Specifically, the request is to construct a Public Works and Park Maintenance Facility on Outlot B, Waterfront Passage Addition. See attached Planning Report dated July 24, 1995 for a complete analysis of the CUP application and process. Public buildings are listed as a CUP within the Zoning Ordinance for the B-P, Business Park District. As such, in order to construct the maintenance facility as proposed, the City of Prior Lake must review the site according to . the performance criteria for CUP's listed in Section 7.5 of the Zoning Ordinance. The Planning Commission held a hearing on this issue on July 24, 1995. There were residents in the audience however no one provided testimony during the public input, part of the hearing. The Planning Commission reviewed the site plan in relation to the Zoning Ordinance performance criteria. Jeff Ortel, of BRW was present to review the proposal and address specific questions raised by the Commissioners. The Planning Commission adopted attached Resolution 95- 19PC, identifying specific findings and recommending that the Council approve the CUP application subject to 5 conditions outlined therein. The recommendation of the Planning Commission and 5 conditions are incorporated into Resolution 16200 Eagle Creek Ave., Prior Lake, Minnesota 55372-1714 / Ph. ISSUES: The Public Works and Park Maintenance Building project is complicated and requires the involvement of many individuals and several approval processes. In addition to the CUP, the project will require the following: Approval of the final plat of Waterfront Passage 2nd Addition to create a buildable lot; approval of an amendment to the B-P standards to allow accessory buildings within the B-P Zone, building permit approval and site plan approval from the DRC. One issue that is outstanding related to the CUP proposal concerns the 6,000 square foot, accessory building proposed to house sand and salt. the current B-P zoning standards are extremely limited with respect to permitting accessory buildings. The rationale for the restrictive standard is to discourage accessory structures because there is a tendency to build less expensive buildings and the structures tend to accumulate outside storage of various materials. Staff is in the process of drafting language to permit accessory structures within the B-P Zone provided they be totally screened from public view; are limited in size to 150/0 or less of the principal building; are constructed with materials similar to the principal building and are located in the rear yard of the subject site. The zoning amendment issue is scheduled for consideration by the Planning Commission on August 14, 1995. The CUP application under consideration provides for an accessory structure consistent with the objectives mentioned above, however, approval of the CUP should be conditioned upon amendment to the Zoning Ordinance to permit accessory structures within the B-P, Business Park Zone. ALTERNATIVES: 1. Adopt Resolution 95-69, approving a Conditional Use Permit to locate a public building, (Public Works/Parks Maintenance Facility), within the B-P, Business Park Zone subject to the 5 conditions outlined therein. 2. Continue or table the item for further discussion. 3. Deny the CUP application finding that the performance criteria have not been satisfied by the application. RECOMMENDATION: Alternative #1. BE IT RESOL VED BY the Board of Adjustment of the City of Prior Lake. Minnesota; FINDINGS 1. The City of Prior Lake has applied for a Conditional Use Permit, (CUP) under Section 7.5 of Prior Lake Zoning Ordinance 83-6. 2. The CUP application is to permit the construction of a public building within the B- P, Business Park Zoning District. .... :J. The Board of Adjustment has reviewed the CUP application as contained in Case #CU9503, and held a hearing thereon on July 24, 1995. .... 5. See Exhibit A for reference to the site plan and narrative of the proposal. Public buildings are listed as CUP~s within the B-P, Business Park Zoning District. As such, in order to construct the maintenance facility as proposed, the City of Prior Lake must review the site according to the performance criteria for CUP's listed in section 7.5 of the Zoning Ordinance. (See attached Exhibit B for information related to CUP applications and processing procedures. .