The purpose of this item is to consider a minor amendment, or
change to the preliminary plat of Wilderness Ponds. The City
Council approved the preliminary plat on March 20, 1995 subject to
the conditions outlined in Resolution 95-17. The developer was
requested by staff, to submit an amendment to the preliminary plat
related to park dedication and right-of-way width for proposed
Wilderness Trail. A copy of the proposed preliminary plat
amendment as well as a copy of the approved preliminary plat and
Resolution 95-17 are attached for your information.
Subdivision Ordinance 87-6, Section 6-3-3B3, provides the City
Council the discretion to review proposed amendments to an
approved preliminary plat and states: "If the City Council
determines that the scope of the revisions do not constitute a new
plat, the Council can order the preliminary plat amended to reflect
the revisions with no additional fees charged." In the event the
Council determines the scope of the revisions do constitute a new
plat, the developer must reapply for preliminary plat review by both
the Planning Commission and City Council.
Director of Parks and Recreation, Paul Hokeness reviewed the initial
land and park dedication for the preliminary plat of Wilderness
Ponds as well as the proposed trail locations. The approved
preliminary plat indicates park land dedication around a portion of
Blind Lake where a proposed trail was to be installed. Upon site
inspection, Paul Hokeness found the installation of a trail in the
proposed location would be nearly impossible due to steep slopes
and a large number of trees that would have to be removed to
accommodate a trail. In addition, the wetland within the park
located southwest of the intersection of Blind Lake Trail and Fish
Point Road prohibits installation of a ball field as originally
intended.

ALTERNATIVES:
negotiated a revised park dedication for the preliminary plat which
is outlined on the attached letter to developer, Mike Giles, dated
August 24, 1995. The revised park dedication changes the approved
preliminary plat layout in that it adds one additional lot adjacent to
the lake shore of Blind Lake; removes park land from the perimeter
of Blind Lake; increases the right-of-way width for proposed
Wilderness Trail in order to accommodate a sidewalk, which would
replace the lake shore trail; and allows the rear lot lines of all
proposed lake shore lots to be extended out into the lake bed of
Blind Lake. (Blind Lake is an "Un-Meandered" lake which means
the water is considered public, however the lake bed is privately
owned and can therefore be platted).
The issue under consideration by the City Council is to determine
whether or not the proposed changes to the park land dedication,
addition of one lot, and change in right-of-way width for Wilderness
Trail can be made via adoption of Resolution 95-93 or if the change
requires review and recommendation by the Planning Commission.
Staff is of the opinion the Council may adopt Resolution 95-93 as
written or with changes recommended by the Council. The
proposed amendment to the preliminary plat is a result of staff
recommending alternative park dedication and development. The
developer has agreed to the changes in the land dedication and will
install trails, a picnic shelter/rest area beside the trail on Outlot C, a
bituminous basketball court on Outlot A, additional landscaping for
the parks with in the subdivision; install a landscaped comer
monument sign with a park sign incorporated thereon, finish grading
of park land, install a 5' concrete sidewalk on the east side of
Wilderness Trail, procure the necessary trail easement to enable
access to The Ponds Athletic Complex, as well as provide the City
with $5,000.00 for the purchase of play equipment for parks within
the subdivision.
1. Adopt Resolution 95-93 approving a minor amendment to the
preliminary plat of Wilderness Ponds described therein.
2. Pull this item from the consent agenda for discussion.
3. Deny the proposed amendment to the preliminary plat of
Wilderness Ponds.

RESOLUTION PROVIDING FOR AN AMENDMENT TO THE PRELIMINARY
PLAT OF WILDERNESS PONDS.

