DEVELOPMENT L.P. TO CONDUCT A SPECIAL GOOSE
HUNT AT THE WILDS.

The purpose of this item is to consider an application from Prior
Lake Development to allow four permit holders to hunt geese
at The Wilds. Attached find Ordinance 95-12; letter from Diana
Regenscheid, DNR Area Wildlife Manager; Special Canada
Goose Hunt Applications and letters from Tim Jacobs,
Development Director at The Wilds related to the special hunt
request.
The City Council adopted Ordinance 95-12 on August 7, 1995
which allows for the discharge of firearms in platted portions of
the City of Prior Lake under specified conditions. The
Ordinance provides the City Council the discretion to authorize
a special hunt, via resolution, to allow a special hunting season
on private lands within the City. Per the Ordinance, the DNR
Area Wildlife Manager submitted a letter requesting the Council
to consider allowing The Wilds golf course to allow hunting,
(discharge of firearms), during the 1995 goose season. The
purpose for the request is to address problems of
overpopulation and resultant destruction of property due to
local Canada geese in this area of Prior Lake.
The proposal of the applicant is to permit four individuals,
identified on attached applications to participate in a "Special
Canada Goose Hunt", to participate in the goose hunt. The
proposal is to notify all homeowners within The Wilds of the
hunt. No hunting is proposed during the hours the golf course
is open. Shotguns only with a light load will be used. In
addition, the intent of the hunt is to scare off as many geese as

possible. The last resort is to kill the geese. The Wilds has
been advised that geese may not return to nesting areas if they
are successful in scaring the geese oft. All hunting will take
place on the fairways and non-developed portions of the Wilds.
The hunters are required to comply with all other Department
of Natural Resources regulations, state law and local
requirements.
ALTERNATIVES:
1. Adopt Resolution 95-80 authorizing the discharge of
firearms at The Wilds, for the purpose of conducting a
special hunt for Canada geese.
2. Remove this item from the consent agenda for further
discussion.
3. Do not adopt Resolution 95-80 finding it is not in the best
interest of the City to allow the discharge of firearms at
The Wilds.
RECOMMENDATION: Alternative #1.
ACTION REQUIRED: A motion as part of the consent agenda to adopt Resolution

RESOLUTION PROVIDING FOR THE AUTHORIZATION OF A SPECIAL
HUNT FOR CANADA GEESE AT THE WILDS.
MOTION BY: SECOND BY:
WHEREAS, The City Council adopted Ordinance 95-12 allowing for the discharge of
firearms on private property within the City limits for the purpose of
participation in a special hunt; and
WHEREAS, Prior Lake Development L.P. submitted an application according to the
provisions of Ordinance 95-12, requesting permission to conduct a special hunt
for Canada Geese, during the 1995 Goose Season; and
WHEREAS, DNR Area Wildlife Officer, Diana Regenscheid indicates via letter there is a
goose overpopulation and resultant property damage in the vicinity of The
Wilds; and
WHEREAS, the City Council finds the overpopulation of Canada geese in this portion of the
City of Prior Lake creates potential health, safety and general welfare
problems; and
WHEREAS, the City Council authorizes a special hunting season to hunt Canada Geese, on
the private property described herein.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF PRIOR LAKE,
that pursuant to City Code Section 10-4-3(0), it hereby authorizes a special hunt for Canada
Geese on the property legally described herein subject to the following conditions:
1. Discharge of firearms for the sole purpose of hunting Canada geese take place only upon
Outlots B, D, F, G, K, M, N, 0, Q, R, T, U, V, W, X, Y, Z, AA, BB, The Wilds.
2. The property be posted indicating the date and time discharge of firearms will occur. The
posting of signs shall be required at all entrances to The Wilds, all entrances to residential
subdivisions as well as the entrance driveway to the temporary clubhouse. Said signs shall
be posted for at least 48 hours prior to the discharge of any firearm.
3. All residents, owners, association members be notified in writing of the date, time, location,
and purpose of the hunt. Said notification shall be mailed at least three days prior to the
discharge of any firearm.

4. The applicant shall provide documentation, to the satisfaction of the City Attorney, that the
City of Prior Lake shall assume no responsibility for any damages or injuries which may
occur as a result of the special hunt or discharge of firearms.
5. Persons permitted to participate in the special hunt shall hold a valid hunting license, issued
by the Minnesota Department of Natural Resources.
6. Persons permitted to participate in the special hunt shall be limited to Gaylen B. Allen, Jay
A. Schroeder, Richard K. Burtness and Eric Jon Stack.

ORDINANCE NO. 95-12
AN ORDINANCE AMENDING SECTION lO-4-3(c) OF PRIOR LAKE CITY CODE.
The City Council of the City of Prior Lake does hereby ordain:
Section lQ-4-3(C) of Prior Lake City Code is hereby amended to read as follows:
(C) Platted Portions of the City: Except as provided in Section 10-4-3(D), the discharge of a firearm in
any platted portion of the City shall be prohibited for purposes of hunting or target practice.
(0) Special Hunts:
1. The discharge of a firearm in a platted portion of the City will be pennitted by a person
participating in a special hunt during regular seasons, which is in compliance with state law
and regulations and established by the Prior Lake City Council upon the recommendation of
the Department of Natural Resources, for the purpose of reducing animal populations that
create potential health, safety or general welfare problems in the City.
2. The Prior Lake City Council, on its own resolution, may authorize a special hunt in
compliance with Section 1 0-4-3 (D) 1., or a property owner may make application to the Prior
Lake City Council to authorize a special hunting season on such property owner's land. Each
application from a property owner requesting a special hunting season shall specify the full
name, residence address and telephone number of the applicant, a description of the platted
portion of the City where the special hunt would be held and evidence of ownership, the type
of animal or bird to be hunted and the reason(s) a special hunt is being requested. Each
application shall be accompanied by payment of a fee as detennined by the City Council. The
City Council, in its discretion, may thereafter authorize a special hunt pursuant to such an
application when, based upon competent professional advise from an Area Wildlife Manager
with the Department of Natural Resources, a season is needed to reduce an animal population
that creates potential health, safety and general welfare problems in the City. No person shall
make a false statement in any application.
This ordinance shall become effective from and after its passage and publication.

This letter is a request for the City of Prior lake to consider
allowing The Wilds golf course to have individuals discharging
firearms in this platted portion of the city during the early metro
goose season(Sept. 2-11th), the regular waterfowl season(as yet
undetermined) and/or a late December season(as yet undecided), as
provided for in ordinance no. 95-12. Allowing weapons discharge in
this area will allow the course additional means to address the
problems of an overpopulation of local canada geese and their
impacts to the course. We are currently addressing goose
depredation problems on The Wilds golf course. One of my
recommendations, provided it was not against City ordinance, was to
increase the hunting pressure on the geese in this area. Thank you

REASON FOR APPUCATION
We are proposing to hunt geese on the golf course property and non-developed outlots.
Our failways are bent grass, a delicacy for geese. They can consume large quantities of
grass each day, causing several thousand dollars of damage.
Further, their droppings are highly acidic and burn out areas of our fairways and greens.
It is our intention by allowing this special hunting season to reduce or eliminate this
problem.

The following is a supplement to our application.
Attached are 4 DNR applications. These are the individuals we wish to participate in the
goose hunt. Weare asking for your assistance on Mystic Lake, as it has a public access.
We do not want other hunters shooting on the Lake or our property.
The hunt will take place either before or after the golfing sessions. Our home owners will
be notified by letter of the hunt . We will be using only light load shells. It is our intention
to scare off as many geese as possible, rather than kill them. all.