~ BACKGROUND: Public buildings are listed as a CUP within the Zoning Ordinance for the B-P, Busine'ss Park District. The subject site consists of approximately 12 acres and is a triangular piece of property located south of CSAH 21, east of Adelmann Street and north of the south corporate boundary of Prior Lake. Adjacent land uses to the north and southeast consist of existing industrial development. The property to the west will be developed with land uses consistent with the B-P, permitted and conditional uses. The property directly south of the site is located within Spring Lake Township and is currently zoned for Rural Residential development. The southern part of the subject site is heavily wooded and will provide an extensive buffer area to the Township property to the south. The subject site was subdivided by the City of Prior Lake in July, 1993 and later purchased by the City, (in 1994), with the express intent of constructing a new maintenance building on the property. The City Council selected the architect BR W Elness, to prepare plans and specifications for the 3.0 million dollar project. The City Council approved the building design and authorized the preparation of plans and specifications for construction of the maintenance building on June 19, 1995 via Resolution 95-54. Access to the site will be via Adelmann Street. The site was chosen by the City due to its close proximity to the existing maintenance building, (located north of Prior Lake Baptist Church), and to serve as a major "anchor" to Waterfront Passage Business Office Park. The site and building plans were designed by the consulting firm of BR W Elness, represented by Jeff Ortel and Pete Keely. The architects have worked closely with staff and under direction of the City Council, to design site and building plans conforming to City codes and be aesthetically sensitive to the planned future industrial development within the Business Office Park. A consultant from the firm will be present at the hearing to address specific concerns of the Planning Commission and/or audience. The building will be constructed with brick and decorative block on the front office area, and aggregate surfaced concrete panel walls on the larger storage areas of the building. The proposal contains a flat roof system however, a sloped standing seam metal roof is used for accent at the front office areas. The building has been designed to be compatible with the new fire station however, features have been incorporated to provide a distinct character of its own. The site plan indicates a salt/sand storage building which is proposed to be located behind the principal structure, and nestled in a wooded area, to screen the structure from public view. The landscape plan indicates proposed materials and location of vegetation on site to accent and provide screening for the buildings. Staff recommends the landscape plan be amended to provide additional trees along the berm, located on the north side of the principal building. The building and site plans will be consistent with all applicable codes and ordinances of the City of Prior Lake. ISSUES: The Public Works and Park Maintenance Building project is complicated and requires the involvement of many different individuals. The process to date has included the following steps: Site selection, land negotiation, City Council funds appropriation, submittal and review of RFP's (request for proposals), from private consulting firms, Council selection of BR W, Elness to prepare plans and specifications, staff consultation and BR W development of the site plans and information necessary to acquire permits and begin construction. The project will also require the following: Approval of the CUP to locate a public building within the B-P Zone, approval of the final plat for the subject site to create a buildable parcel, DRC site plan approval, approval of an amendment to the B-P standards to allow accessory buildings within the B-P Zone, letting of bids for construction of the project, building permit approval, and the ultimate construction of the building and site improvements. See Exhibit D, for the final schedule for the Maintenance Building. Typically, a CUP application would be considered much earlier in the process than this application. This project is somewhat atypical in that the City of Prior Lake is the developer, land owner, and regulatory authority overseeing the development. The project has been designed according to City Code and ordinance requirements. Staff is of the opinion that the site and buildings have been designed in a manner that is consistent with the performance criteria outlined in the Zoning Ordinance. The approval criteria for conditional uses primarily focus on conformity and integration of the use into the existing neighborhood. The landscape plan and "CU9503PC. 2 exterior building design have been developed in order to complement the B-P District and anticipated future land uses. Approve attached Resolution 95-19PC recommending that the City Council approve the proposal to locate a public building (Public Works and Parks Maintenance facility), within the B-P, Business Park Zoning District. 2. Continue to table this item for further information as identified by the Planning Commission. RECOMMENDATION: Alternative # 1 with conditions as per Planning Commission discussion. The site was thoughtfully chosen in order to meet public works and park service needs of Prior Lake. The architects, City Council and staff have spent countless hours designing the..site and building plans to conform with the codes of Prior Lake and anticipated future development. The use will comply with the performance standards outlined in the Zoning Ordinance for CUP's. The approval criteria for conditional uses primarily focus on conformity and integration of the proposed use into the existing neighborhood. The Maintenance Facility has been designed specifically for that purpose therefore, staff recommends the CUP be approved. ACTION REQUIRED: A motion to adopt Resolution 95-19PC as written or with changes directed by the Planning Commission. Please note that Resolution 95-19PC contains 5 conditions recommended to be placed on the CUP. The Planning Commission may desire to amend the conditions as per discussion at the public hearing. "CU9503PC' 3 '~>~>>"""""_O.'