HomeMy WebLinkAbout6B - Quaker Trl/Pine Rd Access AGENDA: PREPARED BY: SUB.JECT: DATE: INTRODUCTION: BACKGROUND: DISCUSSION: STAFF AGENDA REPORT 6B LANI LEICHTY, WATER RESOURCES COORDINATOR CONDUCT A PUBLIC INFORMATIONAL MEETING FOR THE FOLLOWING PUBLIC ACCESSES: QUAKER TRAIL AND PINE ROAD. AUGUST 7, 1995 The purpose of this public infonnational hearing is to determine if the City Council desires to classify the above mentioned accesses according to the recommendations of the Lake Advisory Committee. Neighbors have been notified and notices placed in the Prior Lake American about this meeting. When the Lake Access Study was accepted by the Council at its regular meeting on October 17, 1994, the study made the following recommendations for these accesses: VACATE: 1) Quaker Trail (Fairbanks Trail) 2) Pine Road Note: In the Lake Access Study the Quaker Trail access was inadvertently mislabeled, its' correct description should be Fairbanks Trail. The definition for "vacate" used in the study is as follows: Vacate: The City would release it's right to use or control property for a designated purpose. Vacate the property after research has been done to ensure no property will be landlocked, and a petition to vacate has been received. The following are descriptions of the accesses as mentioned in the Lake Access Study to be dealt with: FAIRBANKS TRAIL - "This street ends with a 90 degree bend to the south and dead ends. There is approximately a 30 ft. strip of grass between end of the road pavement and the lake to the south. On the east side there is a 5 ft. wide strip of land before it drops 4 ft. to the water. The area is mowed by the adjacent property owner. A boat lift is in the water, which also probably belongs to the adjacent 16200 Eagle Creek Ave., Prior Lake, Minnesota 55372-1714 / Ph. (612) 447-4230 / Fax (612) 447-4245 AN EQUAL OPPORTIJNITY EMPLOYER property owner. No street lighting exists and parking is restricted due to the limited amount of open space in the area." The City snowplows and maintains the street in this area. The natural flow of drainage water is off the end of the street over the grass/shrub area into Prior Lake. Recommendation: Vacate waterfront and retain a drainage easement for the overland drainage flow. PINE ROAD - This road is paved down to the waters edge with a chain across the road and a sign saying "Private Property". It is also posted with two other signs reading ''No Public Access" and ''No Parking". There is no street lighting. When this roadway was platted it was shown as a driveway, which was dedicated to the respective lot owners of "North Shore Crest", meaning that it was a private road. In 1986 the City condemned this roadway so that public utilities could be installed. At that time residents were specifically told that the City had no intention of making this a public access. By releasing City rights to the last 30 feet of public roadway easement and turning it back to the respective lot owners, would effectively limit the public from using this roadway as a public access. Recommendation: Relinquish the City's rights to the last 30 ft. of the public roadway easement abutting the lake. ISSUES: The Lake Access Study recommendations were intended to provide the City with a "strategic plan" through which reasonable access would be provided to the lake. The study philosophy was that the City needs to provide reasonable access for non-lakeshore dwellers while respecting the rights of lakeshore owners. The LAC believes that these recommendations are part of the overall strategy to accomplish this objective. ALTERNATIVES: The alternatives are as follows: 1. Accept the staff recommendations. 2. Accept the recommendations for one or more accesses and recommend changes for the others. 3. Continue the hearing for a specific reason. RECOMMENDATION: Staff recommends the following for each access: - Fairbanks Trail: Vacate waterfront and retain a drainage easement. - Pine Road: Vacate; Le., release City rights to last 30 feet of roadway easement. ACTION REQUIRED: Motion and second to adopt the staff recommendations to classify the following: Vacate - airbanks Trail and Pine Road.
