INTRODUCTION:
The purpose of this Agenda item is to discuss and approve
the concept plans for the improvement of CSAH 21 and
CSAH 42, approve the preparation of the feasibility report
and authorize the city's engineering consultant MSA to
prepare the feasibility report. The purpose of the feasibility
report is to determine the costs for trunk sewer and water
lines.
BACKGROUND:
The proposed improvement for CSAH 21, located between
County Road 82 and CSAH 4:2, upgrades the existing road
from a two lane rural design to a four lane urban design. As
an urban design, the improvement will include curb and
gutter and a concrete median. Other improvements include
a bikeway, which will be constructed the length of the project
on the east side and a traffic signal, which will be installed at
the intersection of County Road 82 and CSAH 42. Trunk
watermain will be installed with the project and
improvements will be made to the storm sewer and ponding
system. Limited landscaping will be included where houses
do not have a buffer. A median will be constructed with
channelization from CSAH 42 to the south side of lords
Street. The median will provide channelization for turn
lanes. Channelization will be included at three intersections
for future access to the Jeffers parcels. Those intersections
are Carriage Hills Parkway, Coachman lane and Raspberry
Ridge Road.

DISCUSSION:
The proposed improvement for CSAH 42, located between
Ferndale Ave. and McKenna Road, upgrades the road from
a two lane rural section to a four lane rural section. As a
rural design, the road will be divided by a grass median. An
eight foot bituminous bikeway will be constructed from
CSAH 21 to Ferndale Avenue along the south side. Trunk
watermain and sanitary sewer will be installed with the
project and improvements made to the storm sewer and
ponding system. Because of the rural character of the area,
landscaping will not be included with this project.
The rural design will provide channelization with turn lanes
for the existing street intersections on CSAH 42. Full access
with turn lanes and a median opening will be provided on
CSAH 42 at Ferndale Avenue, Rolling Oaks Circle, Pike
Lake Trail, CSAH 21, and McKenna Road. Individual
driveways will have limited access to right in, right out.
Future access points to the Vierling parcel to the north will
be determined when development occurs. This parcel is not
in the urban service area and is in the Agricultural Preserve
Program.
Scott County would like to construct CSAH 21 and CSAH 42
in 1997. The county would like to construct the two projects
concurrently to balance out the earthwork. CSAH 42 has an
excess amount of dirt which will be used on CSAH 21 which
is short of dirt.
The county intends for the CSAH 18 project to begin in 1996
but is facing a potential lawsuit from residents in the
Shakopee portion of the project. The previous lawsuit by
these same residents, based on a noise variance, was
disallowed when the State legislature conditionally
exempted county roads from the requirement for a noise
variance. If the project is delayed by legal action, the county
intends to move the CSAH 42 and 21 projects to 1996 and
construct CSAH 18 in 1997. The county will make that
assessment at the end of this year. The city can not fund

both projects in 1996, but can in 1997. By doing both
projects in 1997, the city can use two separate bond issues,
(one each year) to fund the city's share of the costs.
Funding of these projects has a substantial financial impact
on the city. Staff has proposed reducing the scope of the
projects to reduce the City's Ad Valorem Tax Levy. The
County Road 42 project is proposed as a rural section
versus urban section to reduce cost. The trail is proposed to
be on one side (south side) from Ferndale Avenue to CSAH
42. No landscaping is proposed as the area is either
agricultural or the existing residential areas currently have a
buffer. Trunk sanitary sewer and watermain improvements
need to be included.
On CSAH 21 the proposed improvements are a bikeway on
the east side only to reduce cost. The landscaping would be
limited to residential areas which do not have an existing
wooded buffer. Trunk watermain improvements need to be
made. Staff is requesting that MSA prepare a feasibility
study to more accurately determine costs for the trunk sewer
and watermain improvements. Staff is also reviewing the
proposed comprehensive sewer and water plans for their
consistencies.
The following is an estimated cost summary for CSAH 21
and 42. The requested feasibility study will refine the cost of
the utilities.

Funding for CSAH 21 will be by project levy and is estimated
to be $542,000.

Funding for CSAH 42 will be by project levy and trunk
reserve. The estimated project levy is $292,500 and the
Trunk Reserve expenditure is $290,000.
The 12" sanitary sewer indicated above may be relocated if
the county needs to correct for bad soils in the area near
McKenna Road. The 10" line will serve the Meadowlawn and
Rolling Oaks Circle area to the south of CSAH 42.
The county is proceeding with the design of the projects,
and would like Council approval of the design concepts.
Final plans will be presented to the City Council in the future.
The city and county have had neighborhood meetings with
adjacent property owners previously. Property owners will
receive a notice of the meetings. Plans are available in the
Engineering Department. A frontage road was requested by
the four property owners north of CSAH 42 east of CSAH 21
to provide access. This request was made at the
informational meeting. Staff explained that the cost of the
frontage road could not be justified.

The City asked MSA Consulting engineers to submit a
proposal with a cost estimate to prepare a feasibility report
for CSAH 21 and CSAH 42. The cost of the feasibility study
is $5,000. Funding would be from the Trunk Reserve Fund.
ALTERNATIVES:
The alternatives are as follows:
1. Make a motion and second to approve the concept
plans for CSAH 21 and CSAH 42, and authorize MSA
Consulting Engineers to prepare a feasibility study for
CSAH 21 and CSAH 42 utilities.
2. Make a motion and second to disapprove the concept
plans for CSAH 21 and CSAH 42
3. Table this item for specific reasons.
RECOMMENDATION: The recommendation is to approve Alternative No.1.
FINANCIAL IMPACT: The project will be funded by project levy and trunk reserve.
ACTION REQUIRED: Make a motion to approve or deny the concept plans, the
feasibility report and a orization for MSA to prepare the
report at a cos t to eed $5,000.