>~>~>-~-'O~".'-->-r-'-_._-->O>'''O>'-_O--"--------- EXHIBIT B: CONDITIONAL USE PERMIT PROCESS & REQUIREMENTS CUP PROCESS: A conditional use is defined as "a use which, because of special problems of control, requires reasonable limitations peculiar to the use for the protection of the public welfare and the integrity of the Comprehensive Plan." A conditional use permit is "a permit issued by the Council in accordance with procedures specified in the Zoning Ordinance as a flexibility device to enable the Council to assign dimensions to a proposed use or conditions surrounding it after consideration of adjacent uses and their functions and the special problems which the proposed use presents" (Prior Lake Zoning Ordinance 83-6." The Planning Commission should understand that a conditional use is considered to be permitted however, because the use may have a potential for conflict with surrounding uses, the Council has the discretion to apply special conditions to the permit approval. A land use requiring a CUP must follow the specific performance criteria listed in the zoning Ordinance. The Planning Commission and Council determine the application can meet the designated Zoning Ordinance conditions and establish any additional conditions it believes necessary and reasonable to protect the existing neighborhood. SECTION 7.5. ZONING ORDINANCE 83-6 ~ '.CU9503 pc. 4 EXHIBIT A PRIOR LAKE MAINTENANCE BUILDING AND SITE DESCRIPTION The property is a semi-triangular shaped piece, located adjacent to County Highway 21 and Adelmann Street. Access to the site is from two curb cut locations off of Adelmann. (There is no drive or street connection to a state or county highway.) The existing site has a wooded area to the south of the site, which is being saved to the extend possible and used in part to screen the proposed Salt/Sand Storage Building. The site is reasonably flat and includes two small potential wetland areas, each of which are outside of the building or site improvement work. The site improvements include a filtration pond to pre-filter the majority of the site storm runoff. Also included are paved roadways, parking areas, a gasoline dispensing island, above-grade gas storage tanks, a sign monument, storage bins and 'other minor items. Benning is incorporated adjacent to the building in order to diminish the size and height of the facility. Storage bins are also situated into this berm. In addition to the saving over fifty percent of the trees on site, new landscaping and trees are provided in excess of the City of Prior Lake Standards. The main building is slightly under 45,000 square feet in total area, which includes enclosed space for the storage and maintenance of vehicles, as well as shop space, office space and related operational spaces for the City of Prior Lake's Parks and Public Works maintenance crews. A detached 6000 square foot unheated storage building for storing roadway salt and sand (while improving the City's water quality) is located in the south western portion of the site. The building materials of the main building include brick and decorative block at the front offing areas, and aggregate surfaced concrete pC;1nel walls at the larger storage areas of the building. Flat roofs are predominant but a sloped standing seam metal roof is used for accent at the front office areas. In general, the appearance will be similar to the new fire station located in close proximity to this site, and yet have a character of its own. The salt/sand storage building is primarily timber construction with a sloped shingled roof: different in form and material selection from the main building. A conditional use permit is "a permit issued by the Council in accordance with procedures specified in the Zoning Ordinance as a flexibility device to enable the Council to assign dimensions to a proposed use or conditions surrounding it after consideration of adjacent uses and their functions and the special problems which the proposed use presents" (Prior Lake Zoning Ordinance 83-6." The Planning Commission should understand that a conditional use is considered to be permitted ho\vever, because the use may have a potential for conflict with surrounding uses, the Council has the discretion to apply special conditions to the permit approval. A land use requiring a CUP must follow the specific performance criteria listed in the zoning Ordinance. The Planning Commission and Council determine the application can meet the designated Zoning Ordinance conditions and establish any additional conditions it believes necessary and reasonable to protect