HomeMy WebLinkAbout6B Brewpub Ord Amend Report 4646 Dakota Street SE Prior Lake, MN 55372 PLANNING COMMISSION AGENDA REPORT MEETING DATE: FEBRUARY 16, 2016 AGENDA #: 6B PREPARED BY: PRESENTED BY: PUBLIC HEARING: DAN ROGNESS, COMMUNITY & ECONOMIC DEVELOPMENT DIRECTOR DAN ROGNESS NO AGENDA ITEM: CONSIDERATION OF A REQUEST TO INITIATE THE REVIEW OF AMEND- MENTS TO THE PRIOR LAKE CITY CODE RELATED TO BREW PUBS, SMALL BREWERIES AND MICRODISTILLERIES DISCUSSION: Introduction The purpose of this agenda item is to consider a request for the Planning Com- mission to initiate the review of amendments to the Prior Lake City Code related to brew pubs, small breweries, microdistilleries and similar uses. Current Circumstances Although city staff does not believe a brewery project is imminent, staff has re- ceived two inquiries related to small breweries and tap rooms in the City of Prior Lake over the past two years. The City of Prior Lake Zoning Ordinance does not currently address small breweries, tap rooms, brew pubs or microdistilleries. The recent popularity of small breweries and microdistilleries in Minnesota and the development of these uses in neighboring com munities has led staff to be- lieve an ordinance amendment may be beneficial so the city is better positioned to respond to this type of inquiry in the future. Conclusion Subsection 1108 500 of the Zoning Ordinance states the City may either by its own initiative or by petition of a property owner consider amendments to the formal text of the ordinance Amendments to the ordinance may be initiated in one of four ways:  The Planning Commission may initiate the review of such amendments by motion.  The City Council may on its own motion initiate amendments by referring them to the Planning Commission for review.  Any property owner may formally petition the City to consider an amendment to the Official Zoning Map for land for which he she is property owner.  Any individual may petition the City to consider an amendment to the formal text of this Ordinance City staff recommends the Planning Commission initiate the review of amend- ments to the Prior Lake City Code related to brew pubs, small breweries and microdistilleries. 2 ISSUES: Any potential amendments to the City Code which would allow small breweries, microdistilleries, brew pubs and similar uses within specific zoning use district as a permitted use, use permitted with conditions or as a use permitted by condi- tional use permit would also require amendments to the City of Prior Lake’s Of- ficial Fee Schedule. ALTERNATIVES: 1. Motion and a second to initiate the review of amendments to the Prior Lake City Code which may be necessary to allow brew pubs, small breweries, mi- crodistilleries and similar uses in the City of Prior Lake. 2. Provide direction to staff and continue discussion at a future meeting. RECOMMENDED MOTION: ATTACHMENTS: Alternative #1 Article about Savage ordinances.