WHEREAS, The City Council approved the preliminary plat of Wilderness Ponds on
March 20, 1995 subject to the conditions outlined in Resolution 95-17;
and
WHEREAS, the preliminary plat of Wilderness Ponds is proposed to be amended to
change the park dedication, add one single family lot, and widen the
right-of-way of proposed Wilderness Trail; and
WHEREAS, Subdivision Ordinance 87-6, Section 6-3-3B3, provides the City Council
may determine the scope of proposed revisions do not constitute a new
plat, and thereby order the preliminary plat be amended to reflect the
revisions; and
WHEREAS, the City Council determined the proposed changes outlined herein, do not
constitute a new plat.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF PRIOR
LAKE, that it hereby orders the preliminary plat of Wilderness Ponds be amended
as per attached Exhibit A.
BE IT FURTHER RESOLVED BY THE CITY COUNCIL OF THE CITY OF
PRIOR LAKE, MINNESOTA that it should and hereby does require the following
conditions to be met:
1. All preliminary plat maps and construction plans be revised to indicate the approved
amendments.
2. All documents be labeled "Wilderness Ponds, Amended Preliminary Plat" and dated
September 18, 1995.
3. 5 complete large scale sets of all plans and 1 set reduced to 11" x 1 7" be submitted

Dear Mike,
Following our discussions on Friday August 16, 1995, you and I agreed that you would
retain the previously proposed park property adjacent to lot number 13 on Outlot Band
also the property along the shoreline of Blind Lake. In exchange for this property you
would provide the following items at no expense to the City:
1. Install an 8' bituminous trail from County Road No. 21 to Blind Lake Trail.
This would be in Outlot C. (See attached copy of the plat for Wilderness Ponds). This
trail would be approximately 1000 ft. in length. The trail will be constructed according to
City specifications.
2. Construct a picnic shelter/rest area beside the trail on Outlot C. This shelter
would have a concrete floor and hard surface connection to the trail. The pad size should
be a minimum of 16' x 16' to accommodate a picnic table. The shelter will be
constructed according to City specifications and be comparable to the shelter shown in
the attached example.
3. Construct a 50' x 55' bituminous basketball court on the park property on Outlot
A. The City will stake the location after the park has been graded. The court will be
constructed according to City specifications. The City will be responsible for installing
the standard and backboard and striping the court.
4. Provide a mixture of conifers and deciduous trees for landscaping the park in
Outlet A. The quantity and size of the trees would be determined by you and I at a later
date. (You said that you had many trees available and I would be more than happy to
assist you in the landscape design and planting.)

5. Install a landscaped comer monument sign on the comer of Blind Lake Trail and
Fish Point Road. The park sign would be incorporated within this
landscaping/m.onument.
6. Finish grade the park property on Outlot A according to the City's specifications
and provide a minimum of 4" of good quality topsoil. The elevation should match that of
Lot #1 in Block 1 and the sidewalk on Blind Lake Trail.
7. Provide the City with $5,000.00 for the purchase of play equipment.
8. Acquire the easement from the neighbor adjacent to lot # 1 in Block 2 so that the
City may install an 8' bituminous trail-leading into The Ponds Park.
9. Install a 5~ concrete sidewalk on the east side of Wilderness Trail from Blind Lake
trail to the end of lot #22.
These provisions will be included in the development agreement for Wilderness Ponds.
Please sign one copy of this letter and return to me as confirmation of your acceptance of
this agreement.

RESOLUTION OF THE PRIOR LAKE CITY COUNCIL TO APPROVE THE PRELIMINARY PLAT
OF "WILDERNESS PONDS."

