AUGUST 21, 1995 The purpose of this item is to consider proposed Ordinance 95-14 which amends the B-P I Business Park standards of the Zoning Ordinance to permit accessory buildings. See attached Planning Report dated August 14, 1995 for reference to this item. The proposed Ordinance amendment was drafted in part to respond to the Public Works/Parks Maintenance Facility site plan and Conditional Use Permit, CUP. The site plan for the maintenance building indicates a proposed detached accessory building to house salt and sand. The exterior of the building cannot be constructed of similar materials as the principal maintenance building because of the corrosive nature of salt. The B-P regulations allow for the construction of certain accessory uses but are not clear regarding the type of structures permitted to house the accessory uses. The B-P regulations do not currently provide for an alternative to using similar exterior materials as the principal building. Due to the issues related to the salt and sand storage building, proposed Ordinance 95-14 allows for the option to screen the accessory building in cases where the exterior materials are not similar to those on the principal building. The Planning Commission held a public hearing to consider Ordinance 95-14 on August 14, 1995. The Commissioners discussed the Ordinance at great length and recommend its approval. ALTERNATIVES: 1. Adopt Ordinance 95-14 as presented. 2. Place Ordinance 95-14 on the consent agenda for final approval at the September 5, 1995 meeting. 3. Direct staff to make changes to Ordinance 95-14 as per Council discussion. RECOMMENDATION: Alternative #1 or 2. ACTION REQUIRED: A motion as part of the consent agenda to approve Ordinance 95-14, establishing acces buildings as a permitted use in the ~es ark ing District. Reviewed By: CITY OF PRIOR LAKE ORDINANCE NO. 95-14 AN ORDINANCE AMENDING SECTION 5-5-14(E) OF PRIOR LAKE CITY CODE AND AMENDING SECTION 6.15E. OF PRIOR LAKE ZONING ORDINANCE 83-6. The City Council of the City of Prior Lake does hereby ordain: Section 5-5-14(E) of Prior Lake City Code and Section 6.15E. of Prior Lake Zoning Ordinance 83-6 are hereby amended to read as follows: City Code Section 5-5-14(E) and Zoning Ordinance 83-6, Section 6.15E are hereby amended to add item 5. as follows: 5. Accessory Building subject to the following conditions: a. The accessory building shall be either constructed of the same materials as the principal structure or screened from view from adjacent properties and/or roadways. In the event that an accessory building is not constructed of the same materials as the principal structure, the accessory building shall be totally screened from public view from adjacent roads and contiguous properties. The screening must meet all applicable zoning standards. b. The maximum area of an accessory building shall not exceed 150/0 of the total area of the principal structure. c. The accessory building must be located in the rear yard of the subject site and conform to all applicable setback requirements. However, no accessory building shall be located in the yard adjacent to a County Road or Collector Street. City Code Section 5-5-14(H) and Zoning Ordinance 83-6, Section 6.15H Design Standards in the BP District, are hereby amended as follows: H. DESIGN STANDARDS IN THE BP DISTRICT: ''Z09S0600'' 1. Building Materials. Exterior building materials of all structures (except accessory buildings screened from view per item E.5. of this Section,) shall be one of, or a combination of, the following: 2. Additions and Alterations and l\eeessery Struetw"es. All subsequent additions and exterior alterations ana aeeessery stnlemres built after the construction of the principal structure(s) shall be of the same materials as those used in the principal structure and shall be designed to conform to the original architectural concept and general appearance. This provision shall not prevent the upgrading of the quality of materials used in a remodeling or expansion project. 3. Other Structures. Accessory Buildings, screen walls, exposed areas of retaining walls, signs, supporting structures and other areas of exposed permanent materials shall be of a similar type, quality and appearance as the principal structure, (except accessory buildings screened from view per item E.5. of this Section.). This provision shall not prevent the upgrading of the quality of materials used in a remodeling or expansion project. This ordinance shall become effective from and after its passage and publication. N/A DEB GARROSS, ASSISTANT CITY PLANNER _X_ YES _NO-N/A AUGUST 14, 1995 INTRODUCTION: The purpose of this item is to consider an amendment to Zoning Ordinance 83-6 to permit accessory buildings to be constructed within the B-P, Business Park zoning district. A copy of the draft Ordinance amendment is attached to this report. The proposed language is indicated in bold letters on the Ordinance 95-14 draft. BACKGROUND: The B-P, Business Park regulations were added to the Zoning Ordinance in 1993. The standards apply to the Waterfront Passage Business Park land located south of CR 21 and east of Fish Point Road. Since adoption of the B-P regulations, two applications for development in the Business Office Park have contemplated use of accessory buildings. One developer desired to build an accessory building to house wood supplies. Most recently, the City of Prior Lake requested a Conditional Use Permit, (CUP), including a proposed accessory building for salt and sand storage. Unfortunately, the B-P standards did not contain the appropriate provisions to permit accessory buildings. Staff is of the opinion the omission of accessory building language was inadvertent by the consultant who prepared the Ordinance. DISCUSSION: The existing language in the B-P District is somewhat unclear. For example a number of accessory uses are permitted yet there are no regulations permitting buildings to house such accessory uses. In addition, there is some inconsistency between Section 6.15E. Accessory Uses and 6.15H. Design Standards for the B-P District. Section 6.15E. allows for Accessory Uses such as parking lots; parking structures; trash enclosures; radio transmitters, towers; and outdoor display of products as accessory uses. There is no reference regarding the allowance of accessory buildings. Yet, Section 6.15H3, Design Standards indicates other structures such as "garages" shall be of similar materials as the principal structure. Specifically, one accessory building is permitted per lot provided it is constructed of the same materials as the principal structure or screened from view from adjacent properties and/or roadways. The maximum area of an accessory building shall not exceed 15% of the total area of the principal structure. All accessory buildings must be located in the rear yard of the subject site and conform to all applicable setback requirements. It is the opinion of staff that accessory buildings were intended to be permitted in the B-P Zone due to the inclusion of the "garage" language. The proposed amendment broadens the term to accessory building to permit uses other than vehicle storage. ALTERNATIVES: 1. Recommend the City Council adopt Ordinance 95-14 as written or with changes directed by the City Council. 2. Recommend the City Council not adopt Ordinance 95-14 for specific reasons. RECOMMENDATION: Alternative # 1. ACTION REOUIRED: A motion to recommend the City Council adopt Ordinance 95-14. A separate motion to close the public hearing is required. Z006PC.DOC 2
