INTRODUCTION:
The purpose of this agenda item is to set the hearing date
for the assessments to the Creekside Circle and Ridgemont
Avenue improvement projects. Council is also requested to
approve the preparation of the assessment roles for these
projects as well.
BACKGROUND:
The date for the proposed assessment hearing is September
18, 1995. The assessment hearing was originally scheduled
on June 19, 1995 and was not conducted due to a faulty
mailing notice. The notice for the June 19 hearing was sent
out prior to the bid opening. The following rates were
provided at the Public Hearings for the projects:

The frrst hearing notice used the Public Hearing rates for
Ridgemont Avenue, and a 5% increase for Creekside
Circle. The assessment rate for Creekside Circle was
increased by 5% per linear foot from the Public Hearing
rate in anticipation of a higher bid amount because of the
addition of curb and gutter to both sides of the street.
Residents were informed of this change at an informational
meeting. The bid amount was 5% over the Public Hearing
rate. The proposed assessment rate per lineal foot for
Creekside Circle is $37.64.
The bid for the Ridgemont Avenue project was lower than
the estimate as it was bid in a group of projects and the
City, in effect, benefited from a volume discount. This
favorable bid was offset by a change order adding $30,700
worth of street grading and materials to improve the
sub grade of Ridgemont Avenue. The proposed assessment
rates include $6.70 per lineal foot for the cost of the
additional sub grade correction. The net adjustment reflects
a lowering of ~e total assessment to 84% of the
preliminary estimate.
The Ridgemont Avenue project has an area which had
sewer and water previously installed. This area will be
assessed based on the assessment policy, 60% of the cost
will be paid by the residents and 40% will be paid for by ad
valorem tax levy. The second area did not have sewer and
water and is assessed at 100%. Lakefront Park has 964 feet
of frontage abutting Ridgemont Avenue. The City is
paying its share of the subgrade correction, sewer, water
and paving costs as are other benefiting properties. The
Lakefront Park's share of the assessment is $97,036 and
this assessment cost is being paid out of the Trunk Reserve
Fund.
The assessment rates per foot are determined by dividing
the costs for the improvements for each area by the amount
of the assessable footage available on both sides of the
street in each area. The City will fund its share of the cost
of Lakefront footage through the Trunk Reserve Fund. The
40% portion of the street overlay will be paid through the
ad valorem tax levy.

The following is a summary of costs for Ridgemont
Avenue as requested by the Mayor.

*The 1824 assessable feet include 964 feet for Ridgemont
Avenue or $97,036 which is paid from the Trunk Reserve
Fund.
The rates for Ridgemont Avenue compare favorably to
previous projects. The rate for the Prior South project 94-
01 is $54.47. The proposed rate for the Northwood Road
project 94-02 was $54.47. Both of these projects are street
reconstruction projects. The North Shore Oaks project 90-
13, which included sewer, water and street was assessed at
$101.80.
Attached are Resolutions 95-76 and 95-77 setting the
hearing date for Ridgemont Avenue and Creekside Circle
for the September 18, 1995 Council meeting.
Attached are Resolutions 95-78 and 95-79 declaring the
costs to be assessed for Creekside Circle and Ridgemont
Avenue.
The alternatives are as follows:
1. Approve resolutions 95-76 and 95-77 setting the
hearing dates for Creekside Circle and Ridgemont
Avenue.
2. Approve resolutions 95-78 and 95-79 declaring the
costs to be assessed for Creekside Circle and
Ridgemont Avenue.
3 Deny these items for a specific reason

RECOMMENDATION: The recommendation is Alternatives No.1 and 2 approving
the resolutions.
FINANCIAL IMPACT: The project costs will be recouped from the Trunk Reserve
Fund ad valerum tax levy and assessments.

RESOLUTION FOR HEARING ON PROPOSED ASSESSMENT FOR
RIDGEMONT AVENUE STREET IMPROVEMENT PROJECT 95-01

WHEREAS, by a resolution passed by the Council on May 15, 1995, the City Manager was directed to
prepare a proposed assessment of the cost of improvements for Proiect 95-01. and
WHEREAS, the City Manager notifies the Council that such proposed assessment will be completed
and filed in his office for public inspection.
NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY COUNCIL OF PRIOR
LAKE, MINNESOTA:
1. A hearing shall be held on the 18th day of September, 1995 in City Council
Chambers at 8'30 PM. to pass upon such proposed assessment and at such time and
place all persons owning property affected by such improvement will be given the
opportunity to be heard with reference to such assessment.
2. The City Manager is hereby directed to cause a notice of the hearing on the proposed
assessment to be published once in the official newspaper at least two weeks prior to
the hearing, and he shall also cause mailed notice to be given to the owner of each
parcel described in the assessment roll not less than two weeks prior to the hearing.
3. The owner of any property so assessed may, at any time prior to certification of the
assessment to the County Auditor, pay the whole of the assessment on such property,
with interest accrued to the date of payment, to the City Finance Director, except that
no interest will be charged if the entire assessment is paid within 30 days from the
adoption of the assessment. He may, at any time thereafter, pay to the City Finance
Director the entire amount of the assessment remaining unpaid, excepting the
installment portion appearing upon the current year's property tax statement.

RESOLUTION DECLARING COSTS TO BE ASSESSED AND
ORDERING PREP ARA nON OF PROPOSED ASSESSMENT FOR
PROJECT 95-01 RIDGEMONT AVENUE STREET IMPROVEMENTS

WHEREAS, an Engineer's Estimate has been prepared and costs have been determined for the
improvements of Project 95-01 and the estimated contract price for such improvements is
$191 220.08, and the estimated expenses incurred or to be incurred in the making of such
improvement amount to $57 366 02, so that the total cost of the improvement will be
$265 946 10 This total includes a trunk acreage charge of $17 360 to recover trunk sewer
and water expenditures.
NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY COUNCIL OF PRIOR
LAKE, MINNESOTA:
1. The portion of the cost of such improvement is to be paid by the City's Ad Valorem
Tax Levy and Trunk Reserve is hereby declared to be $26 000 67 and $97 036 00
respectively, and the portion of the cost to be assessed against benefited property
owners is declared to be $142.90943
2. Assessments shall be payable on an equal principal installment method extending
over a period of .lQ years. The first installment shall be the annual principal plus
interest calculated from the public hearing date to the end of this year plus twelve
months of the next year and shall bear interest at the rate of a minimum of lli,.per
annum from the date of the adoption of the assessment resolution.
3. The City Manager, with the assistance of the City Engineer shall forthwith calculate
the proper amount to be specially assessed for such improvement against every
assessable lot, piece or parcel of land within the district affected, without regard to
cash valuation, as provided by law, and he shall file a copy of such proposed
assessment in his office for public inspection.
4. The City Manager shall upon the completion of such proposed assessment, notify the
Council thereof.

$125.900.00, and the estimated expenses incurred or to be incurred in the making of such
improvement amount to $37.800.00, so that the total cost of the improvement will be
$163.700.00.
NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY COUNCIL OF PRIOR
LAKE, MINNESOTA:
1. The portion of the cost of such improvement is to be paid by the City's Ad Valorem
Tax Levy and is hereby declared to be $65 500 00. and the portion of the cost to be
assessed against benefited property owners is declared to be $98 200 00
2. Assessments shall be payable on an equal principal installment method extending
over a period of .l.Q years. The first installment shall be the annual principal plus
interest calculated from the public hearing date to the end of this year plus twelve
months of the next year and shall bear interest at the rate of a minimum of lli per
