Prior Lake, MN 55372-1714 MEETING DATE: AGENDA #: PREPARED BY: AGENDA ITEM: INTRODUCTION: DISCUSSION: CITY COUNCIL AGENDA REPORT JUNE 6, 2005 10D DANETTE MOORE, PLANNING COORDINATOR CONSIDER APPROVAL OF AN ORDINANCE AMENDING THE ZONING MAP FOR PROPERTY LOCATED AT 4151 WILLOWWOOD STREET SE (FAIRVIEW MEDICAL CLINIC) FROM LOW DENSITY RESIDENTIAL (R-l) TO NEIGHBORHOOD COMMERICIAL (C-l). (Case File #05-141) Historv: In 1995 Lots 1-3, Block 2, Westbury Ponds 2nd Addition were combined to create the 1.5 acre site and allow for the development of the property as a Fairview Medical Clinic. In 1995 a medical clinic with a Conditional Use Permit was a permitted use within the R-1 Zoning District. On April 3, 1995 a Conditional Use Permit was granted for the Fairview Medical Clinic at 4251 Willowwood Street SE. In 1999 the City Council approved the 2020 Comprehensive Land Use Plan Map to designate the subject property as C- NR (Neighborhood Retail). Consequently, the clinic is a legal nonconforming use ifit remains zoned R-1. On May 23, 2005, the Planning Commission held a public hearing on this item. The Planning Commission recommended approval of the Zoning Map Amendment because it is consistent with the comprehensive plan designation. Current Circumstances: The following are the physical characteristics of the subj ect property. Total Site Area: The site is approximately 1.5 acres in area. Wetlands: There are no wetlands located on the site. Access: Access to the site is from Willowwood Street. Zoning and Land Use Plan Designation of Adiacent Property: Existing Land Zoning Land Use Plan Use North Single family R-l, Low R-L/MD, Urban dwellings, Five Density Low/Medium Hawks School Residential Density South Previously C-4, General C-CC, County Market, Business Community McDonald's Retail Shopping East Faith Evangelical R-l, Low R-HD, Urban Church Density High Density Residential West Single family R-1, Low R-L/MD, Urban dwellings Density Low/Medium Residential Density The property is bounded by Hwy 13, Five Hawks Avenue, and Willowwood Street. Issues: The applicant is not proposing to change the use or the existing structure. Rather, the applicant would like to update the sites signage and will need to rezone the site to utilize the permitted signage within the C-1 Zoning District. The Zoning Code states; "The purpose of the 'C-J' Neighborhood Commercial Use District is to provide for low intensity, service oriented commercial uses for surrounding residential neighborhoods." Permitted uses in the C-1 use district include medical/dental offices, retail, offices, services, banks, museums, funeral homes, libraries, park/open space, and police/fire stations. The 2020 Comprehensive Plan states; "The C-NR category provides for smaller centers that are highly compatible with residential neighborhoods which typically will be within easy walking distance or within five minute driving time of residents within the primary neighborhood." The use as a medical clinic would appear consistent with the adj acent residential neighborhood. L\05 FILES\05 REZONE\Fairview Clinic\cc report.doc 2 CONCLUSION: ALTERNATIVES: RECOMMENDED ACTION: Section 1108.600 of the Zoning Ordinance identifies the following policies for amendments to the Official Zoning Map: · The area, as presently zoned, is inconsistent with the policies and goals of the Comprehensive Plan, or the land was originally zoned erroneously due to a technical or administrative error, or · The area for which rezoning is requested has changed or is changing to such a degree that it is in the public interest to rezone so as to encourage redevelopment of the area, or · The permitted uses allowed within the proposed Use District will be appropriate on the subject property and compatible with adjacent properties and the neighborhood. The current R-l zoning of the property is inconsistent with the C-NR (Neighborhood Retail) land use designation on the 2020 Comprehensive Land Use Plan Map. The proposed C-l zoning is consistent with the C-NR designation. Accordingly, the requested zoning map amendment will carry out the goals, objectives, and policies set forth in the Comprehensive Land Use Plan. The proposed R-l zoning is consistent with the R-L/MD land use designation on the 2020 Comprehensive Land Use Plan Map. Based upon the findings set forth in this report, staff recommends approval. The Planning Commission supported staff s recommendation. The City Council has two alternatives: 1. Adopt an ordinance approving the rezoning as requested. 2. Defer consideration of this item and provide staff with specific direction. Staff recommends Alternative # 1. This action requires the following motions: 1. The Prior Lake Zoning Map, referred to in Prior Lake City Code Section 1101.700, is hereby amended to change the zoning classification of the following legally described property from R-1 (Low Density Residential) to C-1 (Neighborhood Commercial). LEGAL DESCRIPTION: Lots 1-3, Block 2 of Westbury Ponds 2nd Addition, Scott County, Minnesota, This ordinance shall become effective from and after its passage and publication.
