LETTER OF INTENT • Re: 16030 Eagle Creek Avenue, Katherina & Robert Yurko (owners) INTRODUCTION: The diagram (Exhibit A) highlights a unique property condition within the city, where an county road right-of-way exists between Eagle Creek Avenue and the adjoining property addresses: 16000, 16010, 16020, 16030, 16044, 16058, 16072, 16084, and 16094. Some of these properties have existing garages located partially on their property and partially Within the county road right-of-way, while others have no garage and are intending to seek an agreement with the city that would allow them to construct a garage (partially within their property and partially within the county road right-of-way). Property owners, Katherina and Robert Yurko (16030) have 54 feet of frontage along the county road right-of-way, at a depth of 47 feet, and wish to keep and maintain their existing garage in the same manner of operation and in its current location (partially on their property and partially within the county road right-of-way). A new roof was put on the structure in 2014; The Yurko's plan to install new garage doors and put a fresh coat of paint on the structure in the future. They have received a Demolition permit for the existing cabin on the property and are seeking a Building Permit to construct a new home detached from this existing garage on their property, however they have been informed by Building Permit/Inspections staff that they must demolish it in order to get a Building Permit due to the City Code Zoning Ordinance, Part 11 Zoning, Section 1107.2300 Non-conformities: 1107.2302(4) A legal nonconformity may be continued at the size and the manner of operation existing at the time of adoption of this Ordinance, except as provided herein. (4) Damaged or Destroyed Structures. If the cost to repair a non-conformity involving a damaged structure is more than 50% of the County Assessor's market value of the structure at the time of the damage, the structure shall be removed or made to conform to this Ordinance within 12 months of the occurrence of the damage. To keep their demolition/building process moving, Katherina and Robert Yurko, owners of the property located at 16030 Eagle Creek Ave SE, Prior Lake, Minnesota, herby acknowledge the following conditions attached to the demolition permit on record with the City of Prior Lake. 1) Owners have placed $2,500 (value determined as 125% of two contractor estimates, see Exhibit B&C) in escrow monies with the City of Prior Lake and will seek an agreement to retain/maintain the detached garage located at 16030 Eagle Creek Ave SE, by following the process of approval from the city of Prior Lake Planning Commission and/or City Council. Favorable action by the Prior Lake Planning Commission and/or City Council would need to occur by March 26, 2016, (12 months after the start of the house building permit issuance), and would result in the owner being refunded their$2,500. 2) If owners are unsuccessful in formal requests to retain/maintain the detached garage at 16030 Eagle Creek Ave SE, the owner may elect for the detached garage demolition any time after the house demolition permit is issued.
