improvements, then the cost to prepare the feasibility report will be
spread equally to the assessed properties. See attached copy of the
letter from John Mesenbrink dated July 5, 1995.
City staff feels that MSA Consulting Engineers would best fit the
needs of the City of Prior Lake for this type of project. The
developer has a different engineering firm preparing the plans for
their development and this other firm has prepared some
preliminary cost estimates and street grades for Mushtown Road.
However, City staff feels that it would be best to have the City's
own Consulting Engineering Firm prepare the feasibility report.
There are three alternatives for the City Council to consider:
1. Approve Resolution 95-65, and approve the recommendation
to appoint MSA Consulting Engineers as the engineers for
the Mushtown Road Street and Utility Improvement Project
and authorizing the Mayor and City Manager to enter into a
contractual agreement for these services;
2. A motion to direct staff to request proposals from additional
firms to submit proposals;
3. Table this item until some date in the future.
RECOMMENDATION: Staff would recommend Alternative 1.

RESOLUTION ORDERING PREPARATION OF REPORT
FOR
UPGRADING OF MUSHTOWN ROAD IMPROVEMENT PROJECT

WHEREAS, it is proposed to construct improvements within the following generally described
project area:
Mushtown Road from 1000 feet south of Tower Street to the southeast for 2500 feet to
Ridgemont Court. The construction will include sanitary sewer and watermain stubs,
storm sewer, grading, aggregate base, concrete curb and gutter, bituminous surfacing and
appurtenant work.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF PRIOR LAKE,
MINNESOTA, that the proposed improvements be referred to the City Engineer for study and
that he is instructed to report to the Council with all convenient speed advising the Council in a
preliminary way as to whether the proposed improvements are feasible and as to \vhether they
should best be made as proposed or in connection with other improvements, and the estimated
costs for the improvements as recommended.

RE: ESTIMATED LEVEL OF ENGINEERING SERVICES; FEASffiILITY STUDY
PHASE, MUSHTOWN ROAD PROJECT
Dear Mr. Wingard:
Thank you very much for offering us the opportunity to provide you with this estimate of
engineering services as may be required to prepare the Mushtown Road feasibility study.
MSA has conducted some preliminary research and a windshield survey. Our
understanding of the project is summarized below:
Mn~htown Road
At present, Mushtown Road is paved from the intersection with Scott County Road 23
south to the aggregate surfaced section which is to be improved. It is MSA' s understanding
that the improvement is to extend approximately 2,500 linear feet to the south past the
Woodridge Estates, Third Addition. Further, it is our understanding that the existing paved
section of Mushtown Road is to remain as-is.
The 2,500 linear foot section of Mushtown Road that is to be improved is currently an
aggregate-surfaced, rural section roadway approximately 24 feet wide. Following
improvement, the improved section will be an urban section with curb and gutter, storm
sewer and bituminous pavement. Although the curb opening width is yet to be determined,
MSA anticipates a curb opening width compatible with a collector street.
Fpa~ihility Study
MSA will meet with City staff to discuss the Mushtown Road project and further refine the
scope of the project as outlined above. MSA will obtain and review the preliminary
surveying information. MSA will also review the soil borings that have been taken. MSA
will conduct additional field surveys for preliminary design purposes as necessary.

Following review of the soil borings and preliminary field surveys, MSA will complete
preliminary design of the street improvements, as well as required storm sewer. The
preliminary designs will then be used to prepare cost estimates for the project. MSA
understands that the City of Prior Lake wishes to have cost estimates that are accurate to
:t 10% of the actual final project costs.
Following completion of the preliminary cost estimate, MSA will prepare a detailed draft
final report. The draft final report will be submitted to City staff for review. Following
a review meeting with City staff, comments received will be incorporated into the draft
report, and a final feasibility report will be issued. The fmal feasibility report will be
complete with cost estimates, exhibits, and sketches.
MSA will present the feasibility study report to the City Council and at public hearing(s).
Presentation graphics will be prepared for the presentations.

It is MSA' s understanding that City staff will research property records and take the lead
in preparing preliminary assessment roles. MSA will assist City staff in this effort by
providing construction and engineering cost estimates.
A vailahle Information
MSA anticipates that record drawings are available for the existing paved portion of
Mushtown Road. The record drawings will be used to minimize the field surveying
necessary for preliminary design.
It is anticipated that little record drawing information will be available for the aggregate-
surfaced portion of Mushtown Road.
Soil Boring.4;
MSA has obtained the logs of auger borings that have been taken. However, there is no
geotechnical interpretation of the soil borings. Our proposal includes a $500 allowance for
geotechnical interpretation of the auger borings. Geotechnical interpretation will be billed
at MSA's cost with no mark-up.

Right-of-Way F~~pmpnt~
MSA anticipates that only prescriptive rights exist for Mushtown Road and not dedicated
right-of-way or roadway easement. Prescriptive rights are limited to only the existing
traveled surface. Therefore, additional right-of-way will be required. In addition,
easements for storm sewer may be required. We have included 8 hours of land surveyor
time to research the existing right-of-way and to define additional right-of-way/easement
needs.

MSA anticipates that the City of Prior Lake will undertake the development of the 429
notices, mailings, and public hearing notices.

To develop a detailed feasibility report for the Mushtown Road project and presentation to
City staff and the City Council, MSA anticipates the level of effort as indicated on the
attached exhibit.

Regarding feasibility study from MSA for Mushtown Road. Brink Land will pay
25% of the cost. Providing the City council allows us to start third addition. By
blocking off both entrances to Mushtown Road. Per letter dated 7/5/95 to the
City of Prior Lake. The other 75% of the cost we feel should be the City of Prior
Lakes responsibility.