WHEREAS, the Prior Lake Planning Commission conducted public hearings on the 27th day of February,
1995, to act on an application submitted by Wilderness Ponds Development to approve the
preliminary plat, rezoning and variances requested for "Wilderness Ponds"; and
WHEREAS, notice of the public hearings on said motions have been duly published and posted in accordance
with the applicable Minnesota Statutes; and
WHEREAS, the Planning Commission heard testimony from the applicant, the public, City staff and other
interested persons; and
WHEREAS, the Planning Commission found that the preliminary plat of "Wilderness Ponds" is consistent
with the Comprehensive Plan; and
WHEREAS, the Planning Commission approved cul-de-sac length variances described in items 1 and 2 below;
and
WHEREAS, The City Council held a hearing on March 20, 1995 to act on an application submitted by
Wilderness Ponds to approve the preliminary plat.
NOW, THEREFORE BE IT RESOLVED, BY THE CITY COUNCIL OF THE CITY OF PRIOR LAKE,
MINNESOTA, that it hereby approves the preliminary plat of "Wilderness Ponds" subject to the following
conditions and Exhibits attached hereto:
1. The grant of a 540' cul-de-sac length variance from the 500' maximum requirement for proposed
"Windsor Lane. "
2. The grant of a 550' cul-de-sac length variance from the 500' maximum requirement for proposed
"Wilderness Trail."
3. The rezoning of approximately 8 acres of land located in the southeast part of the plat, from C-l,
Conservation to R -1, Suburban Residential.
4. Dedication and improvement of park land as per Director of Parks and Recreation, Bill Mangan, (Exhibit
A, memo dated 2-22-95).
5. The comments outlined in the attached memorandums from Engineering Staff, (Exhibits B and C), be
addressed by the Developer.

6. Developer be responsible to complete the connection to Blind Lake Trait located west of the plat
boundary.
7. Developer provide any oversizing of sanitary sewer, water, depth of sanitary sewer or other requirements
to serve a potential annexation area located south of the plat. Costs associated with oversizing to be
reimbursed to the developer as per City policy.
8. A specific plan should be provided that indicates areas of land disturbing activity along with a restoration
plan. The plan should indicate the location and species of significant trees on site, defmed as hardwood
species, 12" or larger in caliper, and mitigative measures proposed to protect the significant trees.
9. The developer resolve the C.R. 21, 25' road right-of-way dedication issue with Scott County, acceptable
to the City Engineer.
10. Proposed covenants establishing the responsibility for the maintenance of the signs over the entire project,
be submitted prior to final plat, subject to review and acceptance of the City Attorney.
11. That all necessary permits and approvals from other local, state and federal government agencies be
obtained by the Developer which are required due to the development.
12. The ordinary-high-watermark for Blind Lake be determined and/or accepted by the DNR.
13. The paving of Wilderness Trail to be terminated ten fet north of the south property line.

FEBRUARY 21, 1995
Deb, I have reviewed the revised preliminary plat for Wilderness Ponds and I
have determined the following findings:
1. The sidewalk is acceptable as shown on the plat along Blind Lake Trail;
2. There is a need for a minimum of 25 feet along Blind Lake between the
wetland and the back of property lines. This can be accomplished via
trail easements along Lots 7, 8, and 9, Block 2, as it appears that there
is not enough width to construct a trail;
3. The access to Outlot A from Wellington Court will be sufficient to get to the
parkland. However, there needs to be access provided to the south
next to Lot 1, Block 5 in order to have public access to that area as
well;
4. The minimum of 150 feet of street exposure to Blind Lake has not been
met. An additional 20 feet needs to be acquired between Lot 13, Block
2 and Lot 1, Block 4;
5. Trails will be installed by the developer and reimbursed by the Capital
Park Fund at designated locations in Outlot B and Outlot D;
6. A Neighborhood Park will exist on Outlot C. The developer has agreed to
grade the Outlot acceptable to the Parks Department as well as
provide up to $5,000 for the purchase of play equipment for the site
which will be installed by the Parks Department. The ball field and the
shelter will be constructed ty the Parks Department.

