The purpose of this item is to consider an amendment to the Sign
Ordinance Section 5-7 -6G related to signs accessory to Conditional
Uses. Specifically, the proposed amendment suggests sign area,
illumination, height and setback requirements for signs for conditionally
permitted uses.
The City's Sign Ordinance does not contain specific criteria for the
regulation of signs for conditionally permitted uses. Fairview Clinic is
an example of a CUP application for which identification signs have
been requested. To further complicate the issue, Fairview Clinic is a
business type of use located in a R-1, Suburban Residential Zoning
District. Signs have the potential to create distractions, glare and
clutter which can negatively impact residential areas.
Sign ordinances do not typically permit business use signage in
residential zones. Staff reviewed sign ordinances from 21
communities. Two of the ordinances included general language similar
to the Prior Lake Ordinance, wherein a staff member or the Planning
Commission have the authority to apply the most applicable sections of
the Ordinance for the particular zoning district in which the use is
located. (Apple Valley, for Planned Development Districts; White Bear
Lake for residential zones).
Six communities specifically addressed commercial type signs within
residential or mixed use zoning districts as indicated on Table I on the
following page. The maximum sign area permitted ranges from 6 to 80
square feet. Of the 21 community sign ordinances surveyed,
approximately one third contained some regulation for commercial type
signs within residential zoning districts. Typically setbacks range from
5 to 1 0 feet.

Upon review of the various land uses listed as CUP's in the Zoning Ordinance for residential
zoning districts, staff prepared 2 draft ordinances for the Planning Commission to consider. The
Planning Commission concluded that the second alternative (a draft of which is attached) best
addressed the need for signage for conditionally permitted uses.
ALTERNATIVES:
1. Adopt the attached Ordinance as presented and recommended by the Planning
Commission or with changes.
2. Continue or table this issue for specific reasons.
3. Determine that there is no need to amend the Sign Ordinance and deny the attached
Ordinance.

AN ORDINANCE AMENDING SECTION 5-7-6(G) OF PRIOR LAKE CITY CODE AND PRIOR
LAKE SIGN ORDINANCE 94-06.
The City Council of the City of Prior Lake does hereby ordain:
Section 5-7-6(G) of Prior Lake City Code and Sign Ordinance 94-06 are hereby amended to read as
follows:
(G) Signs Accessory to Conditional Uses. Signs for uses which are classified as Conditional Uses by
the Zoning Ordinance, and are located within a Business or Industrial Zoning District, shall be
subject to Section 5-7-7 of this Ordinance.
Signs for uses which are classified as Conditional Uses by the Zoning Ordinance, and are located in
a Residential Zoning district, may have sign(s) provided the total number and area of said sign(s)
do not exceed maximum standards for the B-1, Limited Business Zoning District identified in
Section 5-7-7 of this Ordinance. The Planning Commission may assign conditions of approval and
limit the size, number, location and type of signage in the event it determines the proposed sign(s)
are not compatible with the existing and planned development in the vicinity of the subject site and
underlying Zoning District.
This ordinance shall become effective from and after its passage and publication.