the existing neighborhood. JUNE 19, 1995 The City Council has authorized the selection of BRW Elness as architects for the Prior Lake Public Works/Parks Maintenance Garage. The Council has also revised the total project budget from the originally estimated $2.6 million to $3.0 million. In order to proceed expeditiously with the project, it is necessary for the Council to approve the building design and authorize preparation of plans and specifications. This agenda item requests that the Council act upon each of these issues. Jeff Ortell and Pete Keely representing BRW Elness Architects, Inc. have been meeting with Public Works and Park Maintenance staff members to discuss the Public Works/Park Maintenance building project. pA -::.; The focus thus far has been on the building's interior and exterior. We have been concerned that the interior has sufficient size, layout and equipment to optimize its utility for the most number of years. We have also worked carefully to avoid conflicts between the use of various portions of the building interior . We have been seeking a way to economically breakup the exterior monotony of the large storage area while assuring that the office portion of the building is consistent aesthetically with the fire station. Attached is a schematic showing the building site and proposed interior of the building, including the office area, equipment maintenance and vehicle storage areas. The office area is intended to provide expansion capacity for future employees in the Public Works and Park ~Iaintenance area. A number of the offices are not hard walled which will allow flexibility in the future and the opportunity to maximize space utilization. The key sections of the building are the equipment maintenance area and shops. In these spaces much of the preparation is done so that maintenance activities in the community can take place. Vehicle storage is also high priority so that the city's multimillion dollar investment in equipment is well protected. The building exterior is intended to be reasonably consistent with the quality found at the fire station #1. The office portion of the structure will consist primarily of brick in colors which are similar in many respects to the fire station. The storage area will be tip up concrete panels which are banded and textured in an effort to provide aesthetic relief for the garage portion of the building. Included with this report are building sketches from various vantage points. The architect will review these plans with the City Council at the June 19 meeting. Council may wish to share comments or propose revisions. One decision the Council should make has to do with a bell or clock tower proposed on the northern elevation of the building. The north and west elevation drawings show the clock tower. This concept is intended to keep this building structurally consistent with both the fire station and city hall. According to the Architect, the cost of the tower is approximately $5,000. Councilmembers should determine whether, m their estimation, the cost is worth the benefit of retaining the~tower. Once the Council has reviewed the design plans, it would be appropriate to approve the plans and then consider authorization for preparation of plans and specifications for bidding purposes. Attached is a building schedule for the maintenance facility. Council will note that the intent is to award bids by September 5 and start construction by September 12 of this year. By doing this the Architect believes we can get the best prices possible and have the building envelope completed so that interior work can take place over the winter. This also allows the Park Maintenance and Public Works Departments to move into the building by approximately July, 1996. In order to move forward with the Public W orkslParks Maintenance Building project, it is necessary for the City Council to approve the design of the structure and authorize the preparation of plans and specifications. The design 4f' proposed is within the project budget. If the architect is to remain with the proposed building schedule, then Council actions on both issues are required on June 19. If, however, the Council has major concerns it is still appropriate to defer action for further study. ALTERNATIVES: Council has the following alternatives: 1. Approve the building design with the clock tower and authorize preparation of plans and specifications. 2. Approve the design without the clock tower and authorize preparation of plans and specifications. 3. Defer action on approval pending the receipt of additional inform a tion. RECOMMENDATIONS:Altemative #1. In order to maintain the schedule laid out by the architect, it would be appropriate for the City Council to approve the building design and authorize preparation of plans and specifications. In my estimation, the clock tower provides a ready identification for Prior Lake municipal buildings. Given the productive life of this facility and the image the city is intending to convey, I believe that the clock tower is a minimal and worthwhile investment.