This is a list of items that have been found delinquent per the preliminary plat review.
Comments per Lani Leichty, Water Resources Coordinator.
1. The storm sewer profile from CB-3 to MH-1 should also show the profile connecting to
existing structure. The storm profile from Wetland #2 to CB-5 and other culvert profiles
should be shown.
2. Drainage Items: Per Ord. 6-4-3:(N)2.
(A) The emergency overflow route must be shown on the rear yard catch basin
location in Block 3. Adjacent house pads should be 2' above the emergency
overflow elevation. Please consider removing this CB altogether.
(8) The pad on Block 4, Lot. 1 needs to be set 3' higher than the 100-yr HWL of Blind
Lake.
(C) An 1111 x 1711 map showing existing drainage boundaries showing the numbering
scheme for the. existing conditions should be submitted.
(D) It appears that Wetland #2 has not been routed through Sediment Basin #3 from
the proposed routing schematic and calculations. The current HWL in Sediment
Pond #3 is higher than the HWL of Wetland #2. This needs to be looked at in
further detail.
Comments per Ken Sherman:
1 . The developer will be responsible for completing the connection between Cottonwood
Trail outside of the plat. Revise all sheets to show this.
2. Show the access routes to sediment ponds 1 and 2. Maximum grade for the routes is
100/0 with a 20/0 cross slope.
3. Lots 20-25, Block 5, would require drainage easements across the rear lots with the
current proposed contours, per subdivision ordinance.
4. Show access route to sediment pond #3.
5. Realign MH 15A so that the pipe between CB 158 and MH 15A is centered on the
easement.
6. The city will look at the service area to the South to see if extra depth and oversizing is
needed on the Wilderness Trail sanitary sewer.

FEBRUARY 21, 1995
Engineering has reviewed the preliminary plat plans received February 15, 1995, which have a
revised date of February 10, 1995, for city comments. Most of the items in the engineering staff
review memo dated February 15, 1995 have been addressed. Outstanding issues remaining
are:
1. Submission of an 111x17" map showing existing drainage boundaries and numbering
scheme of the existing conditions.
2. Revisions are needed to show that the developer will be responsible for completing the
connection to Cottonwood Trail outside the plat.
3. The city needs to look at the proposed annexation area south of the plat for street and
utility extensions along Wilderness Trail and Crimson Court. Any oversizing of sanitary
sewer or water and extra depth of sanitary sewer would need to be coordinated with this
plat, and the developer reimbursed per city policy.
We have attached a sketch showing, in a general sense, what is of concern immediately to the
south plat line.

Outlot A Waterfront Passage Addition (PIN number 25 296 005 0) is proposed to be replatted into
Wilderness Pond Addition. This area has been served with City municipal utilities under Proj. 93-11 and
charged the following assessment:
Trunk Sewer & Water Charge:
55.3 acres @ 2750.00/acre = $152,075.00
Lateral Sewer & Water Charge:
3428' @ $20.00/FF = $68,560.00 (water)
150' @ $40.00/FF = $6,000.00 (sewer)
According to "Exhibit D" of the Contract for Deed for the purchase of the Business Office Park site from
the Adelmann Estate, this assessment total of $226,635.00 is deferred until the property is developed or
for a period of ten years from August 16, 1993, whichever is earlier. Interest shall accrue at 8% per annum
and shall also be subject to the above stated conditions.
Since utilities are available to the property site, the cost for the extension of services internally will be the
responsibility of the developer. In addition to these improvement costs, the subdivision will be subject to
the following City charges outlined below:
Stormwater Management Fee
Collector Street Fee
16.8 cents/sq. ft.
$1500.00/acre
The application of these City charges would generate the following costs to the developer based upon a
net area lot calculation of 38.54 acres of single family lots (1,678,811 square feet) as provided within the
site data summary sheet of the preliminary plat description:
Storm Water Management Fee:
1,678,811 sf @ 16.8/sf = $282,040.00
Collector Street Fee:
38.54 acres @ $ 1500.00/ac = $57,810.00
These fees represent an approximate cost of $3650.00 per lot for the 93 proposed lots within Wilderness
Ponds Addition. Assuming the initial net lot area of the plat does not change, the above referenced storm
water, collector street and deferred lateral and trunk water and sewer charges would be determined and
collected within the context of a developer's agreement for the construction of utility improvements at the
time of final plat approval.
There are no other outstanding special assessments currently certified against the property. Also, the tax
status of the property is current with no outstanding delinquencies.
